Don’t Mess with Texas’ Executions

As an Illinois resident I was heartened by the fact that a former governor took the politically dangerous action to halt all executions and recently the current Governor of Illinois signed a bill to  end the death penalty in Illinois.   Tribune   With that background, I was saddened to read that since 1976, more than 1/3rd of all executions that took place in our country happened in Texas. The current Archbishop of Chicago, Francis George (left), recognizes the “difficulty of public discussion … is that the political is the highest level of public discourse.” In explaining the Catholic Church’s concern with the HHS mandate regarding contraception. His Eminence said the first question to ask is: “Is it true or false?”

The product of reason is truth. British philosopher, John Stuart Mill, defined logic “as the science which treats of the operations of the human understanding in the pursuit of truth.”

Zimmerman: Media Circuses Make for Bad Justice

At this point, to be honest, all of the back and forth regarding “evidence” in the Zimmerman Case that has occurred here over a number of threads has been mere speculation that misses the salient issues raised by this case. The real (admissible) evidence will be presented at the trial and a hopefully an unbiased jury will make its decisions. The issues that we need to discuss from my perspective are:

1. Did the Sanford Police make a mistake in releasing Zimmerman rather quickly and allowing him to retain his gun, which was potential evidence?

2. Was there undue outside influence used upon the police to end their investigation quickly?

 3. Is there a degree of probability that in many Stand Your Ground venues, had the victim been white and the protagonist of color, that the protagonist would have been immediately arrested?

4. What are the purposes of a business oriented lobbying group, like ALEC, in getting “Stand Your Ground” Laws passed?

Reasonable Doubt? Crime Scene Photos Shows Serious Injury On Zimmerman’s Head

ABC News has been given a photograph that might make the difference between life in prison and a walk. For weeks, we have been discussing the case and the application of the Stand Your Ground law. As discussed earlier, I think the case was over-charged and I remain doubtful of a conviction. This picture will likely be the single most important piece of evidence in the case. It shows Zimmerman with significant blood on the back of his head — an image that supports accounts from the scene and will be used to corroborate Zimmerman’s account of a struggle with Trayvon Martin where he feared serious bodily injury. [UPDATE: Zimmerman granted bond].

Stones Fly In City Of Glass Houses: Congress and the White House

As a longtime critic of congressional junkets and travel, I am a bit confused by the effusion of shock and contempt by our congressional leaders in both parties over the recent Nevada conference by GSA employees. There is no question that the conference was outrageous and an abuse. However, these are the same people who have spent hundreds of millions on trips that have long been denounced as little more than paid vacations and long fought for the right to be wined and dined by lobbyists and other interests at swank hotels and restaurants (here and here and here). In the meantime, recent reports show that Defense Secretary Leon Panetta has cost the taxpayers $860,000 to fly back and forth on weekends to his home in California. That is almost the exact amount spent at the Nevada conference. They sound like a city of Claude Rains, “shocked, shocked” by the allegations as they rush to make their private flights on government aircraft.

What Happens in Vegas, Stays In Vegas: GSA Official Invokes Right To Remain Silent in Congressional Hearing

This is not exactly the picture you want public when you are invoking your Fifth Amendment Privilege Against Self-Incrimination. The picture shows General Services Administration official Jeff Neely enjoying a spa tub and wine as part of the $822,000 Las Vegas conference that is now the subject of a congressional investigation, as previously discussed. Neely, the GSA’s Public Buildings Service regional commissioner, invoked his Fifth Amendment rights in a hearing. His seat remained vacant at the hearing after his invocation.

The Dangers of Holding Hands

As one who was taught by Benedictine nuns in a Catholic elementary school, I grew up with some strange and possibly severe restrictions on what the nuns called “mixing” the boys and girls. More recently, when my adult children were in school, the Diocese of Rockford forbade Altar boys being on the altar at the same time as Altar girls!  With that background, I thought I had seen it all.  However, the State of Tennessee has just beaten that sorry record of over restrictive rules for school children.  It seems that Tennessee state senators, in their infinite wisdom have updated their already suspect abstinence based sex education law by suggesting that holding hands is a gateway to sex.  Continue reading “The Dangers of Holding Hands” →

Jury Selection Starts In Edwards Case with Controversial Campaign Finance Charges

Jury selection began yesterday in Greensboro, N.C., in the federal trial of former presidential candidate John Edwards. Because of the extremely prejudicial aspects of Edwards’ infidelity while his wife was battling cancer, voir dire and pre-trial motions in limine will be critically important in the case. Equally important will be the legal basis for the campaign finance charges in the case over the use of third-party funds to hide his affair with Rielle Hunter. In my view, the charges stretch the law too far but the government will still have to convince a jury. The greatest danger for the defense remains the prejudicial elements and how they may warp the jury’s view of the facts and legal standard.

Gingrich: Fox News Is Not Fair Or Balanced

Fox News and Newt Gingrich (who once held a Fox contract) are exchanging blows today after Newt Gingrich accused Fox of an overwhelming bias in favor of Mitt Romney and, even worse for diehard Fox fans, said that CNN offered more balanced and fair coverage. Fox responded that Gingrich was auditioning for “a CNN gig.” That might be a needed job after Gingrich’s $500 check to enter the Utah primary bounced. Now Gingrich is selling the names and addresses of his donors to the highest bidder.

Zimmerman Charged With Murder But Can The State Make The Case For Second Degree Murder?

The second degree murder charge of George Zimmerman has received widespread approval. I am in Fort Worth to speak to the Fort Worth Lecture Foundation this afternoon. However, I am receiving a lot of calls on the basis for the charge. I must confess that I am not optimistic on the chances of a conviction unless the special prosecutor has undisclosed evidence to meet the high standard under the state law.  As I discussed on BBC last night, there are substantial challenges to make such a charge stick in this case.

Roma Advocates Seek Ban Of Swiss Magazine Over Incitement

We have followed the growing trend toward criminalization of speech in the West. This morning we have another such story out of Germany over a cover on the Swiss magazine Die Weltwoche, on the increasing numbers of Roma in Switzerland. The cover shows a Roma boy pointing a gun and critics have called for the magazine to be banned for racial incitement. There is ample reason to debate the merits of the cover story, entitled “The Roma are coming.” However, once again, there is a move to ban unpopular speech rather than allow free speech to be its own disinfectant.

Former Maricopa County Attorney Thomas Disbarred; Compares Himself To Gandhi

We have previously discussed the abusive tenure of former Maricopa County Attorney Andrew Thomas and his unethical conduct in conjunction with Sheriff Joe Arpaio. In a triumph of ethical ethics, a three-member disciplinary panel of the Arizona Supreme Court has now issued a 247-page opinion (below) disbarring Thomas and one of his former deputies, Lisa Aubuchon, as well as suspending another former deputy county attorney (Rachael R. Alexander) for six months and a day for prosecutorial abuse. In the action, the Arizona Bar not only upheld the integrity of its membership of lawyers but all lawyers. In response, Thomas has denounced the decision and compared himself to Mahatma Gandhi and Martin Luther King Jr. The bar seems to have a different image in mind. It began its analysis with this quote from Proverbs 12:15–17: “The way of a fool seems right to him, but a wise man listens to advice. A fool shows his annoyance at once, but a prudent man overlooks an insult. A truthful witness gives honest testimony, but a false witness tells lies.”
