“Preserve the Narrative”: The Public Rejects the “Insurrection” Claim in New Polling

In the day long events commemorating January 6th, Speaker Nancy Pelosi made a telling statement to her fellow members and the public at large. Pelosi declared “It is essential that we preserve the narrative of January 6th.” Part of that narrative is that this was not a riot but an “insurrection,” an actual “rebellion” against our country. Pelosi’s concern over the viability of that narrative is well-based as shown by a recent CBS News poll. The majority of the public does not believe that this was an “insurrection” despite the mantra-like repetition of members of Congress and the media. The public saw that terrible day unfold a year ago and saw it for what it was: a protest that became a riot. (For full disclosure, I previously worked as a legal analyst for CBS News).

Not surprisingly, the poll received little comparative coverage on a day when reporters and commentators spoke of “the insurrection” as an undeniable fact. Yet, when CBS asked Americans, they received an answer that likely did not please many. Indeed, CBS did not highlight the answer to the question of whether the day was really a “protest that went too far.”   The answer was overwhelming and nonpartisan.  Some 76% believe that this was a protest that went too far.

That, however, was not one of the four options to the matinee question featured by CBS. It did not allow the public to call this a riot when it asked them to describe “What happened at the Capitol on Jan. 6, 2021?” Why? There was the ever present “insurrection” and “trying to overthrow government.” However, the other two options were “patriotism” or “defending freedom.” That is perfectly bizarre. The most obvious alternatives to an actual rebellion in a violent clash would be a protest or a riot. However, the public was simply not given those options.

The result was predictable. Some 85% of Democrats dutifully checked “an insurrection” or “trying to overthrow government” while only 21% and 18% of Republicans agreed respectively.  For those who did not see the riot as an act of patriotism or defending freedom, they were simply left without a choice.

The poll perfectly captured the state of our media. There is no choice. Using the term insurrection is now a litmus test.  In the age of rage, one’s legitimacy is based on your volume and fury. After the attack, I wrote that this was not an insurrection, but it was a desecration of our constitutional process. When I have used “riot” in columns, I have received a torrent of emails objecting to the characterization as proof of being an apologist or “Trumper.”

Yet, “insurrection” and “sedition” are legal terms. They have a meaning. The FBI investigated thousands after January 6th and charged hundreds. Not one is charged with insurrection or sedition or conspiracy to overthrow the country. The vast majority are charged with relatively minor offenses of trespass or unlawful entry or property damage- the type of charges that are common in protests and riots.

None of that takes away from the disgraceful conduct of these people or the legitimacy of their prosecution. It is simply not an insurrection. This was a protest fueled by reckless rhetoric that was allowed to become a full riot by a shocking lack of security preparations by the Capitol police and the District of Columbia. A large national guard deployment was rejected and critical intelligence not shared by officials planning for the long-planned protests. Again, the fault still remains with the rioters themselves but this would have remained a protest if Congress had taken obvious steps of fencing and guard deployments. Indeed, those measures were used previously in Lafayette Park when the White House security was almost breached by rioters.

Yet, there remains a determined effort to keep the “insurrection” narrative “preserved.” The New York Times recently declared “Every Day is Now Jan. 6.” This is not simply important for political purposes. Democratic members and groups are again calling for members (and Trump himself) to be disqualified from running for future offices under the 14th Amendment. The “disqualification clause” was created for actual rebels who attempted to overthrow the government in the Civil War. Self-described “pro-democracy” advocates like Marc Elias believe that nothing says democracy like barring people from voting for the candidates of their choice.

If January 6th was an insurrection, then members challenging the electoral votes were little more than Confederate rebels. As with villages in Vietnam, it seems that democracy will be saved by destroying it.

The problem is that the public is not buying it. Even when the public is not given the choice by CBS of calling this a riot rather than an insurrection, the truth emerges like water finding a way out. The poll also shows the limits of not just Speaker Pelosi but the mainstream media in preserving such narratives. Despite the endless drumbeat of coverage referring to the day as an “insurrection,” the media cannot get the public to ignore what they witnessed — any more than getting viewers to accept reporting on largely “peaceful” protests with images of burning buildings in the background.  When the media was instructed to call the violent riots of prior summers “protests,” the effort to “preserve the narrative” failed with almost comical results.  This is why the “Let’s Go Brandon” movement is as much a criticism of the media as it is the President.

The failure to “preserve the narrative” is due to the fact that media is now locked into echo chambers of their own making. We have seen the rise of advocacy journalism where the narrative, not the news, controls the reporting. As Stanford journalism professor Ted Glasser explained “journalists need to be overt and candid advocates for social justice, and it’s hard to do that under the constraints of objectivity.”

The media, however, has become less and less relevant to public opinion. Despite the censorship of social media companies and the support of a legion of willing academics and experts, the coverage is largely self-contained. Most networks and newspapers have effectively written off half of the country. They are singing to the choir. That is reflected in the CBS poll.  The public was given the same options that viewers are given every night on network and cable programs: either call this an insurrection or join the Proud Boys and call it an act of patriotism.

