This reads like a torts exam question. A group of frat brothers allegedly want to celebrate the end of the year with some book burning at Pi Kappa Alpha fraternity house at Louisiana Tech in Ruston, Louisiana. The text books then cause a large fire that ultimately claims not just the frat house but the nearby apartment building. The motto of the fraternity is “Once a Pike, Always a Pike.”

One of my former students sent me this video of a harrowing experience of an 80-year-old woman named Laverne who almost falls out of her harness in a parachute jump. I have long collected “falling body” cases of torts involving falling human and animal bodies (which we discuss in class). This one will have to go into the negligence section, though ultrahazardous activities might be an option.

Spencer Freeman Smith, 32, a partner at the San Francisco firm of Smith Patten was arrested this week on suspicion of felony hit-and-run and manslaughter in connection with the death and hit-and-run of Bo Hu, 57, of China, who was bicycling along a road when he was hit by a Mercedes-Benz. Police traced pieces of Smith’s brand new 2012 Mercedes-Benz CLS550 to his home.
Dr. Sharad Shripadrao Pandit in Birmingham, England was accused in Coroner’s Court this week in an extraordinary case of alleged malpractice. The parents of Alina Sarag reportedly called the GP more than 50 times about her ailing over four-and-a-half months. They testified that Pandit accused them of mollycoddling the girl and said that her symptoms were the result of being “lovesick.” She then died for tuberculosis.

There is an interesting criminal case out of Stockholm, New York where Shawn Mossow, 25, is charged with shooting a man. Nothing remarkable there, but the victim admits that he begged Mossow to shoot him in the leg to see what it feels like to be shot. That is perfectly legal. Shooting your friend with a .22 caliber rifle is not.
If you go to celebrity trials just to watch the cars crash, former NASCAR Sprint Cup driver Jeremy Mayfield will not disappoint you. Mayfield has been hit with a $1 million damage award in favor of postal worker Mary E. Bolton who was attacked by Mayfield’s five dog, pit bull/Labrador mixes. It is an interesting case and one more problem for Mayfield who is facing a major drug prosecution.
The ACLU has posted an interesting study that could have profound implications for criminal and torts cases involving injuries or deaths from tasers. We have been following such cases for years (here and here and here and here and here) now a study published by the American Heart Association refutes the claim that tasers are “nonlethal.” The AHA study shows that a rising number of people are dying after being hit by the 50,000 volt shocks (followed by 100 microsecond pulses of 1,200 volts). Since 2001, more than 500 people in the United States have died after being hit by police tasers.

Recently, I have been seeing more commercials for Christian dating. We have previously discussed new dating companies offering racially correct matches and the implications of such trends. However, ChristianMingle.com raises an interesting legal question in telling subscribers that they can “find God’s Match for You.” When does such an appeal to consumers become deceptive advertising as opposed to hyperbole?
I am going to go out on the limb and say that Lena David, 71, has a solid torts case. David was in the dentist chair in Lexington when Dr. W.B. Galbreath allegedly dropped a screwdriver in her mouth. She then swallowed it. That’s right, swallowed it and had to have a surgery to have it removed.
The video below shows two bicyclists who were struck by a car in Berkeley, California — victims of a hit and run. That would normally be the end of it except that one of the bicyclists had a bike-mounted camera and put the video on YouTube. Later police identified the Black Acura Integra of suspect Michael Medaglia, who was arrested.

There is an extremely high (and possible record for Colorado) award for the death of a pet n Denver. Robin Lohre will receive $65,000 from Push Maids for the death of her dog, Ruthie, after the cleaning crew let her out of the house and the dog was hit by a car.

The release of a tape taken of Mel Gibson in Costa Rica by the son of screenwriter Joe Eszterhas has prompted a threat of a defamation lawsuit by the actor. Not only did Eszterhas release the tape secretly made by his son during an argument with Gibson, he accused Gibson of not wanting to proceed with the film “The Maccabees” because he hates Jews.

Recent Cooley Law School grad Aminur Khan did not take long in locating a client: himself. Khan is suing a Michigan photography studio, Call Photography, for using his photo without permission to advertise its ability to retouch blemishes — showing Khan in before and after photos where his skin blemishes were removed.
