The Irish Government Moves to Crackdown on Free Speech After Anti-Immigration Riot

We have previously discussed the growing anti-free speech movement in Ireland. As discussed in The Indispensable Right: Free Speech in the Age of Rage, these crackdowns on free speech tend to come with periods of public  panic or anger. Anti-free speech advocates use such periods as opportunities to get the public to surrender this core right to government censors or prosecutors. Right on schedule, Ireland is now pushing one of the most chilling crackdowns to date.

The excuse for the latest rollback of free speech was a riot in Dublin leading to the arrest of 34 people and extensive property damage in anti-immigration protests.  The protests have challenged the government policies on handling undocumented migrants.

The bill criminalizes any “preparing or possessing material likely to incite violence or hatred against persons on account of their protected characteristics.”  That includes any material concerning national or ethnic origin, as well as protected characteristics including “transgender and a gender other than those of male and female.”

The bill includes crimes relating to “xenophobia” and can be committed merely by the”public dissemination or distribution of tracts, pictures or other material.”

Elon Musk has flagged the law as have other free speech advocates.

Irish Prime Minister (Taoiseach) Leo Varadkar has rushed to ride the political wave after the recent Dublin riot to announce that he would fight hatred by taking away rights.  He declared his intent to “modernize laws against hatred” by criminalizing speech that his government decides is “incitement.” He insisted that the existing legislation is “not up to date for the social media age” and needs to have a broad reach of criminalized speech. He wants to crackdown not just on violence but on those who say things that might “stir up” others.

What was particularly chilling was a speech by the Irish Green Party Sen. Pauline O’Reilly who admitted that  “We are restricting freedom, but we’re doing it for the common good.”

That is all it takes to get citizens to surrender core rights, a declaration that fewer rights is better for the common good. It has become a Siren Call on the left not just abroad but in the United States.

I have previously written columns about the rising generation of censors in our country. After years of being told that free speech is harmful and dangerous, many young people are virtual speech phobics — demanding that opposing views be silenced as “triggering” or even forms of violence. A recent Pew poll showed just how much ground we have lost, including the emergence of the Democratic Party as a virulent anti-free speech party. Pew found that “Democrats and Democratic-leaning independents are much more likely than Republicans and Republican leaners to support the U.S. government taking steps to restrict false information online (70% vs. 39%).”

Ireland shows how public disorder can play into the hands of government officials in further limiting the right of free speech. As O’Reilly explained, free speech is simply too dangerous and denying the right is now viewed as a public good.

Of course, some have more direct measures. Dublin Councilman Abul Kalam Azad Talukder has reportedly called for protesters to be “shot in the head or bring the public in and beat them until they die.”

    Students at NYU Law voted to remove the president of the school’s Student Bar Association after they sent a statement in support of Palestinian resistance in a newsletter.

    “To not even know that this vote was moving forward felt kind of disrespectful to me and a lack of courtesy,” Workman said. “I was disappointed in the outcome, but I wasn’t upset with law students regarding the vote. I really place a lot of the blame on the administration for taking the extraordinary steps for removing me as president when they did not elect me.”

Within a day of her first tweets, the company fired Johnson and removed him from the Board. Johnson and his wife sued Griffin in federal court in Tennessee, claiming (among other things) that she tortiously interfered with his employment.
    Griffin argued that her tweets did not subject her to the State’s personal jurisdiction, and the district court dismissed the case. We disagree and reverse.

  4. Jonathan: For those I know are interested, here is an update on the civil fraud case in NY before Judge Engoron–and it’s not going well for the Trumpster.

    For starters, DJT had appealed Judge Engoron’s gag over DJT’s doxing of the Judge’s principal law clerk. Engoron had already fined DJT $15000 that little attack. The gag order was stayed pending appeal so DJT used the opportunity to further attack the Judge and his clerk. Now the 4 judge panel of the NY Court of Appeals has just reimposed the gag order and Judge Engoron says he will enforce it “rigorously and vigorously”. So if DJT continues to attack Engoron’s law clerk he could face more fines and other sanctions. Will DJT learn the lesson and keep his mouth shut. Don’t count on it!