The disconnect is dangerous. The effort to disqualify Trump or Republican incumbents is unlikely to succeed. That will not diminish the damage. Indeed, it will only further fuel the anger and, yes, the potential for violence on both sides.  Despite the CBS poll, there is a choice for the public. It can still reach its own conclusions . . .  increasingly without the help of the media.

  5. There is no way to paint what happened at the Capitol on 6 January in a good light. It was despicable and criminal.

    Adding perspective, there were approximately 700,000 protesters legitimately voicing their concerns. There were approximately 2000 people involved in the riot. Of those approximately 700 charged and the identified felons is so far less than 90. Those charged were 0.1% and the felons were 0.012%. So this needs a little perspective.

    My father was a WW2 veteran in the Pacific Theater of Operation in harm’s way for three years. For the VP to even try to compare this to the events of WW2 is an insult to the memory of the tragedy that resulted from Pearl Harbor and the bloodshed and hardships endured by those who were there.

    What happened I those seven hours is a misfortune of boneheaded and myopic thinking and lack of foresight.

  7. This is more of a poor attempt at a self coup. Trump pressured election officials to change results and pressured his VP to unilaterally decertify the electoral college votes. Trump lost and his own hand picked audits showed he lied.

He asked them only to look at the EVIDENCE – the same EVIDENCE Democrats spent billions of dollars and hours working feverishly to prevent anyone from seeing – like any good criminal.

  8. To believe that the event of January 6, 2021 was an Insurrection or a Seditious act stretches their meanings beyond the limits. To even define it as a Riot takes an imagination without bounds. Obfuscationist’s would be a more precise description of the accusers. They are endeavoring to cast a putrid odor on the citizens who were allowed into the Congressional chambers by security and then call them trespassers. Jailing these suppose trespassers for an extended time without due process or the right to a speedy trial. This is WRONG in all regards whether you are from the left or right politically. History will not be kind to those in authority who used the events of January 6th to punish the participants.

I know that it is a Fox talking point that there wasn’t any “insurrection”, but what happened that day, and whose fault is it? If the Trump disciples were merely “protesting”, they didn’t need to break down barricades, beat up police officers, forcefully break into the Capitol, urinate and defecate all over the place, smash doors and windows, deface John Lewis’s memorial, enter Congressional offices and steal papers and laptops, erect a gallows, chant “hang Mike Pence”, or invade the floor of the House, to disrupt Pence from accepting certified vote totals, which was merely a ceremonial act.

    Why did the faithful do what they did? Trump began lying about his “landslide victory” being stolen even before Election Day, and has lied about losing ever since. He went on unprecedented “Stop the Steal” rallies to rile up the faithful and encouraged them to go to Washington, promising “it will be wild”, and telling them “if you don’t fight like hell, you’re not going to have a country any more.” He told them to “hope Mike Pence does the right thing”, which in his mind was to ignore the law and refuse the ceremonial acceptance of certified vote totals. He told them he would be with them, which was a lie.

    What was their intention? To try to force Congress to keep Trump in power and thus overturn the results of the 2020 election. Now, what, exactly is it called when a group of people forcibly disrupt the functioning of our government for the purpose of installing an election loser in order to defeat the will of the American people? If that’s not an insurrection, then what it is?

      The word insurrection says there was a plan on n place. No one has identified any plan or planners. It was a riot but use of that charged word allows the DOJ to deny the assisted their rights of due process. That kind of governmental excess should concern anyone who cares about our republic.

Hannity had advance notice. The conspiracists had a room at the Willard Hotel, across from the White House, that they worked from.         1. This protest, like most protests, was “planned”. Organizers had Powerpoint presentations, busses, clipboards, hotel rooms and 2 way radios (not to mention a website and social media presence). None of that implies an “Insurrection”.

          Every protest movement has a political outcome they desire – that isn’t insurrection either.

          Peaceful protests often turn into riots when troublemakers in the group perceive weakness or inaction on the part of law enforcement.

          This is similar in many respects to the legal definition of “assault” which involves a “credible” threat of violence. A quadriplegic shouting “I’m going to kill you” from his hospital bed isn’t assault. A bunch of angry rioters saying “I’m going to stop this steal” isn’t an act of insurrection.

          The Justice Department, under the direction of Joe Biden’s Attorney General Merrick Garland, looked carefully at Title 18 and the relevant case law and concluded that they had no reasonable chance of convicting rioters of Insurrection.

          If they charged the rioters with Insurrection and lost in court (as they almost certainly would have) – it would kill the “Insurrection” narrative.

          You may not like Mr. Turley but he is a legal scholar who understands the law extremely well and I think his analysis is pretty solid.

There was a coup and it was successful in November when the Democrats stole the election, destroying any proof, and relying on the judicial branch’s (understandable) reluctance to interfere in election results.

