For years, we have discussed the alarming shift in the Democratic party on free speech with candidates running on pledges to censor opposing views and politicians supporting blacklisting and censorship on social media. Many citizens oppose such efforts to restrict their rights under the First Amendment, but are unaware of the work of their representatives to limit free speech. Now, a filing in the Supreme Court supporting censorship efforts by the Biden Administration has supplied a handy list of the anti-free speech states for citizens.
The 5th Circuit previously ruled in Missouri v. Biden that administration officials “likely violated” the First Amendment and issued a preliminary injunction banning the government from communicating with social media companies to limit speech.
Not surprisingly, the state of California is leading the effort to get the Supreme Court to reverse a decision enjoining the government from censorship efforts. California has long sought to impose speech limits on doctors, businesses, and citizens to silence opposing viewpoints.
However, 23 Democrat-led states joined this ignoble effort in signing on to the brief of California Attorney General Rob Bonta. The brief lauds past efforts of these states to combat “harmful content” on the Internet and to protect the public from “misleading information” through partnerships with social media companies.
So here is the list to see if you are residing in an anti-free speech state:

Jonathan: When it comes to “free speech” Elon Musk and DJT are having a hard time convincing the courts their First Amendment rights are unlimited.
Last year, California Gov. Newsom signed a new law requiring social media companies to disclose their content-moderation policies. Musk sued claiming the law violated his First Amendment rights. Yesterday, US District Judge William Shubb rejected Musk’s claim saying: “While the reporting does appear to place a substantial compliance burden on social media companies, it does not appear that the requirement is unjustified or unduly burdensome within the context of the First Amendment law”. Musk is upset because he no longer has a content moderation unit nor does he moderate anything on “X”. It’s a free-for-all for all sorts of neo-Nazi propaganda, anti-Semitism and other hate speech.
Then, in DJT’s second defamation lawsuit brought by E. Jean Carroll he claimed he had a First Amendment right to defame Carroll. “Free speech” is no defense to defamation. Now, the US court of Appeals (2nd Circuit) just denied DJT’s request for a 90 day delay in the Carroll case while he appealed his criminal immunity claim to SCOTUS. This ruling came just two weeks after the same court ruled DJT could not assert presidential immunity as a defense in the Carroll case.

Jonathan: Nikki Haley has a lot to explain. In a campaign stop in New Hampshire this week she was asked what she believed the Civil War was about. This was her response: “I think the cause of the Civil War was basically how government was going to run, the freedoms and what people could and couldn’t do”. When the questioner asked why she didn’t mention slavery Haley asked: “What do you want me to say about slavery?”
The next day, reeling from criticism, Haley tried to repair the damage, admitting slavery was the cause of the Civil War. Now in a further attempt at damage control and an effort to appeal to MAGA voters, Haley says she will pardon DJT if elected she is elected president. No amount of flip-flopping is going to repair the damage to her campaign to be the alternative to DJT.
Now we have the former governor of South Carolina and GOP candidate next year refusing to forthrightly say slavery was the root cause of the Civil War–the right of S. Carolina slaveholders to beat, rape and kill people because they were “property”. Haley couldn’t express that simple truth because she was afraid it would alienate the MAGA base of the GOP. That’s the state of the GOP these days!
I don’t understand why anyone thinks Trump supporters would hesitate to recognise that the Civil War was about slavery. The south seceded because they feared Lincoln would prevent its expansion and perhaps intervene where it already existed. The US then fought to preserve the Union and in the course of the war came to free slaves in the Confederacy, and then throughout the country through the 13th Amendment and Treaties with the Indian Tribes thereafter (the tribes were the last to hold slaves in the US, because the 13th Amendment did not reach them). As DeSantis just stated, ending slavery was a great achievement of the Republican Party, opposed to the bitter end by the Democrats.
Only someone who believes MAGA supporters are racist white supremacists who favour slavery could think they would be put off by acknowledging these obvious historical facts.