    But there is more bad news for DJT in the same case. When Judge Engoron originally found the Trump organization liable for “persistent and systematic fraud” a court monitor, retired judge Barbara Jones, was appointed to oversee the DJT companies–to prevent further fraud. Jones has submitted periodic reports to Judge Engoron. In her latest report Jones discovered DJT had secretly transferred $40 million in violation of the judge’s order. DJT was apparently trying to move money out before the eventual sanctions kick it. As it turns out, $29 million of the money was to pay taxes and other things–like money put into an “E Jean Carroll escrow account”. No doubt DJT knows he is going to be hit with a big bill in the second E Jean Carroll defamation case before Judge Kaplan.

    DJT is entitled to make money transfers from one account to others. But he is required to report those transfers to the monitor. He didn’t do that and Judge Engoron is not going to be happy. With the latest disclosure Engoron could well impose further sanctions on DJT. When will DJT learn you can’t keep committing persistent fraud– right under the nose of a judge?

    1. I would suggest that you might want to pay attention to the oral arguments – 2 obama judges and one Biden judge in DC.
      While they have not handed down their decision yet – Chikatan’s far more limited gag order fared incredibly poorly.

      As the Judges noted – all of this is free speech. Prosecutors, the judge, the clerks etc are NOT protected
      The judges also noted that the conduct the DOJ was trying to claim it was preventing with the gag order is illegal.
      Actual witness tampering or true threats are crimes. Should Trump or others actually do those – you charge them.
      You do not engage in prior restraint.

      The Ergron gag order will go up to the NY sumpreme court. Or the superior court en banc.

      Regardless, this is long settled law – Ergron is going to lose.

      Finally, Ergron is NOT going to do anything.
      He has flown into a box canyon and has no good way out.

      Do you know what Rope-a-dope is ?

      Ergron is the dope.

      There is nothing he can do to Trump that is not a loss for him.

      If you need a state court case – try Willis’s efforts to jail one of her Defendants in he case.
      Went down in flames.
      While the oral arguments in DC were much better on the law.
      The Judge in GA made it clear that he is not requiring GA Willis defendants to self censor all their tweets.

      It is a civil case. It never should have been brought.

      The odds of Trump not prevailing in the long run ? Zero.

      James has not weakened Trump – she has made him stronger.

      I do not mostly want to fixate on the details – because mostly they do not matter – Ergron is not paying any attention tot he facts,t he law or the constitution – or the politics.

      He has flown into a box canyon – with no way out, and may not be smart enough to understand that.

      NY already has a capital flight problem. This case is costing NY Millions in lost revenue.

      DB testified the past two days – and their testimony was damning to James.
      I doubt it matters – Ergron is not paying attention.
      But wealthy new yorkers are.

      It is irrelevant whether they like Trump or not.
      James and Ergron have telegraphed that if we do not like you – we will try to steal your assets.

      DB testified that they ACTIVELY sought Trump as a client. They called Trump a “Whale” in internal communications and described trying to loan him Money as “Whale hunting”. They testified that the loans were with full recourse – that means the value of the properties was irrelevant.
      If The Trump organization defaulted – all the assets of the entire Trump family were on the line – that is 10’s of Billions – much more than DJT’s wealth. That Trump’s statement of finances was normal. IT is exactly like those of all high net worth clients they deal with.
      That the deals he got were normal for high net worth clients.
      That the Bank is required – both by law and 2000+ years of practice to do its own due dilligence.
      The legal standard is caveat emptor – it is latin for a reason – it dates back to Rome atleast.
      Regardless, they did their own valuations – they did not use Trump’s. That any differences are meaningless.
      Bank’s assess assets extremely conservatively deliberately.

      I would presume that one form of conservatism that even wing nuts like you support is fiscal conservatism of banks with your money ?
      It went on and on – damning with each minute of testimony.

      I doubt any of that will make much difference to Ergron.

      My prediction is that Ergron is going to find for james.
      He is going to try to find enough to grudgingly satisfy the bloodlust of the left – and in doing so play right into Trumps hands.
      But not so egregiously that the courts reverse him quickly. Though have no doubt, he will get reversed. He is on the wrong side of the constitution, the law, the facts.

      But hey – you have fun with this.

