If The TPP is Such a Great Idea, Why Keep it a Secret?

The Obama Administration has been pressuring members of Congress to pass the bill that will give President Obama the “fast track”  authority to negotiate the Trans-Pacific Partnership(TPP) agreement without any debate in Congress.  Fast track authority would not allow for any amendments and the bill would remain secret until just before it is voted on.

“President Obama is currently pressing members of Congress to pass Fast-Track authority for a trade and investment agreement called the Trans-Pacific Partnership (TPP). If Fast Track passes, it means that Congress must approve or deny the TPP with minimal debate and no amendments. Ohio Judge Reprimanded After Berating Jurors For Acquitting Criminal Defendant

Judge_Amy_Salerno_2005Judge Amy Salerno of Franklin County, Ohio has been reprimand for a serious breach of judicial ethics. Salerno lashed out at jurors after they acquitted a defendant and said that it was a “slam dunk” case. Salerno was ranked as the worst judge in the Columbus Bar Association survey in 2007, 2009, 2011, and 2013. She appears intent on continuing her ignoble distinction. We previously discussed the case.

Cutting the Great Outdoors of Wisconsin, Along With Everything Else!

A few weeks ago, I wrote about the massive cuts to education and programs for the poor by the new Governor of Illinois, Bruce Rauner. In that article, I mentioned that Gov. Rauner seemed to be parroting the budget methods of Governor Brownback in Kansas and Gov. Walker in Wisconsin, both of whose state economies have been floundering under their respective austerity programs.

Well, it seems that in Wisconsin, Gov. Scott Walker has gone even farther in his attempts to balance the budget on the backs of the middle class by proposing massive cuts to the Department of Natural Resources, while attempting to wrest control of  various agencies from the public domain and capturing them in the Executive branch of government. ArnoldKyle Arnold, 42, knows a thing or two about multitasking. Arnold was waiting to finalize his plea bargain for misdemeanor simple assault and reckless endangerment. He allegedly spotted the girlfriend of another defendant and decided to pose as an attorney and bilk her out of $1,300.

Will HSBC Be Too Big To Jail…Again?

British banking giant, HSBC reached an agreement in 2012 with the Department of Justice that kept it from being hauled in to court on criminal charges due to its systemic assistance in laundering money for drug cartels and allegedly terrorists.  HSBC, with its Hong Kong headquarters shown above, is now in trouble again for alleged problems prior to the settlement agreement in 2012.

“The US Department of Justice is considering bringing criminal charges against HSBC and its executives as part of its investigation into whether the bank’s Swiss subsidiary helped US clients evade taxes.

Democratic senator Elizabeth Warren called on prosecutors to “come down hard” on HSBC if the bank is found to have colluded with tax evaders on Tuesday.

Her intervention came as US government officials with knowledge of the DoJ’s investigation provided the Guardian with new details about the inquiry.

Renewed focus has been placed on the long-running investigation into HSBC Switzerland by the department, after a huge leak of secret bank data – passed to the DOJ’s tax division almost five years ago – was obtained by the Guardian and other media.

It shows that HSBC Switzerland helped some clients conceal millions of undeclared assets, and has immediately raised questions on Capitol Hill about the response from prosecutors and tax authorities.  US government officials said the investigation is not merely looking at HSBC’s US clients, and could also result in criminal indictments against the bank itself. “That has not been ruled out,” one official said, when asked if HSBC or its executives could be criminally indicted. “It is certainly something that is under consideration.” ‘ Reader Supported News  Continue reading “Will HSBC Be Too Big To Jail…Again?”

Legal Aid Organization Under Fire For Participation In Film With Cop-Killing Images and Lyrics

Screen Shot 2015-02-06 at 9.01.57 AMThere is a growing scandal in the Bronx that has led to the resignation of two legal aid attorneys (Ryan Napoli and Kumar Rao) and calls for the defunding of Bronx Defenders, an organization that represents over 35,000 indigent persons each year under a $20 million annual contract with the city. The controversy erupted after the release of the video below entitled “Hands Up” featuring a popular rap artist and noting sponsorship and participation by the Bronx Defenders. The video includes repeated images to two African-American men about to shoot a white police officer and lyrics call for the shooting of police officers.

New York Lawyer Pleads Guilty To Bilking Jewish Cemetery . . . After Taking Over From Couple Who Bilked The Same Cemetery

cemetery11n-1-webAttorney Timothy Griffin, 55, has been sentenced to a six-month prison stint in a pile up of criminal and unethical conduct, including the theft of $1.8 million from a non-profit Jewish cemetery. It turns out that he was not the first professional to victimize the cemetery.

Pittsburgh Public Defender Charged With Giving “Inaccurate Information” Before Client Fled and Then Committed Suicide

Andrew-CaponeThere is an interesting case out of Pittsburgh public defender Andrew Capone, 29, has been criminally charged for allegedly given inaccurate information to a judge’s staff about whether his client had appeared for trial in a sex assault case. The case is troubling because, based on what has been released, it is difficult to see where the line was drawn between criminal and noncriminal conduct for counsel.

Offensive Holding: Seahawks Move To Trademark The Word “Boom” and the Number 12

170px-Referees135px-Seattle_Seahawks_helmet_2012If the Seattle Seahawks are known for their aggressive offensive line, their players are nothing when compared to the aggression of their lawyers. Outdoing even the brutish NFL lawyers who claim copyright to terms like “Super Bowl,” the team has filed two dozen trademark applications in a little over a year to claim ownership to such terms as “boom” and “Go Hawks.” The team is also claiming ownership to the number 12 in a font like the one used by the team. It had to settle a prior lawsuit over its use of “The 12th Man” phrase (referring to the fans) — a phrase claimed by Texas A & M where it was forced to pay a licensing fee for the limited use of this common term. Now it is trying to the do the same in claiming parts of the English language as owned by the team (I am waiting for the Patriots to trademark “Deflate-gate”). It is all perfectly bizarre but Congress has done little to stop the frenzy to claim common terms and phrases. Too bad there is not anyone willing to throw a flag for encroachment to protect citizens.

The CIA’s Whitewash Investigation of Itself

It is unfortunately not surprising that anything that the CIA does should be considered suspect.  When the CIA recently came under fire for allegedly spying on Senate computers, no one, except the Senators who were spied on were surprised.  Now that Director John Brennan has completed his internal “investigation” into the matter, the truth has come out.  John Brennan says he and the CIA did nothing wrong! Florida Judge and Former Prosecutor Arrested For Alleged Domestic Abuse

Judge Eric Myers is now on the other side of the bench after an arrest for alleged domestic violence and an order to stay away from his wife and daughter. The arrest occurred on Saturday morning and Myers’ wife, Shirley Sanchez-Myers, 40, petitioned the court for protection over the weekend. She says that the judge beat her as their young daughter pleaded “Daddy stop hitting mommy.” Myers is the former head prosecutor overseeing drug cases in the county.

The Price of Free Speech: California Attorney Posts Widely Denounced Advertisement With Sexy Doll

I have previously written about how some attorneys continue to ignore bar standards encouraging firms to show basic professionalism and decorum in advertising. While we all agree that there is a free speech right to advertise, the vast majority of lawyers show great restraint in deference to the standards of our profession. Then there are people like Michael A. Fiumara. Fiumara of Santa Rosa has posted a juvenile advertisement featuring a sexually suggestive doll in his effort to win the race to the bottom among low-grade lawyers.
