Destroying Democracy to Save It: Democrats Lose Another Effort to Disqualify a GOP Member

For two years, Democrats have been trying to disqualify dozens of Republicans from appearing on ballots for supporting the challenge to the certification of the 2020 election or declaring the election to be stolen. It is premised on a deeply flawed historical and legal view of a provision under the Fourteenth Amendment. In the name of democracy, these Democrats have demanded that courts prevent voters from being able to vote for incumbent members. Yet, scholars like Harvard Professor Laurence Tribe have endorsed this sweeping interpretation. It has been rejected repeatedly in the courts. The latest such ruling comes from the Arizona Supreme Court which ruled that Democrats could not prevent Rep. Paul Gosar (R-AZ) from appearing on the ballot in 2022.

In the age of rage, nothing says democracy like preventing people from running for office.

Last year, Democratic members called for the disqualification of dozens of Republicans. One, Rep. Bill Pascrell (D-N.J.) demanded the disqualification of 120 House Republicans — including House Minority Leader Kevin McCarthy(R-Calif.) — for simply signing a “Friend of the Court brief” (or amicus brief) in support of an election challenge from Texas.

These members and activists have latched upon the long-dormant provision in Section 3 of the 14th Amendment — the “disqualification clause” — which was written after the 39th Congress convened in December 1865 and many members were shocked to see Alexander Stephens, the Confederate vice president, waiting to take a seat with an array of other former Confederate senators and military officers.

Justice Edwin Reade of the North Carolina Supreme Court later explained, “[t]he idea [was] that one who had taken an oath to support the Constitution and violated it, ought to be excluded from taking it again.” So, members drafted a provision that declared that “No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

By declaring the Jan. 6th riot an “insurrection,” some Democratic members of Congress and liberal activists hope to bar incumbent Republicans from running. Even support for court filings is now being declared an act of rebellion. House Speaker Nancy Pelosi (D-Calif.) helped fuel this movement — before Jan. 6 even occurred — by declaring that the Republicans supporting election challenges were “subverting the Constitution by their reckless and fruitless assault on our democracy which threatens to seriously erode public trust in our most sacred democratic institutions, and to set back our progress on the urgent challenges ahead.”

This effort failed on legal grounds in seeking to bar Rep. Madison Cawthorn (R-N.C.) from running for office due to his actions related to the Jan. 6, 2021. It failed on factual grounds in seeking to bar Rep. Marjorie Taylor Greene (R., Ga.), even after a federal district court wrongly allowed a hearing to be held.

Now the Arizona Supreme Court has ruled that not only did the challengers lack the standing to bring the case but Arizona Supreme Court Chief Justice Robert Brutinel reaffirmed that this is a power left to Congress:

“Qualifications of its own Members,” appears to vest Congress with exclusive authority to determine whether to enforce the Disqualification Clause against its prospective members. However, we need not decide these issues because we hold that A.R.S. § 16-351(B), which authorizes an elector to challenge a candidate “for any reason relating to qualifications for the office sought as prescribed by law, including age, residency, professional requirements or failure to fully pay fines . . . ,” is not the proper proceeding to initiate a Disqualification Clause challenge. By its terms, the statute’s scope is limited to challenges based upon “qualifications . . . as prescribed by law,” and does not include the Disqualification Clause, a legal proscription from holding office.

The conduct of those Republicans who voted to deny certification of the election results WAS NOT BASED ON GOOD FAITH OR ANY FACTS. This was an all-out last-ditch effort to deny the will of the American people and to keep the election loser in office by any means necessary. THAT violates their oath of office.

    Turley lamely attempts to distinguish the logic that someone who has violated their oath to support the Constitution should be disqualified from running by downplaying the well-planned and coordinated insurrection as a mere “riot”. No, Turley, the Jan. 6th Committee, despite efforts from many of Trump’s co-conspirators to hide evidence by refusing to cooperate, keeps turning up proof of just how well-coordinated this “riot” was: it wasn’t spontaneous at all, and members of the Proud Boys were communicating with someone in the White House BEFORE the insurrection. The aim of Jan 6th wasn’t to “protest” –what was there to “protest” anyway– the fact that Trump lost? Why use the date of Jan. 6th? — because that was the day Biden’s certified win would be entered by Congress, and Trump had failed to stop Biden’s victory by litigation and bullying state election officials to misrepresent vote totals, and he also failed to bully Pence into refusing to accept the certified results. The disciples were there to carry out Trump’s exhortation to “fight like hell or you’re not going to have a country any more”. There were other conspirators just outside the District of Columbia in a motel with a cache of weapons, waiting for Trump to give the order to move against Congress and stop Biden’s victory from being certified, but Trump was a no-show. Nevertheless, Trump-supporting Republicans still tried to prevent Biden’s win from being certified based on nothing but the ego of a narcissistic liar. You Trumpsters ask yourselves: on what basis did members of Congress vote against accepting certified vote totals showing Biden had won, OTHER THAN the Big Lie? Since they had no evidence, they were violating their oath to protect and defend the Constitution and should be disqualified.