      Of all the Trump cases – the potentially most Damaging was the Carrol Case. While that was a civil case the claim was that Trump raped her.
      The jury reached a very bizarre decision – that Trump had defamed her – but did not rape her. Carrol was alousy plantif and 30 year old claims are a litigation mess.

      Of course now Mayor Adam’s is finding himself the target of an ancient history sexual allegation – as apearetly are other prominent new your democrats as a result of bad law.

      Regardless, While Carrol was a nut job who has accused a long long long list of men of rape. And who ultimately could not even put her and Trump in the same place at the same time. Still Trump has a reputation – especially in the past as a “womanizer” and though there is no evidence that he ever took something that was not offered, no one beleives he was a sexual saint.
      There was the real but small possibility that Carroll could come up with strong enough evidence for people to conclude Trump was a rapist.

      And that would be the end of him. After that he would be a tar baby – everything would stick.

      But that is not what happened. Trump can lose the James case badly – it just makes democrats look bad – no matter what.
      Further with near certainty he wins on apeal – if not be before in the supreme court.

      Regardless, there is no political loss in this for Trump.
      And the amount of free political advertising he has gotten is incredible.

      The Smith cases will die after the election – NO MATTER who wins. They will not go to trial before the election.
      Chutkan recently ruled against Trump on multiple discovery requests. The appeals for those could go to the supreme court.
      No trial can proceed while those appeals are pending.

      I do not know if Trump is entitled to the discovery he asked for – or he is rope-a-doping smith. Trump may be making demands of Smith knowing Smith can either comply and let Trump go on a huge fishing expedition, or fight and Trump gets a massive delay for appeals.

      Bragg has dropped of fthe face of the earth.

      Willis has already tol the court the case will not be over until 2025.

      Democrats need two things – A criminal conviction of Consequence,
      And one that people beleive.
      Without that – this all looks like Democrats abusing their power.

      I expect Trump will do everything in his power to bait Ergron into doing something stupid.

  6. If the US were the superpower we claim to be, we would have a common understanding of how freedoms and responsibilities of speech go hand in hand. What we have instead is near complete silence from conservatives on the responsibilities topic — and naive, simplistic ideation from leftists about assigning govt. as moderator, blind to the certainty that Repubs could later get elected, and then use said moderator role to censor the left.

    There are ways we could achieve a decent degree of self-management in matters of speech, with deterrents against public deceptions and paranoid-zealotry, where the govt. has no role as policeman — rather the judgments and enforcement of standards of acceptable conduct are widely distributed throughout society.

    One idea is to use Public Frauds civil litigation as the deterrent. It would work similar to defamation law, except with rapid-due-process (lawyers could not delay discovery or trials as a defensive tactic). Juries of 12 Americans would be finders-of-fact under strict rules of evidence, equipped with the investigatory power of subpoena. Such civil trials would be places where lies go to die, and liars to be held liable. Public Frauds civil suits is the ultimate leveler, where citizens hold the power to bring dishonest candidates, campaigns, and public officials to heel. We are going to need something like this to enjoy freedom of expression without ceding the upper hand to the most clever, devious, ambitious liars.

    The People defined broadly and our shared values form the backbone of society — the government is in a subservient role to us. That relationship must be maintained, but neither can we risk our public square becoming drowned out by unhinged zealots — that is what happened in Gaza 16 years ago. That is what is going on in Russia with militant nationalism. That is what has happened to our elite university campuses. Zealotry leads into delusional-belief-bubbles where blunders become inevitable. This is the dark place where free speech with no collateral responsibilities takes a free people….this explains why speech should not tolerated that is militant and hedonistically self-righteous.

    Let’s use our thinking caps, and figure out how to allow the free exchange of ideas with parallel responsibilities — to respect the safety and integrity of one another — to let each speak for themselves (rather than being pre-empted by pernicious oppo-branding) — and to afford each independent mind reach their own conclusions. This effectively means figuring out how to effectively deter psyOps such as the Blinken-Morell whopper about Russians having fabricated Hunter’s laptop. Those attempts at mind-control must be challenged on the spot before they can gain purchase.

    Here’s an idea, JT: How about dedicating 1 month to discussing and debating the responsibilities of public speech, and
    how best to hold citizens to those responsibilities?

