The Golden Rule and the Hunter Biden Scandal: Three Questions Raised by the FBI Leak

Below is my column in the Hill on the noticeably narrow scope of charges referenced in the recent FBI leak from the Delaware investigation. The leak raises a number of intriguing questions in its wake.

Here is the column:

President Biden’s hot mic moment during a visit to hurricane-stricken Florida — in which he muttered that “No one f–ks with a Biden” — left many people confused. His Sopranos-like warning might not deter developing hurricanes but it has succeeded for years in Washington as a kind of “Biden Golden Rule.” Neither prosecutors nor the press have seemed interested in pursuing allegations of criminal or corrupt practices by some members of the Biden family.

Now, after years of investigation, reports indicate that FBI agents are convinced ample evidence exists to charge the president’s son Hunter Biden on gun- and tax-related charges. Those charges (and a possible plea) may be the best-case scenario for the Bidens — and many others in Washington. Indeed, the reported narrow scope of a possible indictment is strikingly similar to what I previously described as the ideal “controlled demolition” of the Hunter Biden scandal.

Three questions immediately arise from this Justice Department leak, and the concern is that all three may be answered by the Biden Golden Rule:

For the Bidens, justice delayed is justice

The first question is why, in an investigation that began in 2018, the Justice Department only now believes it could charge over false statements on a gun registration form and on tax evasion. Both crimes were well established years ago.

The gun charge is based on the fact that Hunter Biden reportedly answered “no” to a standard question about whether he was an “unlawful user of, or addicted to” a narcotic drug or any other controlled substance. He wrote a book detailing his raging drug and alcohol addictions during this period (ironically, even as his father called for stricter enforcement of gun laws).

The FBI has long had the gun registration form, the book and other self-incriminating statements, not to mention President Biden’s repeated references to his son being an addict.

Hunter Biden also apparently did not pay taxes on millions garnered from his foreign business dealings or alleged influence-peddling schemes, and a Hollywood lawyer reportedly paid off as much as $2 million in delinquent taxes on his behalf recently. The FBI has had Hunter Biden’s infamous abandoned laptop since 2019, detailing payments from foreign sources and gifts or benefits, including a diamond.

Yet the long investigation has worked to the advantage of the Bidens as well as the Democrats in pushing any indictment beyond 2020 and, most likely, after the 2022 midterm elections. Indeed, Hunter Biden’s lawyer insisted after the leak of possible charges that prosecutors “should not be pressured, rushed, or criticized” to act.

It is often said that “justice delayed is justice denied” — but in politics, justice delayed is simply justice.

Is this all there is?

A second question concerns what were not referenced as likely charges against Hunter Biden.

For years, some of us have said an obvious, overwhelming argument existed to appoint a special counsel in this case. Yet Attorney General Merrick Garland has refused to do so.

Hunter Biden’s laptop reportedly contained detailed emails about business deals spanning the globe and millions of dollars from foreign sources, including some tied to foreign intelligence operatives. Some of his accounts reportedly were used to pay some of the bills for President Biden.

Even if the Justice Department is set to decline charges linked to foreign money transfers or influence-peddling, there is the obvious omission of charges under the Foreign Agent Registration Act (FARA). The Justice Department has used FARA aggressively in past prosecutions such as that of Trump associate Paul Manafort.

The omission of a charge under FARA would be glaring and troubling in light of those past prosecutions. And with the refusal to appoint a special counsel, that omission would likely avoid a public airing of any influence-peddling allegations tied to the Biden family.

A telling leak

The third question is why this leak occurred in the first place. Hunter Biden’s lawyer is justified in objecting to this leak and noting that it likely would constitute a federal crime. So why would sources at the FBI take the risk of a leak at this time?

Much like the Supreme Court leaking of the Dobbs decision, this one appears intended to trigger a response. The most obvious motivation would be to lock in the Justice Department if agents feared the department’s leaders might be resisting or delaying any charges.

It could also be an effort to alert the public about the narrow scope of charges being discussed with Hunter Biden’s defense team as a possible plea deal. There may also be concern that a plea deal might be reached before any Republican takeover of the House of Representatives. GOP leaders have pledged to investigate the influence-peddling allegations, but a plea could be used to say the matter is now considered closed by the Justice Department.

