Biden’s “Normal”: The President’s Constitutional Takes are Becoming More Unhinged from History

The decision of the Supreme Court to end the use of race in college admissions was not unexpected. Indeed, the rulings in cases involving Harvard and the University of North Carolina ended decades of muddled 5-4 decisions. Yet, President Joe Biden seemed to go into full attack mode and actually claimed that the Court gutted the constitutional guarantee that “all men and women are created equal.” In declaring that this Court was not “normal,” Biden further insisted that these admissions decisions and the Dobbs abortion decision reversed the gains that “we fought a war over in 1860” to secure.

In an interview on MSNBC’s “Deadline: White House,” President Biden accused the Court of ignoring what “the Constitution says: We hold these truths to be self-evident, all men and women are created equal, endowed by their creator.” That is actually a reference to the Declaration of Independence, but it was the substance of the point that was so baffling.

In barring the use of race in admissions, the Court believed that it was protecting that very guarantee. It erased what the Court viewed as a glaring anomaly in its cases in the treatment of racial discrimination in education as opposed to employment. It was the capstone opinion for Chief Justice John Roberts who in 2017 declared: “The way to stop discrimination on the basis of race is to stop discriminating on the basis of race.”  In 2006, Roberts added: “It is a sordid business, this divvying us up by race.”

The Court was enforcing what it saw as the “self-evident” guarantee referenced in the Declaration and later protected in the Fourteenth Amendment. The Court reaffirmed that all men and women are created equal and will be treated equally in both education and employment.

The President is not alone in such hyperbole. Figures like Whoopi Goldberg actually asked whether the decision means that we are “heading to no women in colleges soon? Who knows.”

We actually do know. An opinion rejecting the use of racial classification to determine who goes to college could not be read by anyone as endorsing the exclusion of other groups.

The truly baffling statement was Biden’s claims over the Civil War. By leaving questions like abortion to the states, Biden claims that the Court was reversing what was gained in that war. The criticism came in response to an opinion insisting that there is no place for racial discrimination in higher education. That would hardly seem an argument that would be embraced by the Confederacy.

President Biden has long taken liberties with our constitutional history. Many of us have repeatedly objected to claims that he has made in areas like the Second Amendment. One of his most repeated lines is that the Second Amendment was passed with the understanding that certain guns would be banned and adding “You couldn’t buy a cannon, when in fact the Second Amendment passed.”

That happens to be utterly false. Yet, even after the Washington Post declared Biden’s understanding of the Second Amendment to be false, he has continued to make the same false assertion over and over again.

Now Biden has moved on to the Civil War and his revisionism is about as subtle as Sherman’s scorched “March to the Sea.”

The Civil War did not end federalism or states rights. It denied the right of the states to secede and ultimately fulfilled the pledge to equality first made in the Declaration of Independence.

One can have good-faith disagreements on whether the use of racial criteria is constitutional affirmative action or unconstitutional racial discrimination. However, Biden is belittling our prior struggles for equality with these sweeping and erroneous claims.

In his interview, the President also insisted that one has to “look at how it’s ruled on a number of issues that are — have been precedent for 50, 60 years sometimes, and that’s what I meant by not normal.”

In reality, the Court’s decisions on affirmative action in education have been muddled and conflicted for decades. In 1977, in Regents of the University of California v. Bakke, the Court barred affirmative action in higher education. However, it allowed some consideration of race as part of a holistic admissions process.

In the decades that followed, the Court remained sharply divided. By 2003, the Court was ready to issue the very decision that it issued this week. However, in Grutter v. Bollinger, then-Justice Sandra Day O’Connor supplied the fifth vote to uphold the use of race by the University of Michigan. Yet, O’Connor wrote that the court “expects that 25 years from now, the use of racial preferences will no longer be necessary to further the interest approved today.” That was roughly 20 years ago.

It is also ironic to hear the President bewailing the reversal of precedent since the greatest advance in racial equality was the reversal of Plessy v. Ferguson and the doctrine of “separate but equal.” That was the governing precedent from 1894 to 1954, but few denounced the Supreme Court for reversing the precedent in Brown v. Board of Education. It was a decision to eliminate different treatment on the basis for race.

This Court did indeed overturn long-standing cases but these have long been areas characterized by closely and fiercely divided 5-4 and plurality decisions.

The President also asserted that “the vast majority of the American people don’t agree with a lot of the decisions this court is making.” The majority clearly opposed the Dobbs ruling, but that is not the case on the affirmative action ruling. Polls have consistently shown (including this week) that the majority of the public does not support the use of race in college admissions. Indeed, even in the most liberal states like California, voters have repeatedly rejected affirmative action in admissions.

