The White House Expected to Name Supreme Court Nominee Soon

Washington is abuzz this morning with rumors that President Joe Biden will name his nominee, an announcement that is expected as soon as today. As previously discussed, President Biden announced that he would only consider Black, female candidates — threshold criteria overwhelmingly opposed by the public. The pledge was as unnecessary as it was unfair. The three short listers — each with impressive backgrounds — are Judge Ketanji Brown Jackson, a federal appeals judge; Judge J. Michelle Childs, a federal judge in South Carolina; and Leondra Kruger, a justice on the California Supreme Court. I have previously said that Judge Brown Jackson remains the frontrunner for the position.

The nomination would seek to put a Black woman on the Supreme Court for the first time in its 233-year history.

Biden recently interviewed all three candidates for the job.

Liberal groups have mounted a campaign against Childs for being too moderate and “tough-on-crime.” This concerted opposition campaign, including the Bernie Sanders–aligned Our Revolution group, has also painted Childs as anti-union and pro-employer. President Biden has been criticized for yielding to the far left on nominations in the past.

Sen. Richard Blumenthal (D-Conn.) has added his voice that the nomination should be “very expeditious.” What Democrats may be fearing the most is the type of nomination practices that they employed in the last three confirmations, including the use of the “Barrett Rule.”

  1. Jonathan: Nothing you say will change the probable vote on Judge Jackson nomination. Jackson’s stellar resume is well known–a Harvard law grad who was confirmed 3 times by the Senate. This time McConnell can’t deny a hearing to Jackson like he did with Merrick Garland, Obama’s nominee. Almost all Senate Republicans will vote against the first Black woman to be nominated for the SC. The optics will be terrible for GOP candidates this year and in 2024. Black voters have a long memory. McConnell will no doubt try to slow down the confirmation process that normally lasts about 2 months. McConnell is not know for consistency. He pushed through Justice Barrett’s confirmation in only 27 days–to get it through before the 2020 elections even though polls showed most voters opposed Trump’s nomination so close to the election. Don’t recall you citing the polls back then. In fact, you enthusiastically supported Barrett. Of course, that was then and now the tables are turned. So McConnell is not the only one to show a lack on consistency!

      In 2003, then-President George W. Bush nominated Janice Rogers Brown, an associate justice on the California Supreme Court to serve as a Judge on the United States Court of Appeals for the District of Columbia Circuit. She was the first black woman nominated for the federal bench.

      And of course we know exactly who fashioned the noose, and found the tree, for the high tech lynching of an uppity Black man, by the name of Clarence Thomas.

      1. Janice Rogers Brown was not “the first black woman nominated for the federal bench.” Constance Baker Motley was the first Black woman nominated for the federal bench. Motley was appointed to the US District Court for SDNY in 1966 by LBJ.

        Biden screwed up the hearings on Thomas, refusing to allow other testimony against Thomas. It’s one of many reasons I voted for someone else in the Dem. presidential primaries.

  3. Unconfirmed reports say Biden’s selection will be Judge Ketanji Brown Jackson, who clerked for Breyer. We can only hope that she understands her role and hope. Biden’s foolish statements have tarred her, but maybe that will provide an incentive for her to think twice. Though she is not my choice, I wish her well.

  5. This morning our priorities were set straight: CNN and MSNBC were all excited over Biden’s nominee; FOX was more concerned with details covering the Russia/Ukraine conflict. My personal opinion is that the latter is ultimately more important because it will impact more US citizens than the former.
    ( could Biden’s selection have been influenced by the fact that Ms Brown-Jackson is the youngest of his three considerations, thereby possibly will serve longer than the other two ? )

You clearly see Biden grab his temple, mystified that he can not grasp basic logic. Senator Kennedy got it but hated that an educated Black man was lecturing him, the “Lion of the Senate” about 1). racist Dem policies that keep Blacks down, and 2). judicial activism. Dr Sowell’s greatest gift is articulating succinctly basic logic even today in his advanced years, in the 90s. Pity Dr Thomas Sowell did not become the first Black President instead of the grifter Barry O.

    1. Bork was rejected with a bipartisan vote. Justice Kennedy was subsequently confirmed with a unanimous bipartisan vote.

          We’ll never know for sure if Vladimir Putin was watching when Joe Biden let the cat out of the bag live on television. If he was, the Russian president probably poured a vodka, called his generals and told them to get ready.

          It was January 19 at the White House, and the US President dropped a clanger, suggesting that Russia would get away scot free with a “minor incursion” into Ukraine.

          “It depends on what it [Russia] does,” Biden stumbled. “It’s one thing if it’s a minor incursion […] and then we end up having a fight about what to do and not do, et cetera.”

          His comment was what is known in the US capital as a “Washington gaffe” – when a politician inadvertently tells the truth. In this case, the plain truth was that Biden did not seem to have much of a stomach for taking on Russia.

  11. Jeff, as previously discussed Dementia Joe should never have ” said the quiet part out loud”. But it is entirely his choice to make. The R’s should treat any nominee with respect. Don’t stoop to the level of those who employed the ” Barrett Rule”. Whoever is the eventual Justice ,she will not change the Conservative/ Liberal makeup of the Court. This is not the hill to die on. Especially when our country needs to at least appear united as we face a possible invocation of Article 5. Just this minute read that his nominee will be Jackson. This will not please Clyborne. But she checks all of the boxes. Let’s hope the this ” box checker” is not the disaster that the last one was. I don’t have to name her. The whole country knows to whom I am referring.

  14. Clyburn has been advocating Childs, and she has the support of Lindsey Graham and Tim Scott. With Lujan unable to vote, the Democrats no longer have a majority. The Republicans should unite against anyone but Childs, who is most likely the least bad of the options.

    1. It’s not Clyburn’s choice to make, and Lujan has said that he plans return to Senate soon so that he can vote on the Supreme Court nominee.

    2. Well, he did not nominate Childs. We’ll see if the Republicans will oppose a nominee who has a judicial philosophy and record with which they disagree, or if they will instead be afraid of being called racist misogynists for opposing a black woman.

  17. Not many American breakfast tables were abuzz this morning about the soon coming nomination for Supreme Court Justice, as was Washington, DC. I saw an image from Ukraine of two very frightened little girls whose world was being destroyed by an abundance of Power hungry and sick people trying to create a lasting Legacys for themselves. Some people bought gas or groceries yesterday and most can’t name three Justices. Both conversations are important but sure seem out of sync.

  18. The Republicans must attack the method of selection….not the selectee unless she has a background that proves her unfit for the Court and then focus on only those issues that make her unfit.

    Race and Sex being the primary threshold for Biden’s pick is what is wrong about it…..as Identity Politics is wrong for any position in government or the private sector.

    We have seen how it works in our current Vice President who is plainly grossly unqualified for her job….but who was picked for her plumbing and skin color and not her competence.

    Were I any of the three being considered by Biden I would withdraw my name as I would not want my name associated with the sleazy method of appointment.

    What the Nation needs and deserves is a person of genuine conviction, a proven record of jurisprudence, and proven impeccable ethical standards……not a zealot or one who espouses a radical view of our judicial system who understands and has proven an ability to interpret the Law and not legislate from the Bench.