HE has not been arrested, just briefly checked out (his phone got a cursory glance) and it’s because he’s an FBI agent/asset undercover who instigated it. Some knew who he was and yelled “FED, FED, FED” in response to his yelling to go to the Captial and break in (you can hear people yelling “Won’t they arrest us if we do that?” and “We can’t do that, it’s against the law”). Pelosi is hiding 14,000 hours of video from 1/6! There was only one place where there was “urine and defication” (there’s plenty in my deep blue big city on the sidewalks!), not “all over the place”. Only 1 or 2 laptops, etc. were taken by a very small group of individuals. The doors and windows were the ones they used to get in (emmergecy “doors” in windows) and a father and a son and friends had a noose and were yelling for Pence. Did you see actual gallows? I’ve never seen that. Pres Carter and SOS Baker did deep research into the huge fraud potential of mail-in ballots and I’ve seen the illegalities and irregularities. I don’t think Trump won by a landslide (and now it seems that an FBI plant in the WH staff came to Trump with evidence of a “landslide” that was bogus, ON PURPOSE, to get him to freak out. It’s the SAME GUY who farmed the bogus Steele dossier around DC, including to Obama and his WH). But I’ll tell you one thing, I watched the campaigns, primaries, and I’ll never believe in 20 MILLION YEARS that Biden got 81 million votes! And I saw the irregularities and illegalities myself and I think probably neither got to 270 electoral votes and then a vote is done in the House (which Trump probably would’ve won as there’ s more red states than blue). Trump’s rederic sounded EXACTLY like the Dems in 2016 and 2017! The Dems in the exec. branch actually called themselves the “revolution”!!! And Schummer said to fight like hell to save “our democracy” (we are actually a constitutional republic and not an “our democracy” – the founders HATED “straight up, mob rule, democracies”.). I’ll tell you what the intention was because it’s been talked about A LOT (but the Dem Marxists who never saw an election they didn’t want to rig – listen to the undercover vid that exposes that!) won’t report on that), the intention was to get a forensic audit done, that needed to be done and is now proving illegalities and irregularities enough to give the election in some states to Trump. As for Trump’s comment of “or you’re not going to have a country anymore?” Oh, heck, we’re getting close to him being ACTUALLY RIGHT AGAIN!

  13. Despite the endless drumbeat of coverage referring to the day as an “insurrection,” the media cannot get the public to ignore what they witnessed — any more than getting viewers to accept reporting on largely “peaceful” protests with images of burning buildings in the background.

    Democrats cannot come to grips with the fact a majority of Americans remain immune to the gaslighting tactics of the mainstream media. When they see with their own eyes months of rioting, arson, assault and murder, and they are told these are “peaceful” protests, they have that as a legitimate baseline by which they can measure the event on January 6th. They don’t need to be told a narrative. They’ve condemned the 2020 riots as well as the 1/6 riot. What is abundantly clear, is there was far more coordination and damage in every 2020 riot than there was on 1/6. Pushing a narrative that this event was a threat to our democracy was never going to succeed with a majority of Americans that witnessed Democrat-supported chaos in 2020.

        So let’s play out this “insurrection” narrative. Hundreds, perhaps thousands of “mostly peaceful” and unarmed protestors descend on the capitol to overturn an election. What specific action(s) were they threatening to take that would have threatened our democracy? Kill a congressperson? Attempted assassination of Rep. Scalise certainly didn’t concern Democrats that it was a threat to democracy. Arson, destruction of government property? Didn’t concern Democrats in 2020 that it was a threat to democracy. Assault and murder of law enforcement personnel? Doesn’t to this day concern Democrats that it is an assault on our democracy. Take over and claim the Capitol building as an autonomous zone, perhaps chain themselves inside the government building? Didn’t concern Democrats in 2020 that it was a threat to our democracy.

This was not a “protest”–they were trying to “Stop the Steal”, just like Trump told them they should.

Again, Epps helped push past the short “bicylcle lock-like” fence that was there (it was NOT a “barriade”, it was short and not connected together; it’s like what you see at a concert. I SAW IT IN A PICTURE WITH THE 500,000 who were there protesting). Why did so many NOT tell them to stop?? Why did so many escort them in or just allow them to walk in? NO, THERE WAS NOT “PEE AND CRAP ALL OVER THE PLACE”, that is a lie. How many papers and laptops were stollen and by how many people. And Trump never “told them to do it”, Ray Epps did and the one Antifa/BLM guy (he admitted it under oath) who was yelling “We can do this” and “Lets burn the place down” and he is now doing time for his actions (since he’s a Leftist, he’ll get out soon).

I’m not certain whether you are dishonest in that, or merely naive. Mobs don’t work that way, they gather and mill, some people shout slogans, and some seemingly innocuous act will start a stampede. Likely this mob was instigated in part by FBI informants, but most of the constituents probably iintended to merely show support for the LEGITIMATE inquiries into whether the election was or was not conducted fairly, and according to law. The lying media are terming those inquiries as part of an insurrection. That is the classic Soviet BIG LIE.