The focus on the gun charge is likely to highlight the absence of charges related to the reported foreign payments and alleged influence peddling. While the standard registration form warns of a potential 10-year sentence for false statements, it is rare to see significant prison time emerge from such cases. Indeed, prosecutors often choose not to charge on such violations. As a first-time offender, Hunter Biden could avoid prison entirely or plead to a short period of incarceration.

For those concerned about alleged influence-peddling, such a charge may seem like arresting a bank robber solely for double-parking his getaway car. While the reported charges could result collectively in a few years in jail, the absence of far more serious charges is likely to raise questions about the scope of the investigation.

The videos and emails reportedly uncovered on Hunter Biden’s laptop show a wide array of alleged criminal acts — a target-rich environment for any prosecutor. Indeed, it would take an amazing marksman to hit the gun charge and a few tax violations while missing other potential crimes. While any eventual indictment might contain other charges, the leak (if accurate) suggests a strikingly narrow focus as a basis for a possible plea.

The U.S. attorney in charge of this investigation, David C. Weiss, is a respected prosecutor. Even so, many Americans may wonder why Hunter Biden’s case suddenly was downgraded from a Category 5 hurricane to a tropical storm.

    2. On 8/6/20 FBI agents Nikki Floris and Breadly Benavides advised Senators on matters purportedly related to the investigation into Hunter Biden. The briefing led to a leak that falsely labeled the investigation as advancing Russian disinformation.
    3. In 10/20 NYPIt’s published some of Hunter Biden’s e-mail corrspondence.
    4. Within days 50+ high profile ex-intels wrote a letter that this might be about “Russia Disinformation”
    5. Mainstream-media and “Big Tech” surppressed story.
    6. All these efforts because Hunter Biden made a mistake by filling out Form 4473 (Firearm Transaction Record) or his representatives had another POV about his taxing?

  3. You’re correct Mr. Turley, Hunter Biden is being massively under charged for a guy who’s had his bank account flagged so many times for suspicious activity. The influence-peddling related charges are being scrubbed to protect Joe Biden who is complicit in his son’s crimes.

    I do believe this leak is coming from people who want the public to know they nevertheless have evidence to charge Hunter with some crimes, so if he gets off it’s proof Biden put the fix in.

JT has made it clear that he wants Garland to appoint a special counsel for the Hunter Biden investigation but it’s unclear whether he wants Garland to make US attorney Weiss (appointed by Trump) a special counsel as recommended by Senate Republicans or if he wants Garland to appoint someone else a special counsel. A new one appointed now (or any time since Garland became AG) could significantly delay the investigation.

Ok on one question you have to know the answer to if you’re an addicted or Habitual user…..you intent maybe…..on answering that question gets you subjectively in hot water… Maybe. for 6 months of perjury. Hah there is no answer! . Another question asks if your mentally ill…..you can be totally mentally ill and KNOW it….and be on meds……but you are not denied from owning a gun unless you’ve been “committed”. Against your will!!   6. We have military cemeteries located throughout the nation as final resting places for those who gave their last full measure to the idea of American patriotism and exceptionalism. I propose that we now develop new final resting places for all the swamp scum that permeates our body politic. These hallowed locations can and should be placed next to the most polluted and environmentally scarred areas found in our nation and burial there would be mandatory for any politician who serves more than 2 terms, is convicted of any crime while in office or has family who profited from rules and laws made while said person was in a position to further their enrichment. We won’t need a lot of land for the cemeteries as all the bodies can be interred vertically in the ground with a large corkscrew as the person being buried is that slimy and crooked.

    1. Anyone who dies while performing a military function allegedly “in service to the US” is one of 2 things or both: either greedy and/or a sucker. Greedy for accepting the job for the pay and/or benefits, a sucker for thinking that military service is a noble goal.

They cause primarily an increase in orphans and dead innocent children. Wiki states that modern warfare kills only 1 military member per each 10 innocent civilians.

