Yesterday, I posted the account of one of my children who followed another student at George Washington University as she tore down flyers of the Hamas hostages from poles around campus. The vandalism near our law school is occurring across the country as activists seek to prevent others from expressing their views on the war. When I posted the GWU incident yesterday, I noted that this is behavior that has been reinforced by faculty members who have engaged in violent and destructive conduct for years targeting pro-life and other causes. One such incident involved an adjunct professor at City University of New York. Callen Zimmerman is also accused of shoving a person confronting her on her actions.
The videotape below shows Zimmerman ripping up flyers of the Hamas hostages. When a couple of people object, she tells them to “go colonize somewhere else.” The incident follows videotapes of students ripping down such flyers across the country, including one such incident at George Mason University.
Zimmerman was listed as teaching a course on the Stony Brook University website, where she is studying for a PhD in “Women’s, Gender and Sexuality Studies.” The bio stated that “Callen Zimmerman explores intricacies of material culture and queer experience, as fashion freak, educator and maker.”
As I have previously written, these recent incidents are little surprise for many of us who have been critical of the growing intolerance for opposing viewpoints on campuses for years. Many of these faculty members are part of a radical chic that has been the norm in hiring.
Universities are increasingly awarding degrees in activism, often taught by faculty who blur any distinction between academics and advocacy. Other faculty members have taught by example in destroying displays of opposing views. Universities have often done little to counter such faculty vandalism.
This year, Hunter College Professor Shellyne Rodríguez was shown trashing a pro-life display of students.
She was captured on a videotape telling the students that “you’re not educating s–t […] This is f–king propaganda. What are you going to do, like, anti-trans next? This is bulls–t. This is violent. You’re triggering my students.”
Unlike the professor, the students remained calm and respectful.
One even said “sorry” to the accusation that being pro-life was triggering for her students.
Rodríguez continued to rave, stating, “No you’re not — because you can’t even have a f–king baby. So you don’t even know what that is. Get this s–t the f–k out of here.” In an Instagram post, she is then shown trashing the table.
Hunter College, however, did not consider this unhinged attack to be sufficient to terminate Rodríguez.
It was only after she later chased reporters with a machete that the college fired Rodríguez. She was then hired by another college.
That of course is the point. She is a professor and was teaching these students that they do not have to allow others to speak if they oppose their viewpoints.
This has been going on for years.
Fresno State University public health professor Dr. Gregory Thatcher, recruited students to destroy pro-life messages.
At the University of California Santa Barbara, professors actually rallied around feminist studies associate professor Mireille Miller-Young, who physically assaulted pro-life advocates and tore down their display.
Despite pleading guilty to criminal assault, she was not fired and received overwhelming support from the students and faculty.
She was later honored as a model for women advocates.
Rather than put up their own flyers with their own views, the faculty and students destroying the flyers of Hamas hostages reflect a view that they are entitled to silence others. They view free speech as preventing others from reading or hearing opposing views. That is also a lesson that has been taught by faculty members for years. Academics like former CUNY law dean Mary Lu Bilek even insisted that disrupting a speech on free speech was free speech.
Notably, some of the faculty who are objecting to the intolerance and threats on campuses in these recent incidents have been silent for years as their colleagues have been targeted in such campaigns over conservative, libertarians or dissenting views. These incidents show how such silence has only emboldened and expanded the anti-free speech movement in higher education.

Upstate, the media draws the line and sets in the markers. From what I read, if you draw the line and place the marker in the center, most Americans fit to the right of the marker. Posters are put up all the time on public property. Garage sale and open house home sales. If I don’t like a house for sale sign because I think it is defacing government should I be allowed to tear it down. What a question???
Plus if you’ve ever been on a college campus or lived near one, the putting up of posters is takes place on steroids, with umpteen fliers going up on any and every topic imaginable. In that environment it would be surprising to see a public surface without a flier.

