Romanian Thieves May Have Burned Seven Masterpieces As Police Closed In

130717-romanian-museum-hmed1-330p.380220px-Large_bonfireThere is an interesting forensic challenge in a Romanian criminal case as well as an unspeakable destruction of art by a band of thieves.  Police have found a furnace with ashes containing paint, nails, and canvas that a mother says is the remains of seven multimillion-dollar paintings — including a Matisse, a Picasso and a Monet. She says that the paintings were destroyed as police started asking questions about the gang of thieves from a museum, including her son.

Carter: The United States Has No Functioning Democracy

carterWe have been discussing the collapse of the American civil liberties movement and the attacks on the free press and privacy under the Obama Administration. As discussed in prior columns, we continue to refer to the United States as the “land of the free” despite a comprehensive reduction of civil liberties and due process in this country. The Snowden affair has put that record in sharp relief as the White House and Congress has joined together in barring the prosecution of perjury by high ranking officials and pursuing Snowden with close to unhinged rage. As previously discussed, our governing class has created a new American Animal farm. Long ago, American politicians adopted a type of dismissive paternalism toward the public as shepherds to so many sheep. Then one sheep goes and spooks the flock. The response has been bipartisan rage that has included demands to cut off aid to entire nations if they grant sanctuary to this whistleblower and even boycott the Olympics. The shepherds want Snowden made into mutton for stampeding the flock and no measure appears too extreme. Now Jimmy Carter has entered the fray and said what many citizens are saying in denouncing our duopoly. Carter told Spiegel “America has no functioning democracy.” Of course, you have to live in Germany to read such views.

Florida Mother Allegedly Tells Police They Would Have To Shoot Through Her Baby And Then Throws Baby At Officer

images-1If you thought that Brittany Harris was the worst mother of the year, you have not met Ashley Taylor Wright. Wright, 32, first shoplifted, then told the police to shoot through her baby to get to her, and then threw the baby as an officer to try to escape. What is fascinating about this story is that her escape will likely result in far more serious charges than her shoplifting.

Florida Mom Arrested After Leaving Kids In Car During Lil Wayne Concert

r-BRITTANY-NICOLE-HARRIS-large570220px-Lil_Wayne_in_ConcertBrittany Harris, 25, is the latest parent to be arrested for going to a concert or casino and leaving kids in the car. In this case, Harris went to a Lil Wayne rap concert and left her two children — ages 3 and 5 — in a parking lot with hundreds of strangers milling about, including a large number of drunken people.

Oregon Man Killed 5-Year-Old Girl and Wounds Another After Allegedly Using Assault Weapon As A Crutch

Meyer is responsible for shooting a little girl with an assault rifle. His defense? He was using the assault rifle as a crutch when it released a burst of fire into the ceiling and killed 5-year-old Alysa Bobbitt of Shady Cove and wounded apartment resident Karen Hancock.

Twitter Caves To Demand Of French Jewish Students To Reveal Identifies Of Posters

150px-Twitter_2012_logoIn a disappointing concession by Twitter, the company has  agreed to hand over the details of people who post racist and anti-Semitic abuse anonymously on its site.  We previously discussed the effort of Jewish students to strip anonymity from posters and punish people for using language that they consider anti-Semitic.  It is in my view another major attack on free speech — part of a worldwide reduction of free speech rights.

Former Alabama High School Teacher Avoids Criminal Charges By Marrying Former Student

51de238566e2a.preview-300mug-shot-93230571Kimberly Dawn Bynum, 31, has found not just love but a criminal defense according to her lawyers. Bynum was facing charges of having a sexual relations with a former student from November 2011. The student was 17 at the time. However, her counsel recently told the court that she had married the student and was now living outside the country. The charges were promptly dropped.

College Student In India Gang Raped And Set On Fire . . . Police Blame Victim And Refuse To Register Charges

India flagIndia continues to experience an epidemic of rape — and a continued alleged passivity of the police in dealing with rapes.  The latest case occurred in Uttar Pradesh Chief Minister Akhilesh Yadav’s home district Etawah where a 20-year-od college student was allegedly gang raped and then lit on fire by her rapists.  The men came from a wealthy area of the district and the police refused to register the charges according to her family.

Wounded Soldier Writes Letter About Pain And Being Forced To Commit War Crimes In Iraq . . . Then Commits Suicide

article-2346882-1A77BC63000005DC-561_634x472Daniel Somers was a veteran of Operation Iraqi Freedom and served with Task Force Lightning, an intelligence unit. He ran more than 400 combat missions as a machine gunner in the turret of a Humvee and interviewed Iraqis and insurgents alike. When he returned, he had PTSD as well as traumatic brain injury and several other war-related conditions. On June 10, 2013, he wrote the letter below to his family. A heartfelt and heart-breaking account of pain and memories that he could not overcome. He tells his family that “I was made to participate in things, the enormity of which is hard to describe. War crimes, crimes against humanity.” You may have seen this but if not it is worth reading. It is worth considering the unfathomable cost of these wars that our politicians, including Obama, allowed to continue for years despite little sign of progress. Men and women like Daniel have paid the cost of a cynical political calculation.