    1. Freedom’s are NOT conditioned on responsibilities.
      There are no conditions on freedom short of the law, and when the law infringes – the need must be compelling and there must be no other way to accomplish what is needed.

      Actual responsibility for excercising (or not) freedom’s is imposed on us outside of government.

      Apple, Disney, etc. have chosen not to advertise on X. And Musk has told them to F#$K themselves.

      Disney has lost over a Billion dollars at the box office alone.
      Anheiser Bush has given away 25% of its marketshare.
      The Red Hen resturant that refused to sever Huckaby is closing and reopening under a new name.

      This is how we hold people responsible for their excercise of their freedom.

      There is little need for public discussion.
      Each of us makes our own choices regarding whether we give our patronage to others – their excercise of their freedoms is one criteria for doing so.

    2. The responsibilities of speech are well established.
      You can not direct someone to commit a crime.
      You can not make or publish child porn.
      You can not distribute adult content to minors.
      You can not issue a “true threat” That is a threat of imminent violence that is credible.
      Mean tweets are not True Threats.
      Making someone uncomfortable is not a true threat.

      Everything beyond the above is the responsibility of individuals.
      You can boycott AHB or you can switch to Bud Light – your choice.

  7. It seems we are in a time warp back to the days where citizen were arguing amongst each other over individual rights. The Anti-Federalists were opposed to the constitution if it did not include the verbiage guaranteeing individual rights. Richard Henry Lee wrote to John Lamb in June 1788 in part” …. “tis really astonishing that the same people who have just emerged from a long and cruel war in defense of liberty should now agree to fix an elective despotism upon themselves and their posterity….”, he was alluding to the Bill of Rights. The Anti-Federalists insisted on freedom of religion, assembly, press etc., be written into founding documents. Lee further wrote “To say that a bad government must be established for fear of anarchy is really saying that we should kill ourselves for fear of dying.” Brutus “the pseudonym” for the Anti’s wrote “”informing a government on its true principles the foundation should be laid by expressly reserving to the people such of their essential natural rights, as are not necessary to be parted with”. Brutus also wrote in essay 1, “In every free government, the people must give their assent to the laws by which they are governed.” Turning to John Locke: “Treatises of Government” Chapter II, Of the State of Nature “Sec. 92” For he that thinks absolute power purifies men’s blood, and corrects the baseness of human nature, need read but the history of this, or any other age, to be convinced of the contrary. He that would have been insolent and injurious in the woods of America, would not probably be much better in a throne; where perhaps learning and religion shall be found out to justify all that he shall do to his subjects, and the sword presently silence all those that dare question it: for what the protection of absolute monarchy is, what kind of fathers of their countries it makes princes to be and to what a degree of happiness and security it carries civil society, where this sort of government is grown to perfection, he that will look into the late relation of Ceylon, may easily see.” I assume that Locke was alluding to the [Uva Rebellion] around 1815+/- where males of fighting age were driven out or killed.

    It is truly concerning that a group of individuals would strive for state controls over individuals’ thoughts. There so many instances of the State pursuing control to counter individual rights it’s useless to itemize them individually. We have reached a tipping point where confidence of the people is being strained in the foundational documents we’ve agreed to. The authorities of the state in their despotic nature are intent on removing protected freedoms from state tyranny under the guise plurality “issue for the day”.

    The United States suffered the deaths of 500,000 Americans in WWII to help free and protect Ireland and Europe.

    The United States has assisted in protecting Ireland and Europe for 50 years through its membership in NATO.

    A crackdown on free speech by the government in Ireland is a slap in the face for America by the tyrannical, global, communist, Deep Deep State “swamp” and “dictatorship of the hired help.”

    The rights and freedoms enumerated in the Constitution and Bill of Rights are natural and God-given; they are universal.

    Ireland, presumably, is in the universe; Ireland must protect and perpetuate the absolute freedom of speech and all other rights and freedoms presented in the U.S. Constitution.

