
Below is my column in the Hill on today’s final scheduled hearing of the J6 Committee. While the Committee can continue to schedule new hearings, the eighth hearing highlights the fact a compelling criminal case against President Donald Trump has still not been made. Despite the prior promises of the members, the hearings have largely amplified what was previously known rather than introduce new “smoking gun” evidence. Even in the absence of a single dissenting member, the Committee has not been able to make the long-promised criminal case.

The eighth and final scheduled hearing of the House Jan. 6 select committee is scheduled for Thursday, and its members reportedly will present a time line of events on that day, particularly the 187 minutes between the end of then-President Trump’s speech on the Ellipse and his call for supporters to leave the Capitol.
It will again replay moments from the horrific to the heroic. What it has not shown thus far, however, is what was promised at the outset: a clear criminal case against Trump.
At the start of the hearings, committee members promised they had the long-sought smoking-gun evidence — new material that would close the circle on Trump. Committee member Rep. Adam Schiff (D-Calif.) indicated he thought there was now “credible evidence” to support a variety of criminal charges. His colleague, Rep. Jamie Raskin (D-Md.), said the committee would show that Trump organized a “coup” on Jan. 6, 2021.
No sooner had the hearings begun when many in the media declared that the criminal case had been conclusively proven — even though most of what was being presented was already generally known.
It often sounded more like a prayer than proof.
Former Nixon counsel John Dean said an indictment would be forthcoming because “I don’t see how the line prosecutors at the Department of Justice can’t take a lot of this evidence and use it. … Trump is in trouble. Trump is in trouble.”
Harvard law professor Laurence Tribe said the question was only what would be charged first, since Trump’s felonies were shown “without any doubt, beyond a reasonable doubt, beyond any doubt, and the crimes are obvious.” That included an allegedly clear case of attempted murder of former Vice President Pence.
Yet, on the eve of the primetime hearing this week, committee members sound strikingly less prosecutorial. Rep. Elaine Luria (D-Va.) told CNN that “I look at it as a dereliction of duty. He didn’t act. He did not take action to stop the violence.”
It is difficult to make a criminal case over what an official failed to do. Yet the last hearing seemed to focus on a number of things that did not occur, from a draft tweet that was not sent to an executive order that was never signed. There were discussions of appointing Trump attorney Sidney Powell as a special counsel, seizing voting machines or replacing the Justice Department’s leadership. As unnerving as these proposals were, they also were not carried out.
It is the type of evidence used to show mens rea — “guilty mind.” However, crimes generally require both guilty minds and guilty acts. Building a criminal case on the failure to act to stop the violence is a notoriously difficult case to make. It has been raised in various contexts without success even when officials had direct law enforcement duties, as in Seattle with the CHOP zone in the summer of 2020. It is even more difficult when the House committee has blocked any serious investigation into the potentially contributing failure of Congress to take better precautions before the riot, another costly act of omission.
The committee has built a powerful case that no compelling evidence of widespread voter fraud existed in the 2020 presidential election, and that Trump knew (or should have known) he was asserting baseless allegations. White House strategy sessions became increasingly heated between Trump’s two teams of lawyers, including a breathtaking Dec. 18, 2020, meeting when two lawyers seemed close to a physical altercation. Clearly, Trump only heard what he wanted to hear — but that does not prove he knew the election was valid.
The committee has portrayed Trump’s reliance on a private legal team as knowingly dishonest by calling it “Team Crazy.” However, the committee also portrayed Trump as a raving egomaniac who could not accept that he lost the election to Joe Biden.
But, again, it is a difficult criminal case to make, based on a layperson believing one set of lawyers over another. Former prosecutor and former senator Heidi Heitkamp (D-N.D.) said of the hearings that “as a former prosecutor myself, everything that I’ve heard, I think it would be a very tough indictment to get.”
It is not even clear, after seven hearings, what crime we are discussing.
The conspiracy to insurrection claim of the second Trump impeachment has turned into accusations of obstruction of Congress, seditious conspiracy and conspiracy to defraud, or the dereliction of duty suggested by committee members like Rep. Luria.
Attorney General Merrick Garland clearly is looking for evidence of criminal conduct and could seek an indictment. If based on the committee’s evidence, however, it is a criminal case that would be ripe for reversal even if a conviction could be secured from a favorable District of Columbia jury.
Looking objectively at the evidence, the committee never supplied “credible” proof of crimes. That is not to say the evidence is not shocking; indeed, it is like a series of “jump scares” involving Trump and others raising unfounded or unconstitutional courses of conduct.
However, the most damning evidence concerns what Trump failed to do in those 187 minutes.
Trump has stressed that he told his supporters to go to the Capitol “peacefully” to support Republicans challenging the election. At 1:11 p.m., Trump concluded his speech. Around 2:10 p.m., people surged up the Capitol steps. At 4:17 p.m., Trump made his statement to stop — roughly an hour and a half later.
Many have denounced that delay, and some of us were critical of Trump’s speech as he was giving it or soon after it ended. His was a failure of leadership — but that does not mean it was a violation of the criminal code.
It is the type of evidence that should have been gathered before the second impeachment, to make a case for conviction in the Senate. Instead, House Speaker Nancy Pelosi (D-Calif.) and others opted for a “snap impeachment,” holding a single hearing. Today, they seem to be building the case I recommended in 2021 — just 19 months too late.
Trump still could face charges in Georgia over efforts to force a recount there and pressuring state officials to “find” the needed votes. However, the committee spent much of its time with Georgia witnesses in showing how they were hounded by Trump supporters and publicly mistreated by Trump. That again is outrageous and reckless, but not necessarily criminal. A Georgia case could also bog down on the question of Trump’s intent and knowledge in pushing election fraud claims.
The Jan. 6 committee has made a case against Trump personally and politically. It has not done so criminally. This final scheduled hearing would be an excellent time for that promised case to be finally made.