The photo is dated September, which was after the event.
There are even laws in most jurisdictions covering the posting and removal of such posters.
Typically they are legal to post – though if they are on private property you may need permission.
But the poster is obligated to remove them after a specified period.
Conversly third parties removing them before they expire is vandalism – a crime, if only a small one.
I do not know why and I have not seen a credible explanation for why anyone, especially a lesbian or gay person, would support what Hamas has done in Israel. I accept the fact that those who act as this “lecturer” did keep themselves ignorant of facts that contravene what they want or feel they need to believe, but how can anyone be so ignorant of facts to not know that Iran, Hamas, Hezbollah and the other aligned tribes not only have pledged the destruction of Israel but also have destroyed and will continue to destroy homosexuals when they find them? Surely they have heard of this and if they had just a little bit of curiosity, a few minutes of research would reveals stories in such publications as the Atlantic and the New York Times reporting on such things. Perhaps there is a moral difference in her mind between people who are born homosexual from those who are born Jew so that Mehrdad Karimpour and Farid Mohammadi did not deserve to be hanged just over a year ago by Iran for being gay, while Jewish babies deserved to be beheaded because they were Jews. One thing is certain. Neither she nor her fellow travelers have spent much time in an environment where they were held accountable for criminally stupid thinking, whether at home or in school.
They also pledge the destruction of Christians. Lets not forget that. That is their history. Jews are merely a stepping stone.
It is instructive to see videos and read comments by the Left on how Israel must cease fire, America should not support Israel, denounce Jews, and essentially personify Nazism. When it comes to Ukraine, the Left do 180 degree turn and insist on arming Ukraine, demand the US give unlimited amounts of billions of US dollars to Ukraine with no accounting on where it has gone, and showing concern about supporting Ukraine makes one pro-Putin.

Estovir– I agree with everything you’ve said. We seem never to learn, or at least never retain what we learn. After WWII, we saw the incredible power of propaganda and what it could do in the wrong hands. The constant drumbeat of hateful messages about Jews in Hitler’s Germany was one of the big reasons a Christian people like pre-WWII Germans accepted the “relocation” and extermination of Jews. From that day to this, knowing the danger, if we had focused students on real education, part of it would have trained them to think critically and not simply let information– propaganda– wash over them. Instead, we let our education system drift into things that have proven to be incubators for “progressive” ideas, carefully shielding students from any contrary views, even though what they are being taught is not anchored in any recognizable reality. Callen Zimmerman, obviously a product of this system, is untroubled by supporting people who would rejoice at torturing and murdering a lesbian like her as much as Jews. Most of our news media has adopted propaganda, euphemistically called “advocacy journalism,” as their professional model. I usually am optimistic but right now I do not see a way for us to dig ourselves out of this hole.

