I had a fleeting sensation of hope yesterday when a poll of 1,000 Egyptians by the Pew Research Center found that 59% percent said that their preferred form of government is democracy. Then a little below the poll found that 82% feel adulterers should be stoned and 84% believe that apostates from Islam should face the death penalty.

We only recently passed the 22,000,000 mark last July but a few minutes ago we just hit 23,000,000. It continues to be a banner year for the site with a continuing increase in traffic, links on other sites, and new voices on the blog. These milestones are coming faster and they give us a chance to look at the spread of our regular readers and commentators. As always, I want to offer special thanks for our weekend contributors: Mark Esposito, Mike Appleton, Larry Rafferty, Charlton Stanley, Darren Smith, and Kimberly Deines. The increasing traffic on the site is gratifying and reaffirms that there are many people looking for mature and civil debate. Even among the top ten sites, I believe that we offer a unique forum of different views and backgrounds in the discussion of law and politics (and a few quirky items).
We previously discussed the bizarre case of Faulkner County Circuit Judge Mike Maggio who was identified as an anonymous commenter known as “geauxjudge” in a an an interesting controversy in Arkansas where Maggio was was outed from online sites. Maggio previously apologized and withdrew from a race for the appellate court. The controversy raised the question of whether such comments should be a subject for ethical discipline and whether judges should have the right to comment anonymously on such sites. Now Maggio has been permanently removed from the bench for his discussion of a confidential adoption of a child by actress Charlize Theron. He agreed with the Arkansas Judicial Discipline and Disability Commission about the lifetime ban. However, the Arkansas Supreme Court rejected the recommendation because it included Maggio being suspended with pay until the end of the year when his term expires.

This afternoon, the Senate Committee on Homeland Security and Governmental Affairs will hold its hearing on whether to accept a new state into the Union: New Columbia. While I was asked if I could testify on S. 132, I will be traveling today to Newport News to Christopher Newport University for a long-planned debate with John Yoo on presidential powers. I have written a long academic publication on the status of the District of Columbia and testified at the prior hearings on allowing for voting representation of District residents. See Jonathan Turley, Too Clever By Half: The Partial Representation of the District of Columbia in the House of Representatives, 76 George Washington University Law Review 305-374 (2008). Since I will not be able to appear, I thought that I would re-run my earlier column on the proposal. Before Congress embraces the path to statehood, it should give the original concerns of the Framers (and some new ones) full consideration. I have long argued that a constitutional amendment is the best way to give residents a vote in Congress. Statehood raises a myriad of difficult issues but regardless of the reform (whether statehood or an amendment simply allowing for a representative in the House of Representatives), this should be a decision that is submitted directly to the American people as a whole. I am troubled (as I was in 2007) by the effort to push this through Congress to avoid such a vote (as well as the cloud of partisan politics that continue to swell around the issue).

Unfortunately, the hearing was moved to the afternoon on Monday, which made it impossible because I have to be in Newport News on Monday for a long-planned debate with John Yoo on presidential powers. Accordingly, I had to reluctantly decline. I have great respect and sympathy for those trying to secure a vote for the District residents. I have previously suggested different means to accomplish that end. However, before Congress embraces the path to statehood, it should give the original concerns of the Framers (and some new ones) full consideration.

The scandal surrounding former Ravens running back Ray Rice has continued to deepen this week after his release by the Ravens for punching his now-wife in the face in an infamous elevator video. First, a longer version of the video was released. Then, the Associated Press has reported that not only was a league executive shown the video in April (long before what the NFL claimed in the wake of the scandal) but that the video was sent by a law enforcement official.

Egypt has continued its crackdown on social and religious minorities under Sharia law with the arrested of seven men for debauchery, “incitement to debauchery” and “publishing indecent images” after they were shown taking part in a “gay marriage” video on social media networks. The prosecutor declared that the video was “humiliating, regrettable and would anger God.”

We have been following the alarming rollback on environmental protections under Australia’s conservative Abbott, including the repeal on the carbon tax (the first of a major Western power). Tony Abbott has pledged to reverse environmental measures from the protections of the country’s famous reefs to opening up pristine areas for development. Now, just two months after the repeal of the tax on emissions, a study shows that (not surprisingly) carbon emissions and electricity demand in Australia have risen after a nearly six-year long trend of decline. This comes a week after the report of scientists who found an over 99% likelihood that humans are causing climate change.
In Riyadh, the Saudi morality police are again in the news. You may recall that when we last left the medieval mod squad they had secured a sentence to flog a woman who insulted them. Now, the religious police was caught on video beating up a British resident after they paid a bill at a women-only cask desk. The religious police was irate at the violation of the strict Sharia-based separation of the sexists and apparently took what they thought was the morality correct approach in beating the man in front of his wife who was wearing a black abaya cloak.
We have previously discussed how the United States lags behind many countries in the speed and availability of high-speed Internet. As noted earlier, this is due primarily to the powerful lobby in Washington and members who do their bidding in Congress to allow certain companies to control and profit off of such access. The U.S. cable industry and its lobbyists however have been careful to stay out of the public eye to protect their income and the members that they use in Congress. Now, however, the industry has made a rare play in the open. The industry is moving to block plans in Chattanooga, Tennessee and Wilson, North Carolina to offer high-speed internet services to their citizens. Lawyers and lobbyists for USTelecom, which represents cable giants Comcast, Time Warner and others, have mobilized to stop this trend where municipalities have responded to the demand of their citizens for such access. In the world of Washington lobbying, the slowest in this field has continued to win the race. While slow in service, our telecom companies are fast in making friends in Congress.
The National Report has released another highly disturbing story out of Louisiana where Paul Horner, 15, allegedly was given 25 years to life for “swatting” — calling in a face police report on an online gaming opponent. The problem is that the story is entirely untrue. There is nothing funny of course about the article like an Onion publication. National Report, which we have previously discussed, is a fake new site in which grown adults do nothing but try to trick blogs and news sites into republishing false stories. That is it. Just a juvenile “gotcha” site that is the equivalent to journalistic graffiti. Now, once again, here is my question: why do advertisers support this site and why hasn’t someone sued these people? The latest fake story shows the picture of a person crying in a courtroom surrounding by officers. The editors list the photo as an Associated Press photo and the website appears to have removed its prior disclaimer that the stories are false.

Lawrence Winger, a leading labor and employment lawyer in Maine, was arrested Wednesday morning and charged with possessing child pornography. Winger, 63, consented to a search of his office where investigators allegedly found dozens of images and videos of prepubescent children engaged in sexual activity. Winger has a blog specializing in labor and employment issues.

Deputy Senate Speaker Roberto Calderoli (and Senator from the The Northern League and once Minister of Reforms under the center-right government of Silvio Berlusconi in 2006) may not appeal to many Italians. He is viewed as xenophobic and racist. He insults groups with remarkable frequency and . . . oh yes . . . he says that he is possessed. That’s right, Calderoli believed that he has been hexed by the father of the the Minister of Integration and wants an emergency exorcism from the Church.