We should have a robust and passionate debate over these issues. Yet, a president should be seeking to facilitate that dialogue rather than distorting and weaponizing our shared history. It is a continuation of his prior declarations that members of Congress opposing his election reforms to block state laws are voting with “Jefferson Davis” and the Confederacy. Despite the laws in states like Georgia being upheld as constitutional, Biden declared them a return to the “Jim Crow” South based on distorted accounts of those laws. The claim was again historically and legally ridiculous even if one opposed these state laws.

We should not allow the President’s constitutional and historical distortions to become, to use his description of the Court, “normal.” We have fought hard to address the scourge of slavery and racism in our country. That struggle is continuing but we cannot address those problems in the future by distorting our past.

    Pres. Biden is at best a poor spokes person for the nonsense and lies of the modern progressive left.

    The important quesiton is why do any of the rest of us listen to people who lie whenever they speak about anything.

    The president – and many here and in the media are touting Bidenomics.

    In what world do we pat ourselves on the back for economic destruction ?

    At this moment in time we are seeing multiple examples accross the entirety of human endeavor demonstrating the failure of popular ideas of the left.

    There is a legitimate reason to be concerned regarding the federal student loan program – it has made colleges bloated and richer and saddled graduates with heavy debt burdens. All to deliver declining education quality. Something does need to be done. But that is not to make the problem even worse.

    End government subsidized Student Loans – They clearly do not work.

    We saw much the same with Covid – We can fight over details but the FACT remains – Government did not keep us safe and ultimatley did much more harm than good. We can and should debate the merits of specific policies – but it is inarguable that the overall effect of government intervention in the epidemic was More deaths and greater economic and other harms.

    Those of us old enough to remember learned or should have learned the FACT that government control fo the economy FAILS – often bloodily from the disaster that was 20th century communism. Yet here we are today with the left shilling for permutations o the same nonsense that has failed forever.

    More recently we spent $6T on economic stimulus – with disasterous results. MMT should be permanently put onto the dustbin of history.
    But so should Keynesian and neo-keysnian economics.

    We get ever increasingly large scale evidence that the various thesis of the left – even the less extreme parts of the left FAIL.

    And yet the nonsense refuses to die.

    Why should it surprise you that Biden is spewing utter nonsense ? Even you still hold onto several repeatedly disproven sacred cows of leftist orthodoxy.

    We must learn from our actual experience what works and what does not. We have ample opportunity to do so.
    I have cited only a few examples of clearly failed ideas. We must open our eyes to those failures and quit trusting those who have been repeatedly wrong.

    We have reached a point where those on the left and those on the right are constantly talking of jailing or even hanging those we disagree with – those who have lied to us. While there are a few instances where people have committed real and clear crimes and should be prosecuted, the punishment for those Like Fauxi who imposed bad advice on us often by force is that no one should ever believe them again.

    The lynchpin of a free society is trust. Billions have been made int he free market figuring out how to conduct trustworthy free exchange between two people who never met and do not know each other.

    The most important currency in the world is trust. And so often the left is litterally trying to destroy that.

    If you loan money to those you do not expect to pay you back – that is not a loan – it is a gift.

    The most critical factor in success is trust. Trust is earned – by doing what we say we will. By paying our debts, by keeping our promises, by speaking truth. and by being right when we provide advice.

    Some of us create prosperity for the rest of us by earning our trust and delivering massively to our benefit.

    But ALL of us are a part of that process – because we all have a role in deciding who we trust.

    When you vote for people who lie constantly. who do not deliver on their promises and who when they actually do cause disaster. You harm yourself and everyone else.

    Biden is NOT the problem.

    There are always charlatans selling the brooklyn bridge.

    The problem is that so many Believe they are buying the brooklyn bridge from people who have lied over and over to all of our harm and without consequence.

    The left is the emporer from the emporers new cloths and the rest of us are the fawning psychophants unable to admit what is plain as day – this nonsense does not work, and those shilling it are unworthy of our trust – and never should have had it in the first place.

    If women are “birthing people”, “lactating people”, and “menstruating people”, then, to be fair, males should be referred to as “sperm producing people”. They really do need to update birth certificates.

    Then maybe the male gender will be “people assigned sperm producing people at birth”.

  3. Biden is not suffering from cognitive decline. It’s just that, because he is in the public spotlight to a greater extent than at any time in his life, the public can now see him for the mean-spirited idiot he has always been.