              For the most part TTV did not make much effort to prove that the fraudulent ballots were for Biden.
              Most of us grasp they are. But it is not proven they were.

              We do know they were fraudulent, just not who benefited.

              TTV did not identify the 501C3’s that were running this election fraud operation.
              Some could be republican. That is not likely, but it is still not proven that Biden won.

              Finally TTV focused on the 6 unusual areas of the country – that is reasonable, but they did not check for similar or different election fraud by the GOP.

              It is near certain that a thorough examination of the election will find fraud by both parties.

              These idiotic claims that 2020 was the most secure ever and there was no fraud are just proof of the stupidity of those uttering such nonsense.

              I suspect a thorough examination will expose some fraud on both sides. I suspect that of democrats will be far larger than Republicans.
              But that is my speculation.

              What is proven so far is there was a large scale organized illegal ballot harvesting operation in AZ, MI, WI, NV, GA, and PA – especially PA.
              It is pretty obvious who benefited, but that is not yet proven.

          We are no longer in the territory where having a title like lawyer or doctor affords someone credibility. Sussman is a lawyer, Fauci is a doctor. Oaths are absolutely worthless. The only thing meaningful is what one actually does. What has become apparent is the trust but verify idiom seems to only be important to conservatives. Silberman claims to believe 2000Mules has been debunked, but he won’t be bothered to verify that is true. The 2016 election was all about verify. I had verified Clinton could never be trusted. Trump was a political unknown and he was going to have to earn the trust. And he delivered, despite the Democrats efforts to paint him as untrustworthy.                 I praise Turley’s judgment by and large when he speaks out. My criticism is his hypocritical silence about Fox News, Newsmax and OAN. If 2000 Mules is as you say it is, Turley would certainly report it. Why wouldn’t he? He reports the truth about the Hunter laptop. He advertises Durham’s investigation. If Turley remains quiet, it stands to reason that the movie is BS.

      It applies to those who break their oath by supporting an attack against the constitution. Encouraging sedition is also an attack against the constitution and an abandonment of their sworn oath to uphold the constitution. Turley focuses on insurrection, what about their support for sedition?

      This admission by OAN means absolutely nothing. Solid evidence now exists showing Biden lost the election by a lot. It behooves any media to clean up things they cannot prove and devote their attention to what has just been confirmed, Biden lost. Concentrate on the big stuff.

      The admission only involved counting ballots in a specific area. It is meaningless and insignificant when one reviews 2000 Mules which involves illegal trafficking, not counting votes. The difference between the two is vast. Trafficking has been proven with evidence the police use, plus the additional evidence of videos, whistleblowers and the non-profit centers that were at the center of the illegal ballot distribution.

      In an attempt to prove accuracy beyond any reasonable doubt, 2000 Mules used the most stringent criteria that eliminated a much greater supply of illegal votes and limited the investigation to just a few areas. Biden lost using these low numbers. One can only imagine how bad Biden’s loss actually have been had they used reasonable, less stringent requirements and a more extensive search area. I guess that Biden’s loss would have been tremendous.

      See 2000 Mules. Some might find such detail taxing but push on because as the pieces are exposed, one can picture the criminality of the left up close. Not only that, but the left used real criminals.

        TTV makes clear the methods they used to catch these fraudsters, and that makes it possible for them to adapt their process in 2022 and beyond.

        They can avoid ballot boxes and use mail boxes instead.
        The 501C3’s can rent locations using proxies.

        It is also likely given the demonstrated political bias of Big Tech that Google will not sell geofence data to TTV in the future.

            Nothing in 2000 mules proves beyond any doubt these people were democrats. And TTV chose not to releast the names of the orgainizations that are implicated in this. Ultimately that will come out.

            You are free if you want to beleive for the moment that TTV found a Trump Ballot harvesting campaign in Democratic strongholds.

            I am not skeptical of most of the films claims. The FUNDIMENTAL claim – that there are atleast 380K fraudulent ballots that should not have been counted in 2020 is proven just about as well as can possibly be proven.

            There is little doubt who benefitted – but the film does not establish that.

            I think they could have done several things better:
            Persuading their focus group of prominent republicans was not compelling.
            They should have used ordinary people
            But that is a messaging problem not an evidence problem
            6 Democrats saying maybe there was fraud – is more powerful that Sebatian Gorka.