I found it interesting, but also thought it was a bit broad stroke depiction of Jews concerning progressive causes.
I have several Jewish friends ranging from what I would call progressive to conservative.
The conservative ones felt the Biden Admin was not a friend to the Jewish community and even less so towards Israel. One said he felt fear of this admin. He preferred Trump by far.
I grew up in a progressive Jewish family, so I have a little insight on the matter. Just briefly, I would add to what Kunstler says by pointing out that progressives (other than the cynical ones driven solely by power-hunger) tend to have an academic bent; they deal in highly abstract ideas which in theory work well, but in reality don’t work as well. In that world of theory, smart people can come up with complicated ways of ordering society to be nearly utopian. It always involves a huge role for the government, and hence, they tend to favor government-based solutions for most problems (hence they are progressives). But it is based on an unrealistic view of human nature, which is not accounted for very well in the abstract schemes.
Now you combine that with the facts that (a) Jews tend to have an academic bent and are overrepresented in academia, and (b) the Tikkun Olam driving force, and, voila! you have a large percentage of Jews attracted to the Democratic party. All that is changing now, as you yourself have observed. The left-wing reaction to 10/7/23 is a watershed. I believe when we look back we will see it as a turning point at which Jews realized progressives were not their friends and began to look elsewhere in large numbers.
Lawyer, I am not surprised that LGBTQ+++++ is supporting Hamas. If Republicans and Christians support Israel then Hamas must garner their support. The First Amendment clearly allows individuals to post flyers, subject to certain restrictions on where they can be posted.
The more interesting legal question is whether there is a First Amendment right to remove a flyer, and whether this is a First Amendment right to cover up a flyer with one’s own flyer. To me, these actions are the same and should have similar protections as they both effectively result in one’s expression at the expense of the speech rights of the individual, whose flyer was removed or covered.
That’s an interesting point. Is it anti-free speech to post flyers on top of others? Instead of ripping off others posts why not post on top? It’s the equivalent of countering “bad” speech with more speech.
Given this blogs focus on free speech I am constantly surprised at the lack of understanding of fundimentals.
I will Try to review the general principles – that our laws must conform to – not specific laws in places like NYC.
To my knowledge there is only one type of speech that is universally barred based on content in all contexts – that is child pornography.
You may not show it publicly or privately. publish it. posses it produce it. You can not even fake it.
Except for child pornography I am not aware of any content based restriction on speech that does not violate the first amendment when applied to purely private expression.
On private property that is also public space, content based restrictions on pornography, and true threats can be criminalized.
All other government restrictions must be content neutral – both facially and in application – i.e. government can not have a content neutral law that it applies in a content biased way.
Reasonable Restrictions on time, place, and size are usually allowed, but generally government can not otherwise restrict speech in the public portions of private property.
There are similar divisions with respect to government owned or controlled spaces, but the allowed restrictions in each domain are different from private property.
Generally government has broad discretion for content neutral laws in PRIVATE government space.
And far more limited power in Public Government space.
Next some government space constituttes either a permanent or temporary public forum. Public forumns constrain government the most.
Government can as an exampel require permits for the use of public formums – but these are on a “shall issue basis” – government can not say no, and can not impose requirements that burden speech. At most they can in a content neutral way preclude two groups from using the same public forum at the same time – but they must do so neutrally.
The next “domain” we get is that sometimes private actors are subject to government constraints. Universities and colleges that accept government funds are treated more like government from a free speech perspective than like private actors.
Comversely – though genarally consistent with content neutrality government when fucntioning as an employer or as a school is permitted SOME of the ability to limit speech that private actirs have.
Next we have constraints on non-government public actors. These are fundimentally self imposed. When a private entity such as a college imposes a free speech code that is usually binding – it is treated as a contractual right for those attending or working there.
Next we have defamation – defamation in the US is mostly or entirely civil. You can privately defame anyone you want to your hearts content.
But if you do so publicly, and falsely you may be subject to damages. The standard that must be met is higest with public figures or those in government who have virtually no protection against defamation.
Finally government generally – beyond issues of free speech, cannot do through proxies what it can not do directly.
Government can not leverage Social MEdia to censor for it.
Generally there already exists constitutionally sound laws regarding all of this that are not being enforced.
Who teaches people to be vicious and cruel?
Who doesn’t understand that in order to win elections that democrats will support terrorists.
Israel and Palestine – these are people that have unabashedly hated one another for generations, and it has nothing to do with these idjits. Nevertheless, behold the people being given doctorates in the 21st century. The same is true in medicine, the sciences, technology – anyone that thinks this will not be a problem in the future is whistling in the dark, we will all have to live in the world we are creating, and political stance matters exactly zero.
Most kids across the board are this low and unthinking, whether they are woke or not. This year, in a very conservative county, 50% of my wife’s students are below average, and their parents honestly do not care. They do not think being able to read and do basic math is important. Very few are thinking critically about anything in the 21st century. And rest assured, the woke fools do not care about the law, and those that support them will continue to be all too happy to bail them out. We keep having these conversations amongst ourselves when they do not matter one whit to the people in question. There is plenty of blame to go around in terms of enabling, and alma mater that have their heads up their behinds and still seem to think we are just riding a wave of youthful incongruence are a large part of it. That is not what is happening here. Stop asking barking dogs to be logical, we are one or two generations away from kids simply being feral, and as far as things go politically, ALL of the parents are doing a supremely sh***y job with their kids. They show up to school, even in the early stages, already bereft. It’s a hop and a skip to absolute idiocy, and no one wants to talk about it.
Who cares??? We have people being arrested for peacefully protesting OUTSIDE the Capitol on January 6 and Turley obsesses about tearing down posters.
The professor can’t cover everything at once. That the DOJ is corrupt is no new revelation. But the degree to which our universities and their faculties have sunk into idiotic and depraved approval and justification of evil is new. They were known to be rotten, but the extent of the rot has shocked even me who expected little of them.

