Woman Flogged In Indonesia For Being Present

125px-Flag_of_Indonesia.svg85px-Coat_of_Arms_of_Indonesia_Garuda_Pancasila.svg
We have yet another example of the brutality of Islamic Sharia law from Indonesia where a woman was savagely flogged publicly for spending time with a man who was not her husband, including an allegation of sex outside of marriage.  The flogging occurred in Banda Aceh on the Island of Sumatra.

Cleric: Killing Kurds Who Convert To Zoroastrianism Is “Legitimate”

By Darren Smith, Weekend Contributor

In another example of attempts to legitimize murder for apostasy, an Islamist Cleric of the Kurdistan Islamic Group (KIG) declared in an interview with the BBC that Kurds who leave Islam to convert to Zoroastrianism are to be murdered; or in his words “Killed and Executed.”

The cleric extended his hand of mercy by allowing those converts three days to regret their decision but thereafter are to be executed.

In an almost brutal irony, Mulla Hassib from Sulaimani said that Islamic religious tenets permit such executions, but ISIS’ practice of killing apostates is partially correct but he criticizes the terrorist organization for spreading the religion by means of “violence”.

TRUMP NOMINATES NEIL GORSUCH FOR THE UNITED STATES SUPREME COURT

ap17024739756097President Donald Trump has made his choice for the Supreme Court and it is Tenth Circuit Judge Neil Gorsuch, 49.  With the selection, President Trump would be submitting a jurist with unassailable credentials and proven intellect.  He is also someone with a proven conservative record, though there are a few blind spots for those who want a nominee vaccinated against what conservatives view as the David Souter virus — a creeping condition where a conservative gravitates to the left of the Court with time.  Last night, The Hill newspaper ran my column on Gorsuch and his unquestioned qualifications.

Is The Trump Executive Order on Refugees Unlawful?

donald_trump_president-elect_portrait_croppedI previously discussed how President Donald Trump has the advantage in a constitutional challenge of this executive order suspending entry for refugees and imposing special limitations on seven stated countries.  As I have noted, this does not mean that there are not legitimate questions raised, particularly over the express preference to be given “religious minorities” under the order. However, the case laws heavily supports a president’s plenary power over such border controls.  There remains however a question over whether the law could be constitutional under a president’s inherent authority but still unlawful under statutory authority.  Most of that argument centers on the Immigration and Nationality Act of 1965, which bars discrimination based on nationality or place of origin.  There are clearly compelling arguments on both sides of this question, but once again I believe that critics may be overstating the 1965 law as making the executive order facially invalid.  As I have repeatedly stated since this executive order was signed, I believe it was a terrible mistake, poorly executed, and inimical to our values as a nation.  However, legal analysis by a court should not be influenced by such personal viewpoints.  The question is solely whether the president is barred statutorily from taking this action.

“Trump Is Here Now”: Massachusetts Man Arrested After Assaulting Muslim Delta Worker

220px-2010-07-15_B767_Delta_N1611B_EDDF_04Another incident has captured the growing hate exhibited on both sides of the widening political rift in this country.  Robin A Rhodes, the president of Nitrofreeze Cryogenic Solutions (a metals company based in Worcester) is accused of a vile attack on a Delta employee due to her Muslim faith  Rhodes allegedly abused Rabeeya Khan in the Delta Air Line Sky Club and kicked her. He also is quoted as declaring “Trump is here now” and “he will get rid of all of you.”

Federal Court Stays Executive Order On Refugees

donald_trump_president-elect_portrait_cropped gavel2Yesterday, I discussed the constitutionality of the executive order halting all refugee entries to the United States.  Late on Saturday, U.S. District Court Judge Ann Donnelly ruled in favor of a habeas corpus petition filed by the American Civil Liberties Union (ACLU).  The petition was brought on behalf of two Iraqi men detained at John F. Kennedy International Airport on Friday.  As I discussed on CNN after the ruling, this is decision to stay not to enjoin. The latter will require a showing by the ACLU that it is substantially likely to prevail on the merits, a tough standard to satisfy.  Judge Donnelly effective froze developments in the case pending a hearing on the case.

SUPREME COURT TURNS DOWN SISTER WIVES PETITION

240px-sister_wives_tv_series_logoSupreme CourtI regret to report that a few minutes ago, the United States Supreme Court denied the petition for review filed in the “Sister Wives” case. The case is Brown v. Buhman, No. 14-4117. As lead counsel for the Browns, I was joined on the petition by co-counsel Thomas Huff and Adam Alba.  My prior assistants, including my current assistant Seth Tate, and law students worked countless hours into many late nights to maintain this litigation.  We are greatly in their debt for their pro bono work on this case.  The attorneys and law students who worked on this case came from different religions and held different values.  Many disagreed morally with plural families. However, we all believed strongly that every family has a fundamental right to follow their own faiths so long as they did not harm others.  We all believed that the Browns were denied those rights when they are singled out for public condemnation and criminal investigation due entirely to their public support for plural marriage.  It is particularly difficult to prevail on the merits in establishing constitutional violations only to be reversed on standing issues on appeal. However, our victory in Salt Lake City will remain as a cautionary decision for legislators who wish to marginalize or sanction this community in the future.