And Trump just called, Wisconsin State Assembly Speaker, Robin Vos begging him to somehow try to find a way to decertify the EC vote given to Biden. I suspect that Trump is correct about the voting shenanagans. However, his lack of discipline and preparation before the 2020 election is what cost him. But if I were the Dems, I’d be really careful what I asked for — if Trump doesn’t run, DeSantis is the likely candidate to run against Joe, Kamala or someone even less qualified. DeSantis is politically smarter/more experienced, younger and more disciplined than Trump. He’s done a great job here in Florida (where we moved from the NYC area a year ago), and he fights back effectively when attacked.
Trump did a lot of terrific things despite being almost alone in D.C. But he’ll be 78, and I think Joe’s decline will scare a lot of Republicans into wanting a younger candidate.

We don’t know the complete testimony for Cipollone or, for that matter, the complete testimony of **any** of witnesses that have testified before the committee. This is because the witness testimonies are sealed and the witnesses are under gag orders not to speak about their testimony.
All that is known is the select ‘tidbits’ of testimony released by the committee. This is done either through snippets of video testimony offered without context or through highly scripted in-person testimony.
Back to the topic at hand, the committee recalled Cipollone to, among other things, clarify Hutchinson’s testimony. What do we have to show for this effort?
The committee released the statement that Cipollone’s testimony “did not contradict” Hutchinson’s testimony…yeah, that is it. I guarantee you that had Cipollone testified that Trump tried to commandeer the Presidential vehicle that this would have been plastered all over the news in video and in transcripts.
Instead we have the statement “did not contradict”. Only an idiot would believe what is coming out of the J6 committee.

JT, the largest affront to the Constitutional transfer of Presidential power involved some obvious lawbreaking.

The plot, it’s intent (a 2nd term for Trump), and the means (impeding the EC Count Certification at the Joint Session of Congress), and the main plotters are all laid out in the ringleader’s speech.
All you need in a trial is to call Mike Pence to the witness stand. And play the video of the Stop the Steal speech with the above sentences.

At the core of your thesis is that false claim that “Stopping” – thwarting, taking every constitutional and legal action possible to overturn an election is a crime.

Right when it looks like Jonathan Turkey is on track he has a grand mal seizure. What exactly is the evidence he claims proves there was no wide spread fraud during the 2020 election. When I was raised the rules were such that if the police had a warrant to search your house for evidence of a crime and you refused and even destroyed evidence. That was compelling evidence in criminal court and a flat out admission of guilt in civil court. This has happened with both Clintons, the first was funny as Clinton’s lawyer tried to eat evidence. It happened again in Gen Flynn’s case. The Muller team destroyed cell phone data. The IRS destroyed data under Obama,the FBI just did it again. And I’ve only been casually keeping track, there are probably another 20 or more. Oh an least we forget Dr Mengale allowed the genetic data on the Communist China Wuhan Virus to be erased as well as the medical data from the military Olympics personnel from Oct 2019.
Where is the evidence? All 50 Secretaries of State certified their votes, and 26 of them were Republicans. There were dozens of audits, recounts, forensic audits, all of which turned up nothting. There were over 60 lawsuits, dismissed for lack of evidence. Giuliani had his law license suspended because an investigation proved he just made up lies about nonexistent fraud. There is a white paper produced by a group of CONSERVATIVE REPUBLICANS who investigated, independently, each of Trump’s claims of fraud, and found they are bogus. Look it up: “Lost Not Stolen”.
Where is the proof that there WAS widespread voter fraud? There is none. All you have is the word of a pathological liar with a massive ego who was hungry for power. Trump was predicted by every single poll to lose in 2020, and he DID lose. He KNOWS he lost. The DOJ investigated, and according to Bill Barr, found NO evidence of widespread voter fraud. Trump began lying about his vainglorious “landslide victory” being “stolen” before election day because all polls showed that Americans were sick of him.

Trump, a non-politician, made some mistakes but his heart was always in the right place. Americans are very forgiving if they see you as patriotic, honest, and loyal. They forgave Bill Clinton whose actions were far worse than anything that Trump was ever accused of doing in office. What Ameicans do not forgive is dishonesty, the hallmark of the current POTUS and his family members.

