There is another controversy involving a police shooting. Jermane Reid was shot and killed after the Jaguar in which he was riding was pulled over for running a stop sign by Bridgeton officers Braheme Days and Roger Worley in a Dec. 30 traffic stop. When one officer reported seeing a handgun in the glove compartment, things got tense and ultimately led to the fatal shooting of the unarmed Reid. The officers are heard screaming over and over “Don’t you fucking move!” and “Show me your hands!” at the driver and passenger. Days repeatedly warns Reid not to move, screaming “I’m going to shoot you . . . You’re going to be … dead. If you reach for something, you’re going to be … dead.” However, Reid is heard saying “I ain’t got no reason to reach for nothing, bro, I ain’t got no reason to reach for nothing.” He then says, “I’m getting out and getting on the ground.” Days tells him not to move, but decides to step out of the Jaguar with his hands raised to shoulder height. He is then shot.

Clearly he should have obeyed the officer but his hands appear to be in clear view and Reid made clear that he was going to get out. Both officers appear to have fired at least six times. It is not clear if it was Reid or Days who opened the door. Under Tennessee v. Garner, there would be no justification for the use of lethal force in such a circumstance.

Reid, 36, had a record, including 13 years in prison for shooting at New Jersey State Police troopers when he was a teenager. He was also arrested last year on charges including drug possession and obstruction. Notably, Days was one of the arresting officers in the later arrests. That record however does not factor into the shooting if his hands were visible and there was no threatening behavior. Disobeying an order to remain in the car is obviously not sufficient cause for the use of lethal force under the controlling standard.

    Many will quickly say this was an unjustified use of force because the man holding the rifle was placing it down and was subsequently shot. But upon further examination, it is revealed that despite the suspect putting down the rifle, he was in fact also drawing a handgun and got shot by the backup officer. If you look carefully you can see the handgun pop out after the suspect goes down.

    This is the reason for a review process. One piece of the puzzle is not always conclusive either way.

  3. Why should we assume the gun in the glove compartment belonged to the passenger? It would more likely belong to the driver (his car), which would mean the passenger could still have had his own weapon concealed. There is far too many details missing.

  4. Would it have been better if officers, knowing there was a gun in his glove compartment, watched him get out of the car and kill them? He had one gun he could have two.

    If I had a gun in my glove compartment I would do what I’m told.

  7. If we are to get scientific, we are all animals my friend.

    Some of us are just better behaved animals and don’t try to kill or hurt each other. Even in the wild, rogue animals who are a danger to the group are put down by the rest of the pack or are driven away. Not that I’m suggesting that we gang up and rip out their throats, but sometimes you need to remove the sick animals from the group so that the rest will survive.

    Are you not aware that if you have a felony, you are disenfranchised? And to the many nationalists on this blog, that is the most precious right to exercise…

    Here I am going to agree with you. Some types of felonies and dangerous unreformed criminals should never be allowed possession of weapons again. Very few though fall into this category. Just like guns….not all felonies are equal. Other felons who have served their time, and reformed should not be disenfranchised. The right to bear arms and to vote are two of our most precious freedoms and unless the person continues to pose a danger to society, they should have their gun rights restored and at the very least the right to vote. Not all states disenfranchise for the vote BTW.

    I have a person who is very close to me who was a guest of the federal system for several years for a non violent crime over 35 years ago when he was in his 20’s. He has since become a model citizen, with no criminal activity…..OK…. a seat belt violation…… and is a positive contributor to the community in which he lives. A stand up guy in all respects. There is no reason that he should not be able to petition to get his rights back and have a gun for protection or for hunting..

  12. Thus is a troubling shooting and we need to go through the grand jury process to investigate the circumstances. After an appropriate investigation if the officers are deemed to have acted recklessly or maliciously the should be prosecuted to the fullest extent of the before a jury of their peers.

I would have shot him. and I am more of the peaceable type usually. but we are having lots of murders around here. I live 40 milse from Sikeston He totally did not do what the Officer told him. I am sick of these Anachro fascist types being allowed to walk the streets with a record with impunity and the pacifists to think they are “animals in cages” when they are put away.

      This guy is a cop killer and a criminal besides with a felony record. So, you think that’s okay that we are supposed to give him the blessings of society?

    Indeed. Have you checked our prison population lately? It’s not death, but the civilized world all but shuts you out in the vast majority of cases.

  14. “Citizens are increasingly viewed as assumed guilty (of some known or arcane legal statute) and police assumed to be just and in the right. Disproving a negative is difficult – especially when you have the state working against you with virtually unlimited resources and information at their disposal. Ignorance of the law is no excuse for citizens, but expedience and benefit of the doubt are for too many police.

    Police have a tough job to do in many instances. Less than adequate training, the power of a gun, testosterone / adrenaline fueled errors in approach and judgement don’t help.

    “Protect and Serve” is a good marketing catchphrase with no meaning.”