    1. Except through our own empiricism, (“Be empirical, LOOK!”) we can’t answer the question of whether Biden suffers from cognitive decline. Yet, I and a few billion other people must believe our lying eyes which say: 1) he is neurologically impaired, with commonly displayed verbal, mental, emotional and physical symptoms of dementia and alzheimers and 2) that neurological impairment aside, Biden is a very low IQ person, probably stupid, but no more so today than ever before. I.e., He’s very dumb (say IQ circa 85-95) but he’s not getting dumber. He’s as dumb as he gets and as dumb as he always was. He was this dumb when he first went into politics 50 yeras ago and Delaware voters liked what they saw and elected him, again and again and again. He was this dumb when he ran for President, every time he ran. He was this dumb in 2020 when voters selected him to be America’s President over a notably intelligent, mentally impressive competitor. Biden was this dumb for the first years of the Biden Administration when he did nothing right and said most things wrong. But even assuming Biden has an IQ of 95 (stretching it,) per psychologist Jordan Peterson, such a low IQ person is unable to function in today’s world and unable to work at a job level other than fast food.

      That state of Biden’s mental disunion is a national existential concern of world crisis proportions. The mentally deficient, feckless moron Joe Biden could destroy planet earth and not even know what he’s doing. Every Republican should be harping about that every day, and every media platform should be harping on it every day, and every Democrat should be ashamed of that all day every day forever until Biden is driven from office.

      Mrs. Biden and his brother and children, for the love of God, country, family and Joe, should pull Joe off the stage NOW.

It is important to note, however, that the decisions of a mean-spirited, mentally deficient, radical leftist, however, are no different those of a kindhearted, mentally sharp, radical leftist. Radical leftist decision making is a function of ideology, not thoughtful analysis. If Joe could somehow be given a kind nature and a high-IQ, his decisions would be no different.

        1. It is certainly psychologically interesting to know if mental impairment or low IQ is causally related to (or at least directly correlated with) anti-social behavior. (An exasperated Justice Holmes seemed to think so in Buck vs Bell: “Three generations of imbeciles are enough.”) Also, low IQ criminals may be so dumb and have such an impaired capacity to differentiate right from wrong that they do not appreciate the evil they commit. For the practical purposes of morality in governance and law and order in society, it would seem that intelligent criminals are more skilled than low IQ Biden-types at carrying out crimes requiring brains (and all crime requires brains) and evading law enforcement and escaping punishment. But, again, is immoral/criminal behavior directly correlated with intelligence? In Biden’s case, probably not. (Yet, he evokes a cunning that smacks of high intelligence at least in evading accountability.) IQ and mental proficiency surely correlate directly with wealth, power and status, so that smarter crooks have more wealth, are more politically connected and, as Biden has done, use their influence a) to “fix” the system politically (as low IQ Biden does better than anyone else) and b) to hire the best, most expensive investigators and defense counsel (Biden has the DOJ/FBI,) thus minimizing their risk of punishment.

    Trump’s appointees have overturned Roe v Wade, repealed environmental rules invented by the EPA, prohibited race-based college admissions, recognized that the president may not force taxpayers to pay off the college loans of their fellow Americans, and recognized the right of business owners, for religious reasons, to refuse to design same-sex wedding registries.

      It’s a little subtler than that but you are on the right track. Yes, Gorsuch, Kavanaugh and especially Barrett (because she replaced Ginsburg) are important but Alioto remains the intellectual linchpin with a backbone. Roberts is a weak kneed swamp dweller and Kavanaugh looks to be cut from the same cloth (will especially lose his spine completely when the Dems – inevitably – get a fourth Justice).

      Casy overturned Roe in 1991 or 1992; last year the current six overturned Casey, which was more important because everyone including Ginsburg agreed Roe was just nonsense. I think it was Bakke that actually prohibited race based admissions but then in another case the spineless cowards that proceeded the current crop gave colleges 25 years to end it. The colleges admitted this year that they have no intention of doing that ever so the Court confirmed Bakke once and for all.

      And the Colorado case had nothing to do with religion or gays or weddings; Sotomayor claimed that the GOP could force Rob Reiner to make ads next year in favor of Ron DeSantis in his presidential run against Gavin Newsome. That of course would be ridiculous and this Court put an end to such nonsense in all walks of life… the two preceding GOP courts would never have even taken the case.

      Now next step: get some cojones, stop this “we’re above the fray” stuff and fight back against Biden and Whitehouse in public speeches and op eds and Twitter for that matter. Every issue has been primarily (Colorado, AA were exceptions) about Executive fiats from presidents of both parties running roughshod over Congressional inaction by both parties. Call them all out on it.
