In a shocking development, a Jaffa military court has reportedly blocked the demotion of three Israeli soldiers for abusing two Palestinian detainees this year. While the prosecutors and defense had agred to a demotion to privates for the staff sergeants, the court found that such punishment was unwarranted and ordered that they only be demoted to sergeant after serving five and a half months for their crimes.

In New York, State Supreme Court Justice Sheila Abdus-Salaam called a recommended 90-day suspension of a teacher who attempted to seduce a student “irrational” and too lenient. A teacher at Staten Island’s New Dorp High School, Colleen McGraham, 39, repeatedly contacted the 15-year-old students who spurned her advances. Given this record, it is hard to see how 90 days is an adequate punishment when McGraham took steps to contact and pursue the boy.
Now, here’s a malpractice case for you. Doctors operated on a patient in Japan’s Asahi General Hospital to remove a large tumor in his stomach that was causing abdominal pain. Once inside, they discovered a greenish towel that was left in his stomach since 1983.

A New York mother, Tehmina Haque, has sued American Airlines for injuries suffered by her son when he came into contact with peanut oil on a flight due to the in-flight peanuts. Even though her son did not go into anaphylactic shock due to his severe allergy, she sued the airline for negligence. While this is not the strongest case due to the lack of a more tangible injury, it is not a frivolous issue. I remain shocked that airlines serve peanuts given the relatively high number of people (including many children) with potentially life-threatening reactions to the product.

A Tampa case may present an ideal context to review the long-criticized pornography test and the role of community standards in the Internet age. Paul F. Little, known as “Max Hardcore,” is facing an obscenity prosecution for selling porn on the Internet. The Bush Administration could have chosen any state in the Union, but engineered an indictment in Tampa — an open case of forum shopping for the most conservative jury pool that it could find. The Supreme Court has never produced a coherent and consistent approach to obscenity and this case is the result of this long-standing judicial failure. There is a very interesting controversy brewing in Orange County, Florida. A 13-year-old girl Alisha Dean has a MySpace page that portrays herself as a 19-year-old divorced woman. She has been accused about lying to two men — Morris Williams, 22, and Darwin Mills, 24, about her age in two separate incidents. Both have been convicted and sent to jail for statutory rape — regardless of whether the older looking girl deceived them. While her parents admit that they did not take down the MySpace page and that she still stays out late at night, her father insists that minors are not expected to have the same judgment as adults.

Parents across Minnesota this morning are searching for switches. The state supreme court has held that parents who spanked their son with a paddle did not commit a crime. The case began when Shawn Fraser decided to paddle his son Gerard for running away from home — using a wooden paddle 36 times on the boy. Gerard was then 12 and weighed 195 pounds. Both parties pledged to keep their supporters in line during the Democratic rules committee meeting on Saturday. However, after the committee agreed to seat all of the Michigan and Florida delegates with half of their votes, some Clinton supporters erupted in anger. I was invited to attend the meeting but had to decline due to litigation demands, but it appears to have been quite a scene. This video of Clinton supporter Harriet Christian’s rant against the “inadequate black man” indicates that the ongoing campaign is clearly hurting chances for November for the party. In the clip, APD Officer Daniel Guzman appears to pummel KOB-TV cameraman Rick Foley after telling him to move to a different location. Not only is Foley arrested without cause but $50,000 in camera equipment is reportedly ruined.

Two university professors have been caught up in an alleged insider trading conspiracy, including respected lecturer and retired St. John’s University professor, Dr. John F. Marshall. He is accused of giving Pace University Professor Alan L. Tucker insider information, resulting in Tucker making a cool $1.4 million on the tips in 2007. Dr. Marshall’s brother-in-law, Mark R. Larson is also accused of buying shares of I.S.E. stock based on the tips.
