Cobb County Superior Court Judge Robert Leonard ruled last Friday that a former housekeeper who filmed sex with former Waffle House CEO Joe Rogers had violated his privacy. The housekeeper, Mye Brindle, alleged that Rogers forced her to perform sex acts as a condition for her continued employment.

There is an extraordinary case out of Texas involving a mother who was reportedly arrested for simply asking to see a warrant before police could enter her home to arrest her son. What is most remarkable to this story is that the family’s lawyer told the media that the Slaton Police Department was only willing to apologize if the family waived any right to sue it for the unlawful and abusive arrest. That demand alone, if true, should result in the immediate termination of the police chief as well as the disciplining of any prosecutor who conveyed the demand in my view. Citizens should not have to trade away legal rights to receive an apology for allegedly abusive police conduct.
There is an interesting torts case out of Dallas where Judge Carl Ginsberg in the 193rd State District Court, ruled against Presley “Rhonda” Gridley, a self-described psychic who created a national frenzy by telling authorities that a Liberty County couple, Joe Bankston and Gena Charlton, had a mass grave on their property. She has been ordered to pay the couple $6.8 million.

Melissa Kennedy and Frederick Willard, parents of the late Danielle Willard, are suing local police in an extraordinary case in which they say that their daughter was shot to death “assassination style” by a now disbanded special narcotics unit that has been accused of corruption and abuse. They are suing West Valley City, its police Officers Shaun Cowley and Kevin Salmon, Lt. John Coyle, Police Chief Thayle “Buzz” Nielsen, and 10 Doe officers, in Federal Court.
There is an interesting tort case out of Miami where a New Jersey woman, Anna Burgese, is suing W Hotel (owned by Starwood) after a beat down by prostitutes outside of the hotel. Burgese says that the hotel is widely known as catering to a large prostitution business and failed to protect guests. Police believe that the prostitutes assumed that Burgese was a “working girl” intruding on their territory.

There are demon infestation problems and then there are problems like the one in the home of lawyer Madalin Ciculescu, 34. Ciculescu went to four priests to rid his home of farting demons that he and his wife insist are making their life miserable. When the flatulence continued, they sued the Bishop and church for “religious malpractice.” Putting aside the chance that this could be an “inside job” of one of the couple, it does highlight the fact that, even though money is exchanged, it is virtually impossible to hold religious officials to any objective standard for malpractice. Ciculescu was denied and hit with costs by the court.
As previously discussed California’s infamous Knoller case involving a vicious dog attack and the sentencing of two lawyers for the death of a young woman coming home from a jog. Now, the owner of four pit bulls has been charged with the murder of a jogger with the use of DNA testing of the blood found on their snouts. Alex Johnson, 29, will stand trial in the death of Pamela Dewitt, 63, who was bitted 150 to 200 times by his pit bulls.

There is an interesting tort lawsuit out of Jackson, Mississippi where Everardo Garfias is suing Husqvarna Professional Products Inc. and Kawasaki Motors Corp., U.S.A., the maker of his Husqvarna lawnmower after it ran over him. Garfias had just been attacked by yellow jackets when he jumped off his lawnmower. The lawnmower however did not shut off and ran over him — severely cutting his legs and completely severing one of his knee caps. Garfias was working for a lawn service company at the time of the accident.

I have long been amazed by the rate of hospital injuries from preventable bloodstream infections. While there have been a few lawsuits, hospitals appear to have avoided liability for these preventable illnesses. Now, a study in the American Journal of Medical Quality suggests that the situation may be worse than anticipated. Not only is that not a strong litigation deterrent (my view), but this study says that hospitals are actually making a killing by making patients sick. Researchers found that an ICU patient who develops an avoidable central line-associated bloodstream infection (CLABSI) costs nearly three times more to care for than a similar infection-free patient. Here is the most amazing fact: hospitals earn nearly nine times more for treating infected patients.

There is an interesting lawsuit against an academic institution in Colorado. Spanish-speaking custodial workers at the Auraria Higher Education Center in Colorado are suing over the failure of the Center to give them instructions in Spanish — alleging that they have faced unsafe conditions over the use of English rather than Spanish. The case suggests that the use of Spanish can not only be legally required but that the use of English can constitute a type of unsafe workplace.

There was an interesting confrontation in Seattle this week where a man flew a drone just feet away from a family home. The drone was camera-equipped and the mother called police. Before the man left, he insisted that he had a right to use a private drone to surveil his neighbors. No it is not John Ashcroft’s neighborhood. I wanted to clarify a couple of points before others take to the air for some private snooping.

Now for our Mother’s Day story. There is an interesting property case out of New Jersey where Kobe Bryant is suing his mother, Pamela Bryant, to keep her from selling mementos from his early years at an auction. His mom says that he told her that the items were hers when he left them in his old room. He says that she is lying about ownership and wants to stop an auction despite the fact that she has received $450,000. At least he didn’t try self-help like some other famous or infamous athletes.
Gov. Rick Perry has long proclaimed Texas as a state favorable to business and has limited environmental protections and regulatory rules. Just how favorable is evident in the news that West Fertilizer Co. had only $1 million in insurance after an explosion that killed 15 people and injured 200 — and caused an estimated $100 million in damages. The insurance lobby has long opposed mandatory insurance laws and this case may be an example of the public cost of that success.
Toys R Us has vowed to appeal a $20 million verdict in Massachusetts in favor of the family of Robin Aleo who was killed after slamming her head on a concrete pool deck when a 6-foot inflatable pool slide deflated. The major issue in the appeal is likely to be the argument that the slide did not comply with federal safety standards. Toys R Us claims the federal standards were written for solid slides and that inflatable slides did not exist when the regulations were written.

Teachers were in a meeting in the Pine Eagle Charter School in Halfway, Oregon when two hooded figures burst into the room and sprayed screaming teachers with gunfire. It turned out to be blanks and they turned out to be cops. This was viewed as a useful drill to prepare the teachers for school massacre scenarios.
