Rubin and Tribe Under Fire for Using the Massacre in Israel for Bizarre Attacks on Political Figures

In academia, one of the most common criticisms in research and discussions is that correlation does not mean causation. It refers to the logical fallacy for some who draw a cause-and-effect relationship between two events. The logical fallacy is captured in the Latin phrase cum hoc ergo propter hoc (‘with this, therefore because of this’). With the horrific attacks on Israel this week, some well-known commentators have been criticized for using the killing of hundreds by Hamas as a criticism of conservative figures or Republicans in general. That includes the Washington Post’s Jennifer Rubin who appeared to blame the GOP for inviting the attack and Professor Laurence Tribe who suggested (and later retracted) that the war was actually a “wag-the-dog” operation by Prime Minister Benjamin Netanyahu to distract from corruption allegations.

Rubin (who goes by the moniker “Jennifer Truthful, Not Neutral Rubin”) immediately attempted to use the attack as another attack on Republicans: “How about this: With US House in chaos and US military promotions on hold, Hamas struck. Republicans’ weakness invites terror.”

Putting aside the effort to use this tragedy as a political cudgel domestically, Rubin ignores the fact that the motion to vacate the chair succeeded due to a unanimous Democratic vote and just eight dissenting Republicans. The Democrats wanted to vacate the chair even though McCarthy was being criticized by the dissenters for working with them and they will now likely receive a far more strident speaker.

Rubin has also called for expelling Republican members, who voted against certifying the 2020 election. She further declared that “we have to collectively, in essence, burn down the Republican Party. We have to level them because if there are survivors, if there are people who weather this storm, they will do it again.”

The Washington Post has repeatedly failed to take down or correct columns containing false claims by Rubin. Instead, it has run her calls to end impartiality and neutrality in journalism.

Now Rubin is suggesting that Hamas decided to launch this massive attack because there is an acting Speaker in the House until next week. It appears that Hamas was just waiting for the motion to vacate to pass.

Laurence Tribe immediately used the massacre to attack Netanyahu. Citing the Washington Post, Tribe wrote “Is Netanyahu wagging the dog of war to take attention away from his own war on the independent judiciary? Can anyone put that past him?”

The response was fast and furious. It was even too much for figures like Keith Olbermann who condemned Tribe stating, “Well this is a moronic and indefensible POV.”

What was striking is that the media finally called out Tribe, who has regularly posted bizarre legal theories and personal attacks against conservative figures, including attacking Bill Barr (erroneously) over his faith. On MSNBC and other outlets, Tribe regularly makes profane or personal attacks against those who hold opposing views of constitutional interpretation, including myself. These attacks include false assertions that had to be later corrected.

These controversies highlight the need to restore an element of maturity and civility to commentary. The “everything-goes” mentality has now taken hold of major media outlets, which regularly feature trash talking and sensational claims. If the target of these attacks is a conservative or Republican, there is a sense of license to remove the safeties in public engagements.

Once again, it is possible to restore a modicum of civility and accuracy in our public discourse. All it takes is for people of good faith to turn away from the rage and return reason in our commentary.

    Iranian Lawmaker Says Part Of Freed Funds Will Go To Central Bank

    A senior Iranian lawmaker said Friday that part of Iran’s $6 billion released by the United States must go to the central bank to cover money already spent. Mohammad-Reza Pourebrahimi, the chairman of the Iranian parliament’s economic committee was quoted by local media as saying that part of Iran’s freed assets needs to be directly deposited to the Central Bank of Iran, as the previous government of President Hassan Rouhani has spent the amount to cover government’s expenditure.

James has been doing this since she stepped into office. She didn’t start with DJT and she won’t end with him

    The big Q is why didn’t DJT incorporate some place else? He could have done that 15 to 20 years–or even after he became president in 2016. DJT decided to stay in NY because he thought he could beat the system as he had done for years. That was also a fatal error. DJT didn’t bank on AG James. When she first filed her lawsuit against the Trump Organization a little over a year ago DJT finally realized he needed to move his assets out of her reach. He tried to reincorporate in Delaware. But it was too little, too late. James got wind of DJT’s attempted end run and informed Judge Engoron. He immediately stopped DJT’s attempt to escape liability and reincorporate in Delaware.

    So getting back to my opening, DJT had many opportunities to find a more business friendly environment. Perhaps out of hubris or because his is a malignant narcissist, DJT decided to stay in NY. So he now faces the largest business fraud prosecution in NY history. If DJT wants to point the finger of blame at anyone, he should point it at himself!

