There is an interesting criminal and torts case out of Georgia. Roger Stephens, 61, is accused of slapping a 2-year-old child across the face when she would not stop crying. That is bad enough, but the child was not his.

Bank of America may have given out money like a drunken sailor before the federal bailout, but it held the line with Steve Valdez. The bank refused to allow Valdez to cash a check after he stubbornly refused to give them his thumbprint to confirm his identification. His feeble excuse is that he has no arms, let alone thumbs.
Former Miss California Carrie Prejean, 22, has sued Miss California USA for libel, public disclosure of private facts, religious discrimination, intentional infliction of emotional distress, and negligent infliction of emotional distress stemming from the controversy over her position on gay marriage. She was stripped of her title earlier this year, but the officials insist it was due to her breaking her contract and failing to perform her duties as Miss California, including the missing of appearances. The complaint also named Miss California USA officials Keith Lewis and Shanna Moakler and publicist Roger Neal.

Attorney Dimitrios Biller was the former managing counsel for Toyota Motor Sales USA and handled rollover cases for the company. He has now done a rollover of his own — accusing the car manufacturer of destroying evidence of rollover in a “ruthless conspiracy” to hide dangers.
The Dutch royal family of Crown Prince Willem-Alexander has prevailed in its suit against the Associated Press for taking pictures of them on vacation in Argentina. In Italy, Prime Minister Silvio Berlusconi is suing the media for the coverage of his private life. Both cases turn on the right to privacy of public officials and public figures.

California Deputy Attorney General Ellyn Levinson has lost her personal injury case against a rancher who allowed her to ride one of his horses as a party. A California court ruled that falling off the horse was Levinson’s own fault and not that of the owner.

The Dolphin did it. That is likely to be the defense of the Brookfield Zoo near Chicago, which is being sued for the 2008 fall of Allecyn Edwards. Edwards fell while walking near the exhibit of Atlantic bottlenose dolphins.

Stamford Marriott Hotel and Spa has allowed its attorneys to aggressively pursue a mother of two children who was pulled into her van and raped in front of her children in a Marriott hotel. Marriott now asserts that the 40-year-old mother was responsible in the attack, failed to “mitigate their damages,” and has sought discovery from friends and neighbors. The move led to a predictable backlash among the public.

Anna Ramirez has a right to be a bit peeved. Recently, her family (including her husband, daughter and grand children) was thrown on the street with little warning and her house auctioned off at a fraction of what she paid for it. It turns out that foreclosure was a mistake the clerk’s office and sheriffs were sent to kick out Ramirez and throw her things and family into the street.

A prosecutor has announced that he will not be criminally charged. The managing partner of the San Francisco was taking the painkiller OxyContin under a doctor-proscribed regime, but insists that he was not impaired.

Audra Harmon, 38, has sued the Onondaga County (N.Y.) Sheriff’s Department in yet another abusive use of a taser without provocation. In this video, the officer yanks Harmon out of the car in order to taser her. What is fascinating is that the officer, Deputy Sean Andrews, could have cuffed her but repeatedly positions her to be tasered.
In Chicago, Jessica Voth has filed a torts case against her former boyfriend Miles Marsh after he allegedly posted “intimate and personal pictures” of her on a website called exgfpics — or “exgirlfriend pictures.” The site itself appears to cater to such hostile and juvenile acts of ex-boyfriends. However, the site is not being sued and has protections under federal law.
