“Confused and Distracted”: McCabe Uses Flynn Defense Against False Statement Allegation

McCabeFormer FBI deputy director Andrew McCabe penned an op-ed for The Washington Post to contest the allegation of his “lack of candor” with federal investigators.  I have been writing (here and here and here) on the contrast between the treatment of McCabe and former national security adviser Michael Flynn.  McCabe has been erroneously portrayed as “losing his pension” but has not been charged.  Flynn was charged and accepted a plea deal under 18 U.S.C. 1001 for making a false statement to investigators.  Now McCabe is raising virtually the same defense that did not work for Flynn: that there was a lot going on and he was “confused and distracted.”

“By The Book”: Wray Pushes Back Suggestions That Andrew McCabe Was Forced Out For Political Reasons

440px-Chris_Wray_official_photoWhile various networks have advanced narratives of former FBI Deputy Director Andrew McCabe being fired as part of a Trump bloodlust, FBI Director Christopher Wray weighed in this week to say that he acted without any political influence.  Wray, who has been widely credited as being completely independent and apolitical, supported the view that McCabe was fired for true cause.  Wray pushed McCabe out after reportedly reading the conclusions of the Inspector General’s report.

THE EXQUISITE CORPSE: HOW ANDREW MCCABE IS NOW PART OF THE BODY POLITIC

McCabeAt the turn of the last century, surrealists had a parlor game in Paris called “The Exquisite Corpse” where writers would create collective stories by writing lines without knowing what preceded them. The lines were often nonsensical like the line that gave the game its name: “Le cadavre exquis boira le vin nouveau. ” (“The exquisite corpse shall drink the new wine.”) With minutes of his firing, former FBI Deputy Director Andrew McCabe became such an exquisite corpse with various politicians adding lines to his story that seemed entirely disconnected to his story. Former FBI Director James Comey used McCabe to pitch his upcoming book while former Attorney General Eric Holder used him to effectively attack career staff at his former agency. The point of the game in both politics and literature is not to advance a coherent narrative but insert your own lines into a collective story.

WA Sex Offender Registration Requirements Can Cause Indefinite Opportunity For Imprisonment Of The Homeless

A recent case before the Washington Court of Appeals for Division I highlights what has as a direct result of an increasingly punitive legislation become a perilous trap for a homeless, mentally handicapped citizen–and by extension likely many more.

In February 1998, when he was 23 years old, Jayson Lee Boyd had sex with a 15 year old. On May 27, 1999, Boyd pleaded guilty to Rape of a Child in the Third degree. Boyd was sentenced on July 29, 1999. He has not committed a sex offense since his original conviction. Nevertheless, he is required to register as a sex offender under RCW 9A.44.130 and RCW 9A.44.140. Since his original conviction in 1999, Boyd has been convicted of failure to register as a sex offender three times, all in Skagit County.

Thus his station in life: Seemingly perpetual incarceration is his future.

Even Without Collusion, Serious Threats Remain For Trump In The Russian Investigation

440px-Director_Robert_S._Mueller-_III-1donald_trump_president-elect_portrait_croppedBelow is my column in USA Today looking at the array of threats still present for the Trump White House even if collusion fades as part of the Russian investigation.  There still could be evidence discovered or disclosed on collusion. However, after multiple indictments, pleas, and a year of investigation, we have not yet seen any credible criminal allegations linked to collusion.  As many on the blog know, I have long been skeptical about the real likelihood of a criminal case based on collusion or obstruction against President Donald Trump. However, even if collusion does recede as a threat, there remain significant areas of risk for the President.

Singular Demotion: Trump Tells Citizens “Ask Jeff Session!”

jeff_sessions_official_portraitYou know you are on the outs with the President when he not only unleashes an army of citizen trolls on you, but demotes you from plural to singular.   President Trump posted another controversial tweet this morning in asking why he is being investigated but not his predecessor or the Democrats. He tells supporters to Just “Ask Jeff Session.”  Attorney General Sessions appears to still be the persona non grata and, if anything, diminishing by the day.

House Intelligence Committee Releases Full Memo Alleging Serious Breaches By FBI In Russian Investigation

HouseofRepSealI will be discussing the memo today in a column in the Hill as well as in the segment with Tucker Carlson.   I fail to see the “grave” classified information that would put the national security at risk.  Indeed, my column addresses the disconnect between the objections made by the FBI and Democratic members and the actual memo. The use of classification laws to prevent disclosure of embarrassing information is itself an abuse of federal law and standards.

The Republicans may have undermined their case by building up this memo as a smoking gun document. Portrayals seems to make this memo the virtual combination of the Pentagon Papers and the Zimmerman telegram. After all of the build up, anything short of a depiction of Hillary Clinton forcing a judge to sign a secret warrant at gunpoint would disappoint most readers. However, there is plenty in this memo that should deeply concern people.

Civil libertarians have complained for years about the tactical use of classification authority by the federal agencies.  This seems a rare and important example of that problem. As to the specific factual representations, they raise clearly troubling questions that need to be addressed on the failure to disclosure information to the FISA court and the alleged heavy reliance on this dossier.