    If your Addicted or Not in handling Illegal Drugs there are some obvious method one uses to continue the drug use.
    Hunter Dealt Drugs, It is normal for a Addict/Trafficker to purchase an “8-Ball” and break it up into smaller units for Distribution.
    Also this often includes “stepping-On” (cutting) the drugs with a non-active ingredient(i.e.: Mannitol baby laxative), to cover the loss of the volume of the illegal substance.

    The Addict/Trafficker then peddles the substance to break-even or make a small profit, while keeping their share cost-free.
    (i.e.: Weed: buy a Pound, split it into 4 quarters, Sell three quarters at the cost of the Pound and keep one quarter for yourself(Free/Profit – S.O.P.).

    “Some Dancers” like Nose-Candy, Hunter definitely frequented the ‘Strip Clubs’. No doubt He was ‘Soliciting Sex’ from Dancers and enticing them with Drugs.
    Strip Clubs have Video Cameras for the Safety of the Dancers and Patrons alike (at least Parking Lot Video). He was filmed at some point.

    Guns:
    If you deal with Drugs, you are no-doubt going to be carrying a Gun. As stupid he is, He’s not that stupid.

    Because the judicial branch and Supreme Court have so failed America, the impeachment process must be streamlined and accelerated to accommodate the increasing volume of violation of the Constitution and corruption in America.

    If the Supreme Court had fulfilled its sworn-oath duties and struck down the constitutional violation and nullification of “Crazy Abe” Lincoln, America would not be in this Augean stable today.

    The Supreme Court is the singular American failure.

  10. Is this the Jonathan Turley blog today or the Svelaz blog? Even though the Professor wrote a long blog today, Svelaz has seemed to eclipse that volume by a large margin. A lot of people care about what happens to Hunter Biden in order to compare and contrast his possible prosecution to the over the top prosecutions of anybody who was within 50 feet of Donald Trump. My main interest is if there will 20 FBI agents banging on Hunter’s door with drawn guns after he is indicted (I’ll believe it when I read it). If protesting at an abortion clinic or a shoving match between 2 men can result in 15-20 FBI agents showing up and banging on your door with guns drawn is allowed then Hunter should at least be tossed to the ground and shackled behind his back. Maybe get a little bit of the view those unimportant little people not named Biden get to see if they are dealing with the FBI.

    The corruption at DOJ is yet another break with the rule of law, yet another support structure in collapse.

So, the issues will be some irregularity on a gun application and a tax issue JUST involving Hunter. The controversy prompted the newspaper to request statistics from the Justice Department to determine whether someone falsely filling out the form face much a risk of prosecution. The answer? They don’t. The statistics are relevant as Congress discusses how to strengthen gun laws after high-profile mass shootings.     Lying on the form is a felony punishable by up to 10 years in prison. For being a user of unlawful drugs in possession of a firearm, the punishment is up to five years. The odds of being charged for lying on the form are virtually nonexistent. In the 2019 fiscal year, when Hunter Biden purchased his gun, federal prosecutors received 478 referrals for lying on Form 4473 — and filed just 298 cases. The numbers were roughly similar for fiscal 2020. At issue is when Biden answered “no” on the question that asks about unlawful drug use and addiction when purchasing a gun. Biden had been discharged five years earlier from the Navy Reserve for drug use and based on his 2021 memoir, he was actively using crack cocaine in the year he bought the gun. The data do not show how many people might have been prosecuted for falsely answering the question about active drug use. A 1990 Justice Department study noted how difficult it was to bring cases against people who falsely answer questions on the form, especially because there is no paper trail for drug abusers like there is for felons.”

What Svelaz leaves out is the result of the prosecutions and what penalties were proscribed. He tries again to downplay the seriousness of crime without telling us the sentences that were meted out to those convicted. I am sure that those who are sitting in jail for such crimes do not share Svelaz’s no big deal sentiment. He knows this.

    Had this been anyone of us, we would of already been arrested, charged and convicted.
    Yet Hunter Biden remains free.
    This is a gross display of a two tiered justice system. It is a gross display of the corruption of the Garland DOJ.