I also wanted to extend my deepest gratitude and respect to the Brown family which allowed us to represent them in this historic action.  The Browns remained steadfast in their commitment to equal rights and have become the voice for not just plural families but many families which do not meet the strict definition of monogamy practiced by the majority of citizens.  The Browns have kept their show and this litigation largely separate to allow the courts to fully consider the merits of our case without interference or aggrandizement.  They continue to have faith in our country and our legal system despite this decision.  More importantly, they have faith in the right of all families to enjoy the protections of our Constitution and will continue to fight to make that promise a reality for plural families throughout the country.

“I Have No Regrets”: Pakistani Mother Tells Daughter To Come Home For Wedding Celebration . . . Then Burns Her To Death As “Honor Killing”

screen-shot-2017-01-17-at-10-52-25-amAfter repeated refusals of her family to allow her to marry the man she loved, Zeenat Rafiq, 18, eloped with Hassan Khan, a classmate.  She was surprised therefore when her mother found her to say that all was forgiven and that she should return home for a belated celebration of the marriage.  When she showed up, her mother and brother proceeded to beat and strangle her . . . and then burned her.  Her mother, Perveen Bibi, has proudly claimed to have upheld the honor of the family by killing her own daughter.  She told the police “I have no regrets.”

Saudi Cleric Condemns Plans To Allow Movies or Public Concerts In The Kingdom

these-are-the-damned200px-Coat_of_arms_of_Saudi_Arabia.svgThe Saudi Kingdom is back this week reminding people of the inherent extreme lunacy of theocratic legal systems.  Saudi Arabia’s top religious authority Grand Mufti Sheikh Abdulaziz Al al-Sheikh has proclaimed that cinemas and singing concerts are unIslamic and morally harmful.  The Kingdom follows a medieval system of Sharia law and denies basic civil liberties to women, non-Muslims,  political dissidents, and journalists.  Cinemas and public concerts are already banned in the name of Islam in the Kingdom.

Ugandan Official Asks For Wads of Cash To Be Placed Into Casket To Bribe God

300px-god2-sistine_chapelCharles Obong, 52, a deceased Ugandan government official, appeared to be quite concerned about being called to account for his life and actions. Accordingly, he instructed that at least $5,700 (roughly P280,000) be placed inside his casket as an “offertory” to forgive God for his sins and “save him from hell fire.” Given his view of not only the susceptibility or ease of bribing the Almighty, I expect he has good reason to be concerned. While I am still a bit confused of why the Almighty would want Ugandan dollars or where he would use the cash, such attempted bribes are generally viewed as beyond the reach of criminal codes — even ones with really really really long-arm jurisdiction.

Turkish Marriage Guide Encourages Beating Wives Who Do Not “Beautify” Themselves And Supports Marriage Of Girls As Young As 10

Flag of TurkeyWe have previously discussed the plight of women and girls subject to Sharia law and extreme Muslim traditions of marriage. The nightmare faced by many women was captured in a horrific guide being distributed by in Turkey by former religious affairs department employee Hasan Caliskan. The guide supports the beating of women who do not “beautify” themselves, supports the marriage of 10-year-old girls, and advances absurd notions like the danger of having a stuttering child if a woman talks during sex.

Texas Legislator Seeks To Get Rid Of No-Fault Divorces and To Delay The Finalization Of Divorces

thumb_wedding_rings2465Matt Krause is a deeply religious man who feels that people too easily divorce. That is clearly understandable view and probably speaks well of his own marriage. However, Krause is also a Texas state representative and wants to make that decision more difficult for his neighbors. He has introduced bills that should more divorces more expensive and more time-consuming and thus more difficult for couples to secure. This is a point where libertarians and some conservatives part ways. As someone with strong libertarian tendencies, I recoil at the government enforcing moral codes on a couples in making it difficult for them to divorce after they have made that difficult decision within her marriage or families. He would specifically bar no-fault divorces to protect the sanctity of marriage.

India Cracks Down On Cow Slaughtering And The Sale Of Beef In Latest Attack On Secular Government

1024px-Flag_of_India.svgWhen one thinks of the countries without a separation of church and state, countries like Israel, Iran, Saudi Arabia and others come readily to mind. It is often easy to forget that India struggles with the same issue as many call for the enforcement of core Hindi values. That was on display in Mewat, India when police raided roadside food stalls to confiscate beef and arrest anyone guilty of slaughtering a cow or selling the meat. This is a new local ordinance and violators can face 10 or 5 years respectively in jail.
