
In academia, one of the most common criticisms in research and discussions is that correlation does not mean causation. It refers to the logical fallacy for some who draw a cause-and-effect relationship between two events. The logical fallacy is captured in the Latin phrase cum hoc ergo propter hoc (‘with this, therefore because of this’). With the horrific attacks on Israel this week, some well-known commentators have been criticized for using the killing of hundreds by Hamas as a criticism of conservative figures or Republicans in general. That includes the Washington Post’s Jennifer Rubin who appeared to blame the GOP for inviting the attack and Professor Laurence Tribe who suggested (and later retracted) that the war was actually a “wag-the-dog” operation by Prime Minister Benjamin Netanyahu to distract from corruption allegations.
Rubin (who goes by the moniker “Jennifer Truthful, Not Neutral Rubin”) immediately attempted to use the attack as another attack on Republicans: “How about this: With US House in chaos and US military promotions on hold, Hamas struck. Republicans’ weakness invites terror.”
Putting aside the effort to use this tragedy as a political cudgel domestically, Rubin ignores the fact that the motion to vacate the chair succeeded due to a unanimous Democratic vote and just eight dissenting Republicans. The Democrats wanted to vacate the chair even though McCarthy was being criticized by the dissenters for working with them and they will now likely receive a far more strident speaker.
Rubin has also called for expelling Republican members, who voted against certifying the 2020 election. She further declared that “we have to collectively, in essence, burn down the Republican Party. We have to level them because if there are survivors, if there are people who weather this storm, they will do it again.”
The Washington Post has repeatedly failed to take down or correct columns containing false claims by Rubin. Instead, it has run her calls to end impartiality and neutrality in journalism.
Now Rubin is suggesting that Hamas decided to launch this massive attack because there is an acting Speaker in the House until next week. It appears that Hamas was just waiting for the motion to vacate to pass.
Laurence Tribe immediately used the massacre to attack Netanyahu. Citing the Washington Post, Tribe wrote “Is Netanyahu wagging the dog of war to take attention away from his own war on the independent judiciary? Can anyone put that past him?”
The response was fast and furious. It was even too much for figures like Keith Olbermann who condemned Tribe stating, “Well this is a moronic and indefensible POV.”
What was striking is that the media finally called out Tribe, who has regularly posted bizarre legal theories and personal attacks against conservative figures, including attacking Bill Barr (erroneously) over his faith. On MSNBC and other outlets, Tribe regularly makes profane or personal attacks against those who hold opposing views of constitutional interpretation, including myself. These attacks include false assertions that had to be later corrected.
These controversies highlight the need to restore an element of maturity and civility to commentary. The “everything-goes” mentality has now taken hold of major media outlets, which regularly feature trash talking and sensational claims. If the target of these attacks is a conservative or Republican, there is a sense of license to remove the safeties in public engagements.
Once again, it is possible to restore a modicum of civility and accuracy in our public discourse. All it takes is for people of good faith to turn away from the rage and return reason in our commentary.

Joe Biden released $6 billion in frozen assets to Iran, a terrorist nation, who begins each day in its schools chanting, “Death to America! Death to Israel!” Hamas has publicly thanked Iran for its material support in its terrorist attack on Israel.
This was not a military exercise over disputed territory. This did not have military objectives. The objective was for homicidal antisemites to kill, torture, rape, and kidnap as many Jews as possible. Hamas’ slogan is “We love death more than Jews love life.” Their goal is to kill all the Jews. They are no different than Nazis. When you visit a Holocaust museum, one of the most heartbreaking sights are the piles of children’s shoes, remnants from the gas chambers. Hamas has uploaded videos of them deliberately murdering entire families, shooting babies, raping mothers, while antisemites around the globe cheer. Hamas itself uploaded a video of a woman raped and sodomized until the seat of her pants ran with blood, dragged by the hair by a terrorist into a car packed with more rapists, who will likely kill her in the end. Hamas took video of the body of a German tattoo artist, in her underwear, likely gang raped, dead, beaten so badly that her legs were bent backwards and hips looked dislocated.
This wasn’t an instance of a US or European soldier going rogue and assaulting women. This was en masse. The entire purpose of the excursion was to rape, torture, kill, like thousands of demented serial killers.
The Left relies upon their audience lacking all critical reasoning. To claim that changing the Speaker of the House meant the terrorists would attack Israel, but not Joe Biden releasing $6 billion to Iran, thanked publicly by Hamas for its planning and resources, is ludicrous.
People should check out Ben Shapiro’s show on dailywire.com. He has an anguished episode on his show in response to the moral equivalence so prevalent in the media today. There is no “cycle of violence.” There are terrorists trying to kill all the Jews, and the Jewish state beating them back while trying to minimize civilian casualties.
It’s like saying if someone breaks into your home, rapes your wife, kidnaps your little girl, and the husband arrives to shoot them dead, that it’s a “cycle of violence” instead of self defense.
If there is any silver lining, it’s that Hamas has revealed to the world that it is indeed a terrorist organization that exists to kill and rape Jews. Their 16 year old daughter and 14 year old son were just at our ranch yesterday. It could have been all of them on the news.