Report: Trump Asked Rosenstein If He Was On His “Team” Before His Testimony To Congress

Rod_Rosenstein_US_AttorneyThere is another disturbing report alleging that, despite all of the damage caused by President Donald Trump allegedly asking former FBI Director for a pledge of loyalty, he asked Deputy Attorney General Rod Rosenstein whether he was “on my team” before Rosenstein testified before Congress.  Notably, in the hearing, Rosenstein was asked  “Is it ever appropriate for a president of the United States to demand a Department of Justice official or FBI director to take a loyalty pledge?” He replied “I don’t have any opinion about that. Nobody has asked me to take a loyalty pledge other than the oath of office.”

“My Life Is Over”: Former Justice Department Prosecutor And Akin Gump Partner Pleads Guilty To Stealing Government Files

Jeffrey-WerkinUS-DeptOfJustice-Seal_svgJeffrey Wertkin seemingly had it all.  At 41, he was a partner at the powerhouse law firm of Akin Gump Strauss Hauer & Feld. He came to the firm after a successful career as a corporate fraud prosecutor.  He had one more thing, however, that his colleagues were not aware of.  He had the non-public files of sealed lawsuits by whistleblowers.  His intention was to use the pilfered files to sell his inside information and services to companies.  He is now likely going to jail.  When the undercover agent told him that he was under arrest, he simply said “My life is over.”

NYT: Trump Tried To Stop Sessions From Recusal

donald_trump_president-elect_portrait_croppedThe New York Times is reporting that Special counsel Robert Mueller has confirmed that  President Donald Trump took the extraordinary step of ordering White House counsel Don McGahn to Attorney general Jeff Sessions to prevent him from recusing himself in the Russian investigation.  I was one of the earliest voices calling for Sessions to recuse himself and continue to believe that he made the right decision not only for himself and the Justice Department but Trump.  The account in the Times states that Trump was irate at hearing that Sessions would follow the advice of his ethics advisors and recuse himself. He allegedly asked why he does not have an Eric Holder or Roy Cohen to protect his interests. If true, it was a grossly inappropriate decision and an even more worrisome analogy. I have been a long critic of Holder and his highly political tenure at the Justice Department.  As for Roy Cohen, he is one of the most reviled and disreputable figures in history.  It would be akin to a CEO asking where is his Bernie Madoff to protect profits.  The accounts is based on two sources that are anonymous and we have not heard from the President.  Obviously, McGahn could also deny the truth of the story but we have not heard from either McGahn or Trump’s personal counsel.

RES IPSA HITS 33,000,000

Audience_Frontier_FiestaWe have hit another milestone today with over 33,000,000 views. We are also expected to reach 35,000 followers on Twitter.  That hardly makes us competition for the largest sites but it is still an impressive collection of people seeking a place for civil but passionate discourse on legal and policy issues  of our time (and perhaps a few wacky stories).  We often use these milestones to look at the current profile of the blog and its supporters around the world.

As always, I want to offer special thanks for our weekend contributors: Mike Appleton, Larry Rafferty, Darren Smith, Kimberly Dienes, and Cara Gallagher (particularly Darren who continues help up with periodic technical problems etc).

I particularly want to thank our regular commentators and readers.  We try to keep this blog as an open forum with as little interference or monitoring of the comments as possible.  Given our free speech orientation, we try not to delete comments and, for that reason, we are deeply appreciative of how most people avoid personal or offensive comments in debating these issues.  We have had to delete a handful of comments with personal attacks or profanity but the number remains quite low for a blog of this size.  The success of this blog is due to the fact that we offer something more than the all-too-common troll-driven, angry, and insulting commentary of the Internet.  Thank you for voluntarily assuming restraint over the tenor and content of your comments. “REDEMPTION”: EO3 AND THE TRAVEL BAN 3.0 SEQUEL

images-1donald_trump_president-elect_portrait_croppedBelow is my column in the Hill Newspaper on third round of litigation over the immigration orders issued by President Donald Trump.  On Friday, in Honolulu, U.S. District Judge Derrick Watson converted the earlier temporary restraining order into a preliminary injunction.  With the two decisions in Hawaii and Maryland, the appeals should move on an expedited basis back to the Supreme Court (which is expected to dismiss the second immigration case from the second round of litigation this week).  Like T3, EO3 could be named “Redemption” as the Administration gears up for what is likely (and hopefully) the final round in this series.

Checking The Fact Checkers: The Washington Post Concludes Comey Likely Violated FBI Rules But Still Criticizes Sanders For Raising “Possible” Illegality

220px-Washington_Post_buildingBelow is a column that I wrote for the Hill Newspaper in response to a “fact checker” column by the Washington Post.  I have written for the Washington Post and have great respect for the publication.  Indeed, I have objected to the attacks by President Donald Trump on the Post and the New York Times which remain two of our premiere journalistic organizations. However, I was frankly floored by the column by Glenn Kessler in criticizing White House Press Secretary Sarah Huckabee Sanders.  I have discussed previously how there has been a palpable bias in reporting on the Trump Administration.  It is often that case that some journalists are not simply satisfied with disagreeing with the Administration. They sometimes take judgment calls or opinions and declare the Trump side to be simply factually incorrect.  This relieves the need for readers to address the opposing view of controversies like the alleged misconduct of former FBI director James Comey.  Those views are simply dismissed as untrue.  This is a prime example.