Bilek was not wrong and professor Turley is not being completely honest with the facts. What he is really arguing is that all free speech even those who object to an issue should be debated in a civil cordial manner. That is fine in itself, nothing wrong with that. However, the professor wants everyone to adopt that view and insists anything other is not free speech and shouldn’t be treated as such. He’s wrong. Professor Turley ignores significant problems with is arguments about Hecklers, shout downs, disruptive behavior, and at times yes “violent” actions such as tearing down posters and such. They are all free speech activities. That’s right, they are. The professor uses the principle of the 1st amendment as the cornerstone for his philosophy, there’s nothing wrong with that.
Academic ideals are nice and practical in his mind, but reality often proves that is never or rarely the case. Professor Turley uses Bilek as an example of what is wrong with her view that disrupting speech about free speech is free speech by not being completely honest with the facts in the first place. This is what he said when he wrote about Bilek the first time.
“Bilek responded in an email to Inside Higher Ed, that the interruption was acceptable because it was short: “For the first eight minutes of the 70-minute event, the protesting students voiced their disagreements. The speaker engaged with them. The protesting students then filed out of the room, and the event proceeded to its conclusion without incident.”
She added “this non-violent, limited protest was a reasonable exercise of protected free speech,” adding that “it did not violate any university policy.”
Some of that is defensible, but Bilek lost me in the end. First, students clearly have a right to protest outside of the event. Stopping an event is not an act of free speech. ”
The event wasn’t stopped. It was interrupted. The speaker who Turley conveniently forgets to mention is an expert on free speech did exactly what should have been done. Engaged the students and didn’t walk a way in a huff or gave up. The event went on. Turley inserted an admission that Bilek wasn’t wrong when he stated that “some of that is defensible”. I’ll repeat that, “some of that is defensible”. What he really wants is for everyone to adhere to his view, because the very next sentence he declares “First, students clearly have a right to protest OUTSIDE of the event”. The professor is dictating what should be because he knows best? Hardly. Because he doesn’t like uncivil speech. Disruptive speech, rude speech, or even speech that is in defiance of his personal view that free speech is a right as long as it’s civil, respectful, and involves a compliant audience. That is simply not realistic.
The only things that keep his view of free speech intact are school policies or rules agreed to for an event. That’s it. There is literally no law or statute that says free speech can only be or must only be exercised in a civil manner, be respectful, or even polite. This is what Turley fails to grasp and what those he criticizes such as Bilek understand. It’s not anti-free speech to heckle, shout down, or even protest to the point of shutting down a speaker. Because there’s literally no law against that except school policy or event policy enforced by private actors or organizations.
This is why Turley’s views are wrong. He relies too much on the idea that speech should be civil and respectful. The reality is there is no rule or law that it must be. Even the 1st amendment does not prohibit it. The professor is right about one thing. The way to counter “bad” speech is more speech. This is what the speaker who was heckled and protested against did during that speech on free speech. He used more speech and engaged those who who exercised their own free speech to disrupt the event. He managed the issue rather than throw a fit or flee the stage in “fear” or “safety”. The speaker stood its’ ground and did exactly what he Turley preaches. Free speech is not just about expressing your views or opinion it’s also about the right to stand your ground against other’s opposing free speech.
Anonymous – that is more than a View – that is generally the law – atleast in public spaces.
LAws against disorderly conduct are constitutional – even when the disorderly conduct is speech, such as heckling, so long as those laws are content neutral.
Laws imposing order only public forums for speech as constitutional – so long as the laws are content neutral.
The right to free speech is NOT a right to forced anarchy.
Government can not prevent you from getting a permit to speak in a public forum. But it can – and must police that poublic forum and prevent others from disrupting it.
And it must do exactly the same for those with the opposing view – when THEY get a permit to speak at a public forum.
Most of the time when Turley is attacking those who are threating the free speech of others – he is on the correct side of the law and the constitution.
If you are putting up posters on public unoccupied spaces – you are subject to content neutral laws regarding the use of that space.
When you are tearing them down or posting over them or heckling someone else – you are illegally and possibly criminally violating their free speech rights.
If you wish to argue that the current constitutional framework for free speech is wrong – you can change the constitution.
But over the course of several millenia we have worked out the rules for what is and is not protected free speech in pretty much every context.
Most of those rules – laws, are determined by logic, and ordered liberty. Regardless, they are the LAW not merely Turley’s oppinion.
Until both sides find it useful to sit down together, take notes, and actually listen to the other side there will be no basis for compromise — let alone a 2-state solution.
If Hamas is not eliminated, nothing will happen until regime change in the Islamo-fascist banker of Hamas.

O T (Voter Fraud)
Trump is on trial for potentially the remainder of his life for questioning the integrity of the 2020 election, where 25% of the ballots were cast by mail, some of which were “harvested”, meaning that they were placed in a drop-box by persons other than the voter.
In Bridgeport CN, a judge has just voided a primary election for mayor because of illegal ballot harvesting.
“A surveillance camera showed individuals stuffing multiple absentee ballots into a ballot dropbox at night. Lawyers for the city of Bridgeport argued that it didn’t prove illegal voting took place.
However, Connecticut Superior Court Judge William Clark disagreed.
“The videos are shocking to the court and should be shocking to all the parties,” Clark wrote in his ruling Wednesday.
The judge added that “to disregard the significant mishandling of ballots by partisans that were caught on video flouting the provisions of Connecticut law” would “endorse this blatant practice of ballot harvesting.”
The challenge to the election was made by a Democrat, which is apparently permitted. Nevertheless, credit to the judge.