The worst of all is the Big Lie, something he KNOWS is a lie, but his massive ego won’t allow him to admit he lost an election after leaving the United States in shambles and being predicted by every single poll to lose. He continues to divide this country with his Big Lie, which has been disproven by dozens of audits, recounts, forensic audits and other investigations. Trump LIED on financial disclosure forms and tax records, to continue borrowing money and to evade taxes and all of this is being investigated. Yet, you, Upstate Farmer, somehow think that Hunter Biden’s misrepresention on a gun permit application constitutes a “gross display of a two-tiered justice system…..and..a gross display of corruption of the Garland DOJ.”? Hunter Biden isn’t the President.

        As I have stated many times on this blog, I am a registered Independent.
        I did not vote for Trump in 2016 or 2020.
        I donated monies to Tulsi Gabbard, twice. I was going to a third time, but she dropped out of the race.
        If she would run as a Independent in 2024 I would even consider volunteering for her campaign.
        Trump is not president.
        Nor is Hunter Biden.
        But the double standard is in fact on gross display of a two tiered justice system.
        And that is not some simple misrepresention on ATF form 4473.

        1. What “double standard”? What crimes did Hunter Biden allegedly commit? When and where? Hunter Biden isn’t the President. Trump was, and his tax and financial lies are catching up to him, as is the fallout from the insurrection he started with his lies. His disciples fell for the Big Lie and many have been convicted of crimes, including felonies, at his instigation.

            1. What’s amazing to me is the literal consistency among you Trump disciples. You cannot come up with any response to my post about Trump’s endless lying, the repeatedly disproven Big Lie, the insurrection he started to try to stay in power after getting rejected by the majority of Americans, and his continued efforts to divide Americans against each other–so, what do you do? Attack me. According to you, I am either a “paid troll” or mentally ill. But, you can’t explain why–what have I said that isn’t the truth? Hunter Biden isn’t the President, and so what if he misrepresented facts on a gun application–how does this implicate his father? At least he tried to get a permit instead of carrying illegally. This is hardly comparable to Trump’s disciples attacking the Capitol Police, storing a cache of weapons in a Virginia hotel room across the Potomac waiting for Trump to lead them into the Capitol to stop Biden’s victory from being certified, and plotting the invasion before Jan 6th–all to try to defeat the will of the American people.

              Then, there’s Hunter’s “tax problems”–again, how does this make Joe Biden corrupt or me crazy or a paid troll to point out that Trump has a decades-long history of cheating on his taxes and financial forms? Turley cannot point to any proof that Joe Biden committed any crimes, and his employer flat out claims that there is a “Biden crime family” all without anything resembling proof. Influence peddling is alleged, but that’s not illegal.

              I don’t obsess over Trump–you people do. He has done everything possible to dominate the nightly news, unlike every other predecessor in office who has lost, and who concedes gracefully. Each previous president has attended their successor’s inauguration, they host the traditional White House luncheon, they welcome the new First Family into the White House and express the wish for a successful presidency. The reason behind this is to show American values and solidarity, despite personal feelings–because the American presidency is bigger than the individual, and Americans have the right to decide who our leader will be. All previous office holders respect the will of the American people and their choice of leader. Until Trump, that is. Instead of rising to the occasion, he gives in to his narcissism–he was rejected, and he cannot accept being a loser, even though this was predicted and he was told he had lost by everyone in his orbit except Giuliani. Even though he has not declared candidacy, and therefore can spend donations however he wants, Trump fundraises over his crimes, including stealing classified documents, portraying himself as a victim. All he had to do was leave the papers behind like he was told to do by at least two attorneys. He was given multiple chances to return them–but instead, chose a few and then lied about having returned the rest of them. He even admitted one reason: free publicity. How does pointing out these actual facts make me either crazy or on someone’s payroll? In my opinion, ignoring these truths and believing endless lies is a bigger sign of mental problems, and/or being paid.

          2. A few critical questions are, did Hunter ever act as a , nominee, for the financial interests of, others , in any of his businesses ? Did Hunter ever pay the bills of his dad or other family members from his income and was this expected? Did Hunter ever introduce Tony Bobulinski to his dad ? Those are the relevant questions, these other issues are just noise.