No one can say with certainty what is the “root cause” of any historical event. Try reading about the “root cause” of the Fall of the Roman Empire. I would remind you and other proponents of your root cause argument that the majority of Southerners did not own slaves. Anti-slavery propaganda probably did alienate even non-slave owners, but that is a story of the effect of constant denunciation, not of slavery itself.
The root cause was secession.
The root cause, secession, was not prohibited and fully constitutional.
The root cause was insurrection, martial law, and a government takeover by “Crazy Abe” Lincoln.
Reprehensible slavery must have been abrogated legislatively and the freed slaves compassionately repatriated, as is the desire of all long-suffering abductees.

Keep up the good fight. I noticed that the amicus brief kept referring to the innocuous sounding “information sharing and dialog”. This phraseology masks the real intent – not to inform (for the States can all freely participate in the information game) but to get the social media companies to censor content. I think that what has transpired with the emergence of social media as the dominant form of information surpassing that of established news companies is that there is now, for much of the content, no independent editor for much of the content. Gutenberg’s movable type revolutionized the information world but there was still gateways to get published and distributed. Now, there are potentially no barriers to publication and world wide distribution. A frightening vision for those who “know” what everyone else should know.
BTW, you list Washington as one of the states but the Amicus brief does not list Washington State as a cosigner. Is there some other explanation? Perhaps Washington State came late to the party?

The Amicus Brief by the listed states focuses on four areas of concern: public safety (mass shootings), mental health issues involving minors, Covid misinformation and election integrity. In all these areas the Brief states: “Information-sharing and dialogue have not been coercive, but rather, helpful in ensuring that social media companies make informed about their own content moderation policies”. By definition “information sharing and dialogue” does not amount to censorship. Under TBM (Twitter Before Musk) there was no evidence the FBI compelled the company to censor anyone.
I have some personal experience on the subject of how minors are affected by what they see on social media. When my 3 granddaughters were minors (about 12 to 15) they were on the i-phones and laptops almost 24/7. Their parents tried to review the content they were watching but found it an almost impossible task. I remember them telling us the 15 yr old was deluged with invitations to “meet and talk” by pedophile predators–even being exposed to child porn. It got to a point where my granddaughter was experiencing some mental health issues and had to be treated by a psychologist. We would have welcomed some content moderation–protecting “minors against online predators and inappropriate content” (p. 7 of the Amicus Brief).
But you seem to think “free speech” demands that even minors have a right to view whatever they want. You can’t be serious?!
So we all should suffer censorship so your kids can have phones? BTW, iphones have very strict content moderation capabilities. Learn how to use it and spare us the sob story.

Yup, that is a fact, and it’s built in, and there are plenty of apps to further administrate what is on kids’ devices. Ditto for other devices, and it has been that way since virtually the dawn of the www. If parents could be bothered to learn about technology in relation to their children, this would not be a conversation. it was not great parenting to sit a kid in front of the tv in the past, but modern parents do not seem to understand precisely what they are exposing their kids to with devices, and the effects can be positively shocking. Here’s a bright idea: do not give your kid a device until they are emotionally and cognitively able to make sense of it and be reasonably responsible. It kills me every time I see a 2-8 year-old fondling a slab of glass and plastic. That kid is already at a disadvantage, a severe one.

But that is rare as I usually can get the gist just by using some critical thinking, logic and common sense.
Dennis – The supreme court has long held that pornography can be censored. But what is troubling is use of the phrase “inappropriate conduct.” That phrase is so vague that it could, and probably would, be used to silence critics if the 2020 election rigging or the numerous COVID lies from Fauci and others.

The question is how best to deter purveyors of intentionally deceitful infowarfare (e.g. the Antony Blinken-Mike Morell whopper suggesting Hunter’s laptop was Russian hacking, and Hillary’s Russiagate hoax).

This was while her hands were restrained up behind her back and she was being dragged away unable to even shield her face from their blows.
The security did nothing to protect her from the kicks and blows from these demons from the bowels of hell, and Trump grinned and cheered as they did.
So don’t tell me the republicans or Trump or his supporters are bastions of free speech. Don’t pretend for two seconds that if Trump gets in he’ll remove any of the censorship powers the democrats are circumventing the constitution to grant themselves. He won’t be any more a champion of free speech than they are.
The only difference the republicans will bring is “what speech” gets censored. They’ll censor speech they don’t like, just like the democrats are censoring speech they don’t like.
The only candidates out there right now who have a prayer for restoring free speech protections are RFK and maybe Vivek Ramaswamy.