At 2:10 p.m. the doors and windows were breached. At 2:38 p.m. Trump urges people to “support our Capitol police and law enforcement,” and tweets that “they are truly on the side of our country. Stay peaceful!”

The “norms” of debate, open, civil discussion on college campuses has been replaced with progressive “norms” of heckling veto, silence is violence, intolerance of any other point of view than the progressive one. Declaring someone or group is a threat to a person based on their religious belief. Professors being punished for even asking for a debate of a given topic. Others being forced out or quitting due to a hostile environment.
The progressive “norms” of higher gas prices is a good thing to promote the green energy policy, as it crushes not only on the lower economic class, but is hurting the middle class (recent poll show those in the middle class are falling behind in the in the inflation driven cost of living increases).

Trump promised to defend against not only foreign enemies to the U.S. Constitution but to defend against “domestic enemies” to the U.S. Constitution.
More than 60 federal judges (including Trump appointed judges) ruled that Biden was the legitimate winner of the election. Even with this knowledge, Trump continued to subvert the constitutional rule of law.
With this knowledge, knowing he lost, he then tried to coerce a Republican election official to “find” votes with no evidence of voter fraud. This is worst than law breaking, Trump’s loyalty oath is to defend the U.S. Constitution. Does anyone think Trump was loyal to the United States?

Trump committed no crime. That’s why there is no case.
There is no evidence whatsoever that he conspired with the Oath Keepers or Proud Boys to invade the Capitol. He tried but failed to persuade Pence to send the elector certifications back to the states. He did not try to use the military to stop the proceedings. The words he used in his speech on Jan 6 and in prior tweets were not criminal incitement. He exhibited poor judgement for sure, but that is not a crime.
The Committee is politics and nothing more.
Life is not the movies. A coup is *any* attempted take over of government. Saying it’s not a coup just because gunships were not flying in the air. Tanks not rolling down the streets. Soldiers kicking in doors. That’s a Hollywood coup. An attempt to subvert the will of the people by manufacturing false doubt of the electoral count in order to depend on your political buddies to certify the count the way you want it to go is just as much a take over of government.

Maybe Trump was reacting on his experience with the Democratic Party and the Justice Dept trying to stage their coup in 2016-2017. If you are innocent of a crime and know you are innocent of the crime but an organized group still tries to pin that crime on you and stage a coup, would you not suppose that in the next election that group would try to stage the same thing but from a different angle. I don’t support anything Trump did after the 2020 election but I can see how he would interpret the voting in several key sates as significant proof that the same people were after him that were trying to remove him in 2016-2017 and then staged another attempt with the first impeachment. Even a very rational person living outside DC would wonder greatly. And then you have a media that consistently lied about “evidence” of collusion even after the Muller team published it’s report. It’s like Muller’s report never occurred. It would be enough to drive a sane man paranoid. And there are very few people in D.C. that I would clinically diagnose as sane.

This may be a huge First Amendment case that affects Americans for decades. The First Amendment was designed as a legal “restraint” against unconstitutional government practices. Essentially to protect citizens against Executive Branch officials.
In this scenario, Trump is the head of the federal Executive Branch and Commander-In-Chief – the precise official to be “restrained” by the First Amendment protecting citizen speech.
Trump supporters seem to have it exactly backwards. They view the First Amendment as protecting the government (Commander In Chief) from the same government.
Really think about this, the Commander In Chief urging citizens to subvert the U.S. Constitution. Trump urging the military and Secret Service to subvert their own constitutional Oath of Office. Does the First Amendment protect the head of the Executive Branch from itself? This constitutional argument should be removed from the equation.
It seems to me that they ought to focus on the “impeachment” and the Jan 6 committee which are preventing the former president from having a true defense. In both cases, Pelosi et al abrograted their responsibility to a fair hearing, insuring that Trump would be convicted without an opportunity to defend his actions. The presentation of choreographed evidence in these televised “made for TV” hearings is obscene.

So, Trump could be indicted in Georgia for asking “find the votes”. In Washington State we had a election for governor 20 years or so ago in which the Democrat (really) said during the second recount, in which she was still losing, “we have to keep counting until we find the votes”! They did keep counting and they did “find the votes” even though some of the boxes of votes were “inadvertently found in the trunk of a car”, no chain of custody, but they were enough to put Christine Gregoire in the Democrat Governor’s Chair over Dino Rossi. The King County elections official left after that incident and became the head of elections for Los Angeles where he never “lost” an election, what a sterling record! Swamp Rats, all!

His case in Georgia that was the subject of the call alleged illegal votes well in excess of the margin of Biden’s victory. Under Georgia law, if illegal votes exceed the margin the election must be re-run. There is no need to show fraud.
It has since been shown that Trump was right. The number of illegal votes by voters who moved counties more than 30 days before the election but voted in the counties they moved from exceeded the margin. These and other illegal votes are what Trump wanted found.

Apparently, you have forgotten everything but his name and the conviction. In reality, Manafort was indicted and convicted for crimes occuring 10 years before he met Trump and for which DOJ declined to prosecute. Good example.
