Germany Moves To Impose Crippling Fines On Social Networks For “Fake News”

I recently wrote about the growing threat of government regulation of speech on the Internet under the guise of combatting “fake news.” Germany has been ground zero for civil libertarians for the rollback of free speech. Angela MerkelGerman Chancellor Angela Merkel long ago established herself as a menace to free speech, particularly in her decision to first apologize to authoritarian Turkish President Recep Tayyip Erdoğan for a satirical poem and then approve the prosecution of the comedian is a shocking and chilling disgrace. Now, Germany is considering imposing a legal regime that would allow fining social networks such as Facebook up to 500,000 euros ($522,000) for each day the platform leaves a “fake news” story up without deleting it. Governments have finally found a vehicle to get citizens to allow them to curtail or chill speech — ironically in the name of facilitating “real news” or “truth.” It is perfectly Orwellian and Merkel’s latest contribution to the erosion of free speech in the West. I recently discussed the issue as part of an interesting segment with Ted Koppel.

Serving Intolerance with An Anti-Democratic Relish: Hawaiian Restaurant Bars Trump Supporters

ff-19-640x454Honolulu’s Café 8 ½ appears to be serving dishes with an anti-democratic relish after the election. To the delight of many of its customers, it has barred anyone who supports President-elect Donald Trump from eating at the Hawaiian restaurant. The sign on the front door reads “If you voted for Trump you cannot eat here! No Nazis.” The sign has caused a firestorm of controversy for the relatively small restaurant.

Have A Haramy Christmas: Islamic Leader Warns Wishing Friends “Merry Christmas” Is Worse Than Murder

We recently discussed how rabbis have issued warnings to hotels and other businesses not to display Christmas trees as offensive to Jewish values, even threatening to pull the kosher certification from businesses.  Now, a leading Muslim authority has declared that even wishing neighbors a “Merry Christmas is worse than murder. It is “haram” or forbidden. The view of Dr. Zakir Naik is not new (and he stated this view years earlier), but there is an interesting alternative take on the issue in The New York Times by a Muslim writer on the shared traditions between Christianity and Islam.

THE REAL DANGER OF FAKE NEWS

Freedom_of_SpeechThe Obama Administration and many Democratic leaders have made “fake news” a rallying cry for more government and private regulation of the Internet — as well as a rationale for the devastating loss of Hillary Clinton to Donald Trump. Below is a column exploring the dangers of this new justification for speech regulation, which are already becoming evident in various countries around the world. I recently discussed the issue as part of an interesting segment with Ted Koppel.

Israeli Rabbis Denounce Christmas Trees and Pressure Businesses To Remove Such Symbols From Public Places

220px-2002_blue_room_christmas_treeThere is an interesting controversy in Israel after the rabbinate in Jerusalem issued a letter warning dozens of hotels in the city that it is “forbidden” by Jewish religious law to erect a Christmas tree or stage new year’s parties. It is a reminder of how Israel remains a country without separation of temple and state — a source of continual tension between the government and both secular Jews and other religions. The Washington Post has referred to a virtual “war on Christmas” by some rabbis in the country.

William Tecumseh Obama: NSEERS Regulations Burned On The Approach Of The Trump Administration

300px-william-tecumseh-shermanPresObama It is not uncommon for presidents to rush through regulations and changes in their final months or even days in office. Thus, the move of President Obama to protect pristine areas from drilling is not unprecedented, particularly as the continuation of his long-standing policies on the environment. However, as I discussed yesterday on NPR, the President made a move that runs against the grain of tradition this week. Obama negated the regulations underlying the dormant National Security Entry-Exit Registration System or NSEERS program. That was not action to advance a positive policy but a purely obstructionist move targeting your successor. There was no reason to destroy the structure except to delay any effort of President-Elect Donald Trump to carry out his campaign pledges to tighten entry rules and impose greater scrutiny of people coming from Muslim countries. NSEERS would have given Trump a readily available structure and pro-immigration groups lobbied Obama to destroy the program. It was a move that was reminiscent of General William Tecumseh Sherman. General Sherman famously left a scorched earth behind his March to the Sea and Obama appears intent to leave the same charred path for his successor.

Final Tally Confirms Clinton Won Popular Vote By 2.8 Million But . . .