A recent United State Supreme Court decision has made it almost impossible for small businesses and individuals to bring class action lawsuits against large corporations who may be in violation of antitrust laws. Not only did the case fly under the mass media radar, it also may allow corporations to use contractual language to insulate them from many other federal laws.  I am talking about the American Express v. Italian Colors case that was decided by a 5-3 margin.  What the Supreme Court majority did here was to allow American Express to force its small business customers to sign a contract that included language that precluded those same customers from having any viable access to judicial review of American Express’ business practices. Morsi, Democracy and Problem with Fundamentalist Politics

Muslim_Brotherhood_LogoWhile I‘ve been trying to take a break from all politics and news as I bask in the glow of my family staying with me this week, I’ve nonetheless been fascinated by the fall of Egyptian President Morsi, in what must be described as a military coup. I’ve never been a fan of coups as I expect is true of most of us, yet the fall of Morsi has raises issues that I think are far more nuanced than appear on the surface. The salient facts are that after too many years the corruption of the government of Hosni Mubarak (who had been installed by the Egyptian military) led to severe economic issues and dissatisfaction with totalitarian rule. This then led to such massive protest that the military felt compelled, or justified to remove him. Mubarak’s removal was cheered, but then the clamor for free elections arose and after 18 months of martial law elections were held, as the first step towards transitioning to democracy and formulating a constitution.

The Society of Muslim Brothers, or Muslim Brotherhood was:“Founded in Egypt in 1928as a Pan-Islamic, religious, political, and social movement by the Islamic scholar and schoolteacher Hassan al-Banna,” It’s stated purposes was to: “to instill the Qur’an and Sunnah as the “sole reference point for …ordering the life of the Muslim family, individual, community … and state. http://en.wikipedia.org/wiki/Muslim_Brotherhood In a country such as Egypt, with its’ long history of totalitarian rule, the concept of political parties was not strong. Through its 85 years history the Brotherhood became the most stable opposition faction in the Egyptian political scene and was the main focus for opposition to whoever ruled Egypt by dint of the Egyptian Military’s backing. Such has been the success of the Muslim Brotherhood that it has branched out to have a significant presence in 20 nations around the world, many without a Muslim majority, such as the Russian Federation, the Indian Subcontinent, Great Britain and the United States. Therefore when the Egyptian Revolution of 2011 took place, the now legal “Brotherhood” was in an excellent position to vie for political power and formed the “Freedom and Justice Party” as its electoral arm. It won more than 40% of the parliamentary seats and its candidate Mohamed Morsi won election as President with 51.73% of the vote. His chief opponent had been a man who served as Mubarak’s Prime Minister. The Egyptian voters were faced, I think, with a “Hobson’s Choice” of Presidential candidates and chose what they perceived to be the lesser of two evils. As reporters were threatened with arrest and other controversies mounted, this scene unfolded in the gallery. According to reports, a 74-year-old woman was arrested for assaulting an officer after the Lt. Governor ordered the gallery to be closed. Troopers then encountered Martha Northington who did not move fast enough out of her chair. Greying of Prison Inmates: An Economic and Social Disaster in the Making

BoP sealThose who advocated for longer prison sentences failed to take the Law of Unintended Consequences into consideration.  We all know that prisons have become warehouses. There are several areas where the US leads the world. We lead all industrialized nations in infant deaths the first day of life. We lead the world in illegal drug use. In addition, we lead the world in number of people incarcerated.

The US prison population is about 2.3 million, more than any other nation. Those numbers come from a global study of prisons by the International Centre for Prison Studies, London.

China is a distant second, with 1.6 million people in prison, despite a population of 1.35 billion. (NOTE: That figure does not include political prisoners in administrative detention for “reeducation.”)

The unintended consequences are an aging prison population. Perhaps the for-profit prisons did not count on that glitch in their bottom line. However, prisons at both the state and Federal level are finding themselves running geriatric nursing homes.  In 2010, the last year for which we have accurate data, prisoners age 65 or over increased 94 times the rate of the total prison population in the three-year period 2007-2010.  During that same three-year period, the total US prison population grew 0.7%.

At the rate we are going, by the year 2030, estimates are that almost a half-million prisoners will be elderly.  Most prisons spend an absolute minimum on staffing and patient health.  Private prisons find the elderly cutting into their profit margin. Problems not anticipated for younger prisoners are cropping up.  What good does it do for a correctional officer to give orders to a prisoner with Alzheimer’s disease?  Prisons are not designed for accommodating walkers, wheelchairs and those who may have serious age-related illnesses.