The US and other countries in the world have centuries of experience with this.
There is a reason that “secret ballot” laws and constitutional provisions are nearly universal.
There are 4 requirements for secret ballots.
1). an official ballot being printed at public expense,
2). . on which the names of the nominated candidates of all parties and all proposals appear,
3). being distributed only at the polling place and
4). being marked in secret.
Mailing ballots do not meet these criteria.
Properly done absentee ballots can – but states that have transformed absentee voting into mailin voting by another name (CT) can not.
There are critical reasons for these requirements.
#1 reflects the fact that ballots – even blank ballots are effectively as valuable as currency.
It is not just that government must print them, it is also that the printing must be tightly controlled so that duplication is extremely hard.
#3 requires that ballots NEVER leave the supervision of election officials. This is critical because it means that there is no question of who committed fraud when fraud is detected.
In 2020 in AZ the cyber ninja’s audit found almost 50K ballots from the same 13K people.
Because ballots left control of election officials – those depulicates could have been done at any step in the process – there is no means to know if they reflect 13K unscrupulous people voting more than once, or are a reflection of a much larger fraud where 100’s of thousands of ballots were manfuctured for registered voters that had not recently voted – and the 50K represents only the fraud that showed up because some infrequent voters did vote.
#4 is important because if there is any way at all to document the way someone voted then they can be coerced or indicted to vote as others want.
If others can not know how you voted you can not be payed or harmed because of your vote.

“Most accounts”? Not most honest accounts. But who cares? Hamas terrorists shouldn’t hide behind women and children. Blame them, not Israel. One of the young women celebrating peace at the big do in the desert was stripped and driven through the streets of Gaza to the taunts and jeers of the “innocent civilians” before she was tortured to death and likely raped and beheaded as part of the evil. A remnant of her skull has been found.

Thousands of Gazans had work permits that let them earn many times more than they could have earned in their own evil society. Some, maybe most, of them provided intelligence to Hamas that made it easier to target the most vulnerable. The two state solution is dead. No civilized society can tolerate such evil always at its shoulder.

Snowden – you’re generally a levelheaded commenter, but here your analysis is seriously deficient in multiple respects. The Gazans voted Hamas into power. They celebrated the massacre en mass when the Israeli corpses and hostages were brought back (the video evidence of that is abundant). The civilian casualties in Gaza are all on Hamas’s head. Hamas launched a massive unprovoked attack on Israeli civilians which predictably drew this response, then Hamas ensures civilian casualties are maximized by where they locate their command centers and rocket batteries. They are on record saying they want massive Palestinian casualties, and their actions are tailored to that end. Whereas Hamas purposely targets civilians, the IDF goes out of its way to minimize civilian casualties by using advanced techniques no other nation employs.
As for your David-and-Goliath comparison in which you paint Israel as Goliath, you omit all context. No other nation in the world is in a neighborhood where its neighbors have been seeking its destruction for decades – and have acted in concert to that end multiple times. At the UN, Israel is regularly told it has no right to exist or to defend itself from unprovoked attacks. Iran is on record as trying to get a bomb so it can wipe Israel off the map. No other nation in the world has to live with that kind of threat hanging over it day in and day out. Russia and China approve of the Hamas attacks and tell Israel it has no right to defend itself. Russia and China – two nuclear powers, and large ones at that. Fiery terror in the form of rockets aimed at its population centers is constantly raining down on Israeli cities. My son spent a summer in Israel working for a water tech company, and he had to keep rushing into a bomb shelter while trying to get a night’s sleep. The same cannot be said of any other nation on earth. Ukraine has had to endure that within the last 2 years, but for Israel it’s decades on end with little respite.
Every war Israel fights is an existential war: win one, win one; lose one, lose them all. It is miraculous that (a) after 1,900 years without a homeland the Jews returned to their ancestral homeland (no other people group has survived as a distinct nation that long without a homeland), and (b) after being militarily attacked multiple times by many of its neighbors in a concerted fashion, Israel has survived each time. There are 7 million Jews in Israel; there are 450 million Arabs in the 22 Arab League states. Israel only asks for a tiny strip of desert with no oil to speak of; its land mass is 22,100 square miles, compared to the Arabs who have 588 times as much land – 13,000,000 square kilometers among the 22 Arab league nations. If the Arabs would just leave Israel in peace, Israel would never attack a single Arab.

One way colleges could improve this situation is actually make students “write” and “read” their views, backed up with facts or logic.
The university could then distill the best points of each side, minimizing much of the emotion in these non-debates.
If a student wants to be upset, they actually have to read the other sides argument. Novel concept for an Ivy League university “writing” and “reading” and doing actual research.

I have a hard time getting worked up about any of this. Putting posters up, tearing them down – it is all activist performance art. If the supporters want to do this, pay for a billboard. Tearing that down or defacing that is a crime.