495px-Donald_Trump_by_Gage_Skidmore225px-Hillary_Clinton_official_Secretary_of_State_portrait_cropGiven our previous discussion of the rising popularity of the electoral college, the final vote tallies are interesting. They do confirm that Hillary Clinton won the popular vote by 2.8 million. However, it also shows that Clinton lost to Trump by 3 million outside of New York and California. The results will tend to reinforce fears that the abandonment of the Electoral College would hand the outcome of presidential elections to voters in New York and California. Trump however issued signature tweets about how Clinton focused on the wrong states.

Drill Now, Drain Later? Gingrich Reports That Trump Wants To Abandon The “Drain The Swamp” Pledge [UPDATED]

220px-cypresses495px-Donald_Trump_by_Gage_SkidmoreThere is a basic rule about “talking points”: you follow them but do not quote them as talking points. That lesson seems to have escaped former House Speaker and Trump confidant Newt Gingrich who has caused a stir by revealing that President-elect Donald Trump is now disclaiming his pledge to “drain the swamp.” Instead, Trump is focusing on working with Congress to get his priorities through in rapid succession from opening up new drilling to rescinding Obamacare. Update: Donald Trump has denied Gingrich’s representation and Gingrich now says that he simply got it wrong.

Illinois Leads Nation For Third Year In Population Decline

illinois-state-flagI am in Chicago for the holiday and was struck by a recent report that shows that my native state is losing more people than any other state. It is a combination of factors to be sure but I have been critical of the politicians in Illinois (and particularly Chicago, my home town) for years in bankrupting the state and driving up taxes on every possible group. This is the third consecutive years for Illinois in leading the decline.

Trump Wins Electoral College After Clinton Loses The Most Defections Of “Faithless Elector”

495px-Donald_Trump_by_Gage_Skidmore225px-Hillary_Clinton_official_Secretary_of_State_portrait_cropThe Clinton supporters have been campaigning hard to convince electors to switch their votes from Donald Trump to Hillary Clinton. It was a remarkably hypocritical stance for Clinton who repeatedly called Trump’s failure to promise to abide by the election results “horrifying” and unAmerican. Clinton maintained that shocked demeanor all the way up to election night when she found herself the loser. She then broke from tradition and refused to concede that night before her supporters. Her campaign then supported challenges in various states and actively sought to convince electors to switch their votes. Well the results are in and it is rather surprising: Of the 10 electors who did not vote for their designated candidate, eight were actually Clinton electors who refused to vote for her. Only two Trump electors switched and neither voted for Clinton.

Georgia Police Sergeant Sues After Being Terminated For Flying Confederate Flag In Her Backyard

flag28n-2-webThere is an interesting first amendment case filed in Georgia where a police sergeant is contesting his termination after flying the Confederate flag at her home. It is of course perfectly legal to fly a confederate flag and Silvia Cotriss, a 20-year-veteran of the police, said that she was simply celebrating her heritage. However, her neighbors found the flag offensive and complained.

Italy Moves To Remove The Promise Fidelity As A Condition For Marriage

la-dolce-vita-vintage-style-italian-posterThere is a fascinating new law in Italy that seems a victory for the growing population of polyamorists around the world. Italy may drop the promise for couples to remain faithful in marriage as a commitment that may be viewed as outdated or objectionable by many modern couples who do not view sexual “fidelity” as a precondition for marriage.

Cost of Solar Power Dropping Globally As “The World’s Cheapest Energy”

earth-screensaver_largeThere is a hopeful report out this week that the cost of solar energy has dropped so dramatically that it is not cheaper than wind power in emerging markets like China and India. Indeed, Popular Mechanics is now calling solar energy the “cheapest energy” option. In Chile, electricity is being produced by solar power for $29.10 per megawatt hour–half the price of power produced by coal. These countries are seeing the benefits in the investment into alternative energy sources in both cost and the environment. The pledge of the Trump Administration to expand drilling and “clean coal” use runs against the trend in other countries.

Spain Arrests Five Activists For Burning Picture Of King Felipe VI

felipe_prince_of_asturiaslarge-spain-flagWe have previously discussed the alarming rollback on free speech rights in the West, particularly in France (here and here and here and here and here and here) and England ( here and here and here and here and here and here and here and here and here and here). Much of this trend is tied to the expansion of hate speech and non-discrimination laws. We have seen comedians targeted with such court orders under this expanding and worrisome trend. (here and here). Even politicians have been charged under the ever-widening standard of criminalized speech. Now Spain has made clear that it is committed to the same trend of curtailing free speech. In a moment worthy of Franco, Spanish police arrested five Catalan independence activists for allegedly burning photos of King Felipe VI.  Much like arrests in Russia, destroying or disrespecting the image of the national leader is all that is required in Spain.