            They were also weak on where the ballots came from. Ultimatley that is important – because it is FURTHER fraud.
            But merely running ballots large scale through third parties is FRAUD. It is a huge violation of election laws.

            Personally I suspect that MOST of the ballots are “manufactured” – they were not filled out by real voters.
            But that just makes this worse if true.

            TTV did touch on the nursing home ballot fraud in WI – that likely occured elsewhere too.
            It alone was likely enough to tip WI, but I stronly suspect it was NOT the most significant ballot fraud in WI.

            The manufactured ballot argument dovetails with the AZ audit. There were way too many double and tripple votes by the same person.

            One explanation is 17K people voted 2, 3, 4, 5 and 6 times.

            A better explanation is that some group was manufacturing over 100K ballots for people who had not voted in the past 10 years – and 17K of them did vote in 2020 triggering duplicates.

            BTW there is strong evidence of this in the News Recall – but no one looked into fraud because Newsome avoided recall handily.
            It is unlikely that there was enough fraud to explain Newsomes totals.

            There were hundreds of thousands of photocopied ballots in AZ, but because some election officials had photocopied blank ballots there was no way to tell if any were forged.

            Complexity interoduces error and error creates oportunities for fraud.

        Now law enforcement can investigate those (thought the cell data gets that too). They can investigate everyone working at these places.
        They can look at finances – follow the money. They can look into where the ballots came from.
        Again – most of these people are small fry – and again if only a small number of them roll – that will expose people further up the food chain.

        There is far more than enough to roll this whole operation up – from the bottom in layers to the top.

        The scale is so large that it will not be very hard at all to get people to cooperate.

        Every single person who they have video of depositing more than a few ballots faces felony jail time.

            I have seen people convicted of drug delivery resulting in death because a SHARED cell phone that they had access to was pinged near where the drug deal took place at the right time.

            TTV has provided law enforcement with far more than enough to CONVICT the mules.

            That is not the big deal.

            The big deal is that there are so many mules and such compelling data – it is near certain they will be able to roll up the entire operation.

            Most states did not even allow family members to return your ballot – because almost everyone is capable of mailing a ballot.

            Wisconsin did not allow ANYONE else to return your ballot – Wisonsin did not allow ballot boxes – but the Sec State set them out anyway.
            WI courts have already ruled that illegal.

            But WI law allowed a “shutin” to request an election official to come and pick up the ballot – if they could not get to a mail box.

            I do not think ANY state (except CA) allows a “friend” to return a ballot. One state allowed a stranger to return a ballot – but they had to have a notarized power of attorney to do so.

            Whether you like it or not placing 5 ballots into a drop box at one time is ALONE sufficient evidence to CONVICT of ballot fraud.

            But if you think that 2000 people can each come up with 5+ immediate family members who voted and who live nearby – go for it.

  14. We have two major parties trying to divide Americans during election season. Then we greatly extended a non-stop election season. Now we have 24/7 divisiveness year round with no rest between elections. What do the politicians expect would happen?

    It’s largely the voters’ fault, both parties destroy politicians that try to unite us and bridge our differences. Remember John McCain correcting lies about Obama or Charlie Christ trying to save his own party? They were essentially kicked out of their party.

    The Framers of the Constitution never designed political parties into the system, they designed a “bicameral” system (House & Senate). This divided, maybe we need to get back to basics.

    Nobody benefits except the “Division Industry”! Neither party is talking about debts and deficits that our children and grandchildren will inherit but we spend our energy hating the other party.

      In and of itself, peacefully protesting outside the home of a Justice is not illegal.

      I support people’s 1st Amendment rights to do both.

      1. And then there’s the other issue: how did the organizers of the protests get the home addresses of the Justices? Presumably by going on the Internet to one of those sites that sell personal information to anyone who will pay for it. There have been a number of cases where people have been stalked and even killed by persons who found out where they live by purchasing the info online. Yet Congress has never taken any action to reign in these data brokers, or even allow people the option to opt-out of having their private information sold online. And if the issue came before the Court, would Alito, Roberts and Kavanaugh say that nobody has a right of privacy, or even the right to prevent their home address and other private info from being bought and sold on the Internet? They can’t have it both ways. Since they don’t believe that a right to privacy exists under federal law, then they should put up with the protesters outside their homes, or move to a different state.

        1. My impression is that a fair number of the people protesting at the Justices’ homes are neighbors, and that’s why they know where the Justices live.

Or were you referring to the fiery but peaceful summer riots, CHOP, the invasion of the judicial hearings that involved actual aggression, the harassment of judges at their places of residence, the harrassment of reps while they were using the toilet, the multiple assaults on Andy Ngo, the calling Thomas an Uncle Tom, or even the SCOTUS leak?