    The U.S. Constitution is the greatest and most beneficial document providing for human self-governance in the history of man, the extreme, biased, partial, subjective, communist, feminazi, and anti-American position of rejecting and not recommending the U.S. Constitution to nations in the process of drafting their fundamental law by the late affirmative action Supreme Court Justice, Ruth Bader Ginsburg, notwithstanding.

    Certainly, Ireland should be faithfully adhering to the U.S. Constitution, if not outright adopting it.

There is an oath that requires you to say if anyone doesn’t agree with censorship they will make sure that they reap the whirlwind.   10. My stomach feels queasy. I am amazed that our leftist posters are not appalled when a politician declares that citizens should be shot in the head or beaten to death. Why not. It happens in Gaza all the time. Instead they change the subject to one or another of their favorite tirades. However, we should keep in mind that they were greatly appalled when the censorship by the government on Twitter was exposed and the Hunter laptop was proven to not be Russian disinformation. In a group cacophony they tried to convince us that no such censorship of these events had taken place. In their continued quest for power not a shred of morality exists. We should weigh their posts with these facts in mind. The explanations with expletives are understood and are not necessary to be written.

  12. Ireland’s Small Population

    The Republic of Ireland has a total Population of not much more than 5 million. That’s similar to a medium size U.S. state.

    Dublin’s metro region is only 1.4 million. That would not even rank amongst the top 30 U.S. metro regions.

    Therefore a major riot in a country that small is a very serious matter. And historically race riots were not even an issue in Ireland.

    Yet even here, in the U.S., any race riot is a serious matter. The George Floyd riots ruined the downtowns of many cities.

Many big advertisers have pulled their ads from “X” after Media Matters reports that ads were being placed next to posts promoting racism and Hitler. Musk is suing MM because he doesn’t like criticism–just as DJT has done when he didn’t like what the media was saying about him. Musk is also suing another research group because they found that in the 12 hours after Musk took over Twitter the use of the n-word increased about 500 per cent. Kill the messenger. That’s Musk’s approach to “free speech”.

    In Europe there has been a strong reaction to hate speech on “X”. In France, the Paris mayor announced Monday she is quitting Musk’s platform because it is a “gigantic global sewer” of hate speech. No doubt many other Parisians will follow suit.

    Lately, Musk has become unhinged by the criticism of his platform and the loss of ad revenue. Yesterday he cried: “What it’s going to do it’s going to kill the company, and the whole world will know the advertisers killed the company. Go f— yourself!” Not exactly the way to endear yourself with advertisers.

    Musk’s “X” is in a world of economic hurt. Without major advertisers “X” is unlikely to survive. But Musk’s problems are self inflicted. He didn’t have to make his platform a home for racists and lovers of Hitler. He made a conscious choice because he is one of them. Now he is reaping the whirlwind. The Q is why you are siding with Musk?

      1. Lin: Probably a lit bit of both. I once worked for a major airline as a corporate attorney. During the period in question we had a contract with the US government to fly refugees from Central America back to their home countries. Our government was then supporting CA dictatorships. Sending refugees back resulted in their almost certain death. Other airlines had similar contracts with the government.

        It was a controversial policy and our HQ was picketed by supporters of the refugees. There was widespread media coverage and we were deluged with reporters asking why we were supporting US policy. Within the company there was also widespread debate. A group of employees, who thought it was a “moral” issue, asked me to make a presentation to the Board of Directors to urge cancelling out contract with the government. At first I was reluctant because I thought it might adversely affect my career. But I decided to go ahead and asked for a meeting of the Board. I made my presentation–with data showing how many refugees had been killed after being returned and the policy was creating a nightmare for our PR department. I also prevailed on the Sr. VP of Sales who told the Board a number of customers had cancelled their reservations over our policy.

        After I sat down there was heated debate in the Board room. One Board member said something to the effect: “Our job is to sell tickets, not to get involved with government policy”. In the end, the Board decided to cancel our contract with the government–as did some other airlines. Flying refugees back to certain death was adversely affecting our company’s “Friendly Skies” image.

        I expect these same kinds of discussions occurred in the Board rooms of companies like Disney, Nike, etc. when they decided not to advertise on “X”. But in the end they decided they didn’t want their products and brands associated with racism, anti-semitism and neo-Nazi propaganda. Economic self-interest? You betcha. Does that answer your Q?