Not all Palestinians support Hamas, and Hamas wouldn’t have the foothold it does if Israel respected the rights of Palestinian people and their property rights. The US refuses to speak out against Israel when it sets up residences in Palestinian territory and drives out Palestinians–something the U.N. has condemned–and that’s just one of the root causes of the conflict. So, if Israel goes in to Gaza and other Palestinian areas and starts slaughtering people to get revenge, cuts off utilities, food and medicine upon which non-Hamas-supporting Palestinians rely–this will only strengthen Hamas and keep the conflict going. Other Muslim countries might get drawn in, too, and there might be an all-out war. Even if Hamas is totally obliterated, another group would take its place. If there’s to be peace in the region, the rights of Palestinians have to be supported.

Slaughtering innocent Palestinians to get revenge for the Hamas killing innocent Israelis is wrong, and the US should not support doing so, because we would be complicit in assisting in the commission of war crimes. As you say, killing unarmed civilians is a war crime. If the US is complicit in and supports such killings, we can expect more retribution from other radical Muslim groups.

Israel’s occupation of Palestinian territory is unlawful under international law due to its permanence and the Israeli government’s de facto annexation policies, a UN-appointed Commission of Inquiry said in its first report, published on Thursday.
The three-member Commission is pushing for the issue to be referred to the International Court of Justice (ICJ), the UN’s highest court.
They stressed that under international humanitarian law, the occupation of territory in wartime is a temporary situation and does not deprive the occupied power of its statehood or sovereignty.
A core UN principle
“Recent statements by the Secretary-General and numerous Member States have clearly indicated that any attempt at unilateral annexation of a State’s territory by another State is a violation of international law and is null and void; 143 member States including Israel last week, voted in favour of a General Assembly resolution reaffirming this,” said Navi Pillay, the Commission Chair.
“Unless universally applied, including to the situation in the Occupied Palestinian Territory, this core principle of the United Nations Charter will become meaningless”, she added.
The Commission has called on the UN General Assembly to request an urgent Advisory Opinion from the ICJ on the legal consequences of the occupation.
Settlement ‘enterprise’ studied
For their report, the Commissioners reviewed the policies and actions Israel has used to maintain the occupation and annex parts of the Occupied Palestinian Territory.
They focused on how Israel has sustained and advanced its “settlement enterprise”, including statements made by Israeli officials indicating the intent to maintain permanent control over the land in violation of international law.
The Commission concluded that by continuing to occupy the territory by force, Israel incurs international responsibilities and remains accountable for violations of the rights of the Palestinians, both individually and as a people.
“By ignoring international law in establishing or facilitating the establishment of settlements, and directly or indirectly transferring Israeli civilians into these settlements, successive Israel governments have set facts on the ground to ensure permanent Israeli control in the West Bank,” said Ms. Pillay.
Restrictive land policies
The Commission also reviewed Israel’s expropriation and exploitation of land and natural resources, and its restrictive urban planning and zoning policies in the West Bank.
Land is often confiscated for military purposes but then used for settlement construction, the report found.
The Commission reviewed statements by Israeli officials indicating that Palestinian construction is seen as an impediment to settlements, requiring action such as confiscation, demolitions and displacement.
Similar processes were also seen in East Jerusalem, where restrictive planning and zoning have contributed to shrinking space for Palestinians.
‘Silent harm’ and trauma
The report also addresses Israeli Government policies that have had an impact on all aspects of Palestinian life, such as access to clean and affordable water.
“There is so much ‘silent harm’ and psychological trauma, that may not be immediately apparent, resulting from the erosion of economic, social and cultural rights. These debilitating processes have severe short and long-term consequences and must be urgently addressed”, said Commissioner Miloon Kothari.
The Commission also examined how the occupation and de facto annexation policies have affected Palestinian human rights, as well as the impacts on Palestinian women and children.
The “coercive environment” which forces Palestinians to leave their homes has fragmented Palestinian society and hampered the right to self-determination, the report said.
International action required
The report concludes by saying that some of the Israeli government policies and actions may constitute “elements” of crimes under international criminal law, including the war crime of transferring part of your own civilian population into occupied territory.
“The actions of Israeli Governments reviewed in our report, constitute an illegal occupation and annexation regime that must be addressed,” said Commissioner Chris Sidoti.
“The international system and individual States must act and uphold their obligations under international law. That must begin at this session of the General Assembly with a referral to the International Court of Justice.”
About the Commission of Inquiry
The Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel, receives its mandate from the UN Human Rights Council.
The Commissioners are not UN staff and they are not paid for their work.
They will present their report to the UN General Assembly on 27 October.
Israel announced yesterday it was cutting off all water, electricity and other utilities to Palestinian territory to retaliate against Hamas. Defending yourself against an attack and retaliating against innocent people are not the same thing. Retaliating by cutting off water, electricity, food and medical supplies will NOT end the strife–it will only escalate the situation and punish people who are NOT part of Hamas, all of which will may cause other Middle Eastern groups to support Hamas. The judiciary change, presented by the most right-wing government in the country’s history, seemed to threaten Israel’s liberal nature. Israelis felt that they were fighting for the soul of the nation and that in this fight, all bets were off and nothing was sacred — including the once-untouchable idea of shirking reserve duty in the army.
Despite the turmoil in the streets, the ruling coalition refused to accept the fact that with a slim majority, it could not enforce such big changes without consensus, plowing ahead with ever more anxiety-inducing policies day by day.

So this idea that Democrats had an obligation to save McCarthy stands logic on its head! Democrats would have been indirectly supporting Trump’s waterboy!!
