Turley Testifies in the Senate on Domestic Terrorism

This morning I will be testifying before the Senate Judiciary Committee on the expansion of domestic terrorism investigations. The hearing is titled “Examining the ‘Metastasizing’ Domestic Terrorism Threat After the Buffalo Attack” and will begin at 10 am in the Hart Senate Office Building (Room 216). The written testimony is linked below.

The Democrats have proposed legislation that would create news offices for the investigation of domestic terrorism. It would impose reporting, training, and assessment of “the domestic terrorism threat posed by White supremacists and neo-Nazis, including White supremacist and neo-Nazi infiltration of Federal, State, and local law enforcement agencies and the uniformed services.” The legislation also directs these offices to prioritize certain domestic terrorism cases. It is that final element that runs against the grain of the Constitution and the principle of separation of powers.

As discussed in the written testimony, we all have ample reason to oppose these violent elements on both the left and the right. The Constitution imposes limits on the range of action for Congress in addressing such issues from the First Amendment to the doctrine of the separation of powers. The “Domestic Terrorism Prevention Act” is an example of how such means can be well-intended but still contravene constitutional principles. I encourage the Senate to reconsider this approach to address those concerns.

      1. George, if I’m interpreting your questions right, you want to know whether under the current Constitution (as amended 27 times) you have the freedom to think and act with racial prejudice. Is that what you’re asking?

        There are many layers to the answer. If you are a government worker, you may privately think, but not act with racial prejudice in any official capacity. And, since the way you think can affect your work, you’d be better not serving the public.

        From the psychology research I’ve been studying on newborns, every human is born with an innate preference for self-similar social company. So yes, at least one component of racism is inborn — it is a legacy of 200,000 years of survival in tribes. That component of racism is not taught or learned, although with self-awareness learning, it can be made so dormant that individuals can effectively work with, and even intermarry with someone from a different race/ethnicity.

        For those who see no reason to want to get along with good-natured, responsible, trustworthy people other other ethnicities, OK, they can remain scared and small-minded. It’s not becoming. It’s the opposite of inspirational. I don’t know anybody like that, and I wouldn’t want to.

        As an example, as a result of brazen urban crime mostly committed by young black men (hold-ups, carjackings, drive-by shootings), I’m seeing many Americans throwing shade on all black Americans. Yet, the reality is that a tiny % are involved in these crimes. And so I ask: What about the 99% of African-Americans who are not involved in criminal lifestyles?….what do they deserve for being law-abiding? Do they deserve to be above your suspicion? Any fair-minded person would say “Yes, law-abiding black Americans deserve to go about their lives free of suspicion.” That reflects the 4th Amendment to the Constitution, which says you cannot be tagged as suspicious absent solid evidence linking you to a specific crime. Sharing skin tone with a criminal does not qualify as reason for suspicion under our system of law.

        Yet, we know that the human brain comes wired up to detect statistical patterns, and combined with the inborn favortism for the race of our birth, and with the fear response which can be quite broad and non-specific, it’s a challenge to live up to the high ideals expressed in the Constitution.

        One the worst mental shortcuts anyone can make is to harbor suspicion of a fellow human where none is warranted or justified.
        Think how it feels when you have been unjustly accused of something bad. Then, step into the shoes of someone who is receiving your false accusation or errant suspicion. Anyone with reasonable empathy, following the Christian Golden Rule, will therefore try to extend trust and goodwill where there is no evidence to not do so.

        I hope I answered your question. In short, the law is blind to race-ethnicity, and as free-thinking individuals, we each decide to what degree we want to act with that same fairness toward others. Those who reject the idea of acting with fairness stand out as a-holes.

        Interestingly, the Founders determined the appropriate age for voting to be 21.

  13. Jonathan: I read your statement submitted at today’s Senate hearing on domestic terrorism. It’s basically a repetition of previous testimony you have previously given to Congress. You claim Jan. 6 was just a “riot”–not an act of “domestic terrorism”. And: “The use of terrorism laws for such violent protests is inimical to free speech”. Really? The destruction of Capitol, the loss of 7 lives–all in an attempt overturn a legitimate election and the Constitutional order does not seem to fall into the category of your run of the mill “riot” or the exercise of “free speech”. But Chuck Grassley will love your testimony.

    You spent a lot of time in your statement trying to divert attention away from white nationalist terrorist groups into your claim that Antifa is the real domestic terrorism threat: “The Antifa movement is arguably one of the most organized and most successful anti-free speech movements in our history”. After Jan. 6 some GOP politicians picked up on this theme by falsely claiming Jan. 6 was a “false flag” op carried out by Antifa and the FBI. I was bent over in laughter when I heard that one. It’s ludicrous to think Trump would enlist Antifa to carry out his seditious plan. That conspiracy theory soon fell apart after the shock troop leaders of the insurrection were identified and arrested. The leader and members of the white nationalist Proud Boys have just been indicted and charged with “seditious conspiracy”. In the Buffalo mass shooting the shooter was not inspired by Mark Bray’s “Antifa. The Anti-Fascist Handbook”. As he states in his manifesto he was inspired by white racist ideology and the “Great Replacement Theory” peddled by white nationalist groups and, believe it or not, Tucker Carlson.

    By the way Fox is throwing in the towel when it comes to covering actual “news”. Fox says it won’t cover the Jan. 6 public hearings starting Thursday. It calls the hearings “grotesque”. No big surprise. Fox is in the “opinion” business. Rupert Murdock admitted this when he successfully defended Carlson after he was sued for libel. Fox said Carlson does not deal in “actual facts” because “any reasonable viewer arrives with an appropriate amount of skepticism about the statements he makes”. This probably comes as a shock to many in this chatroom!

    You must be disappointed Fox will not be covering the Jan. 6 public hearings. Looks like you will have to tune into ABC, CBS, NBC CNN or MSNBC–you know, the “liberal media” you are always complaining about.