          1. Young, you read a lot of history that probably included On the Origins of War, a book written by Yale’s extraordinary historian, Donald Kagan. He tells us the most important thing necessary to prevent wars from reoccurring. There must be a clear victory where the victorious side wins.

            Since 1948, wars and terrorist attacks against Israel did not end. Israel won all but was prematurely stopped from final victory by the US.

            If we wish for peace in the Middle East between the Palestinians and Israel, Israel must, for the present, occupy the Gaza Strip and destroy Hamas. Gaza was given independence by Israel without anything in return except for the hope of peace. Israel then provided Gaza with assistance to provide for its needs and stability.

              All should have learned that lesson from General Pershing.

              As WW1 approached its end with the German army in collapse armistice proposals were opposed by Pershing. He called for a little more fighting to compel unconditional surrender of the Germans.

              Pershing’s proposal likely would have cost a few thousand more lives and was rejected in favor of an armistice that 21 years later cost many millions of lives.

              The armistice gave room for German radicals to claim the army was not really defeated but was stabbed in the back by disloyal Germans, particularly Jewish Germans.

              And so the door to power was opened to Hitler and his ilk.

              Nothing less than absolute victory and elimination of the Gaza terrorist entity should be the wish of every civilized person and the goal of all who can see to it.

        George, that is your first mistake. You don’t understand the use of the name Palestinian. Look at the NYTimes post WW2. They talk about the Palestinian farmers. They were Jews. Somehow, someway you got confused when a different group started using that name. The Palestinians became known as Israelis and the Arabs from Egypt, Jordan, Syria, Sudan and elsewhere became the Palestinians.

        All the boundaries were artificially created except the Jews are the oldest civilization existing today to live in the lands of Israel, Judea and Samaria.

  18. The issue has been skewed to the determent of the Palestinians’. Those advocating peace has been cast aside by the radical element of Hamas, and for what? Do they really think this will solve any problems or unite the average citizen of Gaza? The ignorance resulting in death of fellow citizens will not help them in the ultimate wish of statehood or the total demise of Israel, but further entrench the belief that there can be is no pathway in finding a solution to the long-fought conflict. They have not changed their ideology since Arafat, which is to reach out for the hand of peace until the last moment then throw a punch to the face. These attacks will further split the Middle East into chaos.

    I can hypothecate that Iran has a hand in this, but it could well be other players have taken the cause under wing in hopes that America will be drawn further into a new conflict wasting our resources and administrative efforts.

    This conflict was not spur of the moment, it had to have taken a considerable of time and planning, attacks were multi directional, invasions, rockets etc. and had to be coordinated.

    Now if Iran was the instigator (planning and financial support) they will ultimately pay the price, dividing the affected neighboring countries. This is a very dangerous game to be played without knowing the ultimate ending.

    Regarding the any culpability of a political party or their member’s actions or inactions is just foolish pit-er-patter, a diversion of the facts that are still unknown. As Rumsfeld said, “there are known knowns, known un unknowns and unknown unknowns.” So, a word of advice to all, “hold your fire until you see the whites of their eyes”.

      The Biden admin has grossly displayed their incompetence and weakness practically from day one.
      And the whole world saw it.
      For our enemies and friendemies the Biden admin was the greatest gift they could of been given.
      And they are taking advantage of it.

        Biden is corrupt, and that corruption leaves him weak and open to extortion by our enemies. That alone contributes to this type of terror.

        But he does more. He sends money that promotes terrorism and pays the families of the terrorists who died.

        Biden pays for hostages and funds the rogue regime of Iran, which then funds Hamas and Hezbollah. Iran is the most active state that supports terrorism.

        We can look at Afghanistan, the increasing instability between China and her neighbors, Ukraine, our Southern border, our economy, etc., and see that it was a mistake for anyone to support his rise to the Presidency. I can’t think of a more terrible President in my lifetime.

      I wasn’t trying to discount the fault of the dunderheads in the White House or the leftist lazy attitudes to diplomacy. The left has been the cause for the majority if not all the troubles in the Middle East since Israel was founded. They stand with Israel one day then the next they don’t, always putting the wetted finger up to see which way the wind is blowing. They in general have no backbone which is exampled daily in American cities run by the left. Another major fault of the left was at the conclusion of World War 1, when they divided up what is now known as the Middle East.

      One other item that shows how incompetent the administration is, moving assets of the 6th fleet, ‘We’ll show them wont we”.
