We often discuss the long-standing question of whether it is better for your client to smile or not smile in a mugshot. Some believe a smile conveys a lack of contrition while others view a frown as looking guilty. In the first mugshot of a former American president, Trump (or now Inmate P01135809) rejected both the “carefree smile” and the “disapproving frown” and went with seething scowl. It is a mugshot that unfortunately will resonate with both extremes in our political system.
In Christopher Marlowe’s Doctor Faustus, the devil Mephistopheles (Marlowe spells the name “Mephistophilis”) shows him Helen of Troy, “the face who launched a thousand ships” that released a firestorm.
The Scowl is likely to launch millions of ships . . . all in the wrong directions.
For District Attorney Fani Willis and many of her supporters, the mugshot clearly holds a type of trophy kill appeal worthy of framing and mounting on a wall. This is one of those moments long portrayed on teeshirts and other merchandise for many on the left.
For many Trump supporters, it is a moment of gratuitous insult of a president who is now being prosecuted in four different states just before an election where he is the leading Republican candidate. For the most extreme, it will be portrayed as a virtual declaration of war, proof that the establishment will use every means to prevent another 2016 populist victory.
It is noteworthy that, like his critics, Trump is already selling merchandise with the mugshot and a “Never Surrender” slogan.
In that way, the mugshot will be the rallying cry at both extremes in our political system.
For that reason, I believe the mugshot was a mistake, an inflammatory moment wisely avoided in New York by another Democratic prosecutor. It is entirely unnecessary for the most recognized face in the United States.
The fact, however, is that many on both sides relish the rage. I have previously said that the most unnerving fact of what I have called “the age of rage” is that people secretly enjoy it. Rage is addictive. It allows people to say and do things that they would ordinarily avoid in public. It is a license to hate blindly and excuse all means to achieve an end.
I think that the Georgia, New York, and federal January 6th indictments are unwarranted and threaten free speech. Moreover, it is valid for many to object that these prosecutions could have occurred years ago, but were launched just before the presidential election so that Trump will be running from court to court through the general election.
It is also true that the Mar-a-Lago case is more serious and more substantive . . . and that threat is continuing to grow as a threat for Trump as witnesses change their testimony and Trump aides confirm key prosecution claims.
Likewise, while I believe the case against Trump in the Georgia indictment is weak, there are defendants in that case that face stronger claims on specific election-related crimes.
Of course, in an age of rage, reason is the first to die. We cannot allow that to happen; we cannot allow rage addicts to drive our political or legal processes. We have the greatest legal system in the world. We will sort out these issues from the criminalization of political speech to the claim that Trump can be barred from the ballot even without a charge or conviction.
Courts are likely to divide on these issues. However, we remain a nation of laws. That tradition takes a certain leap of faith. We do not support that system only when we prevail. That is the view of court packers like Sen. Elizabeth Warren (D., Mass.) and Rep. Alexandria Ocasio-Cortez (D., N.,Y.). Notably, Ocasio-Cortez even said that she does not understand why we need a Supreme Court.
Even law professors and legal commentators have called our Constitution “trash” and called for the country to “reclaim America from constitutionalism.” That is the greatest danger of these times: that our deep divisions will cause us to lose faith in our defining values and in each other.
The Trump mugshot captures a defining moment for our country. It will define us. I believe that it is paramount that appellate courts consider the merits of the free speech and other challenges to the Georgia, New York, and federal cases. That may be difficult if judges support these prosecutors in demanding trials before constitutional appeals are taken. Appellate judges could agree, in good faith, that challenges are premature before any convictions.
The important thing is for citizens not to be played as chumps. We will sort this out. The courts will address these important legal issues as citizens resolve the equally important political issues raised by these prosecutions.
The merchandising and madness aside, we have more matters to resolve . . . together.

The mistake surrounding mugshots was that they weren’t required for his first three indictments, effectively saying he’s above the law. What message would it send to have 18 other people take mugshots in Georgia but not Trump?
The ongoing mistake is to allow him to continue to attack judges and witnesses without retribution. One of the judges will first have to haul his ass back to court and warn him, then throw him in jail when he repeats his transgressions which you all know he will.
BTW, Turleys dismissal of three indictments as free speech is ludicrous, he acknowledges some people in Georgia have real legal issues yet somehow ignores the ringleader.

I think a mugshot was needed to demonstrate he isn’t above the law and granted privileges not given to any other defendant. I think they all should have been handcuffed as well but I’m reasonable in forgiving that. Having him undergo some of the steps related to his indictment and granted a 10-minute breeze through jailing doesn’t prove he isn’t above the law but the opposite, It was nice to note he’s gotten taller and slimmer according to the booking report. Who would have guessed he weighs 215 lbs. Now you all have to agree with his weight because acknowledging he’s a liar isn’t possible. Then again, fat does weigh less than muscle.

On the stolen documents case. Trump had 18 months to return the documents with no absolutely legal risk. Anyone else would have been in jail right now.
By contrast, when Hillary Clinton won about 3 million more votes than Trump received, Hillary respected the authority of the courts and Electoral College. When Al Gore won about 500,000 more votes than George W. Bush received, Gore contested it but respected the authority of the courts.
Trump alone is responsible for the chain of events he created for himself.
The “60 judges” you cite never got to rule on the merits but threw out the cases because there were procedural flaws, such as standing. Your numbers are wrong and this type of propaganda is what fuels the public’s feelings that the election was rigged. As the currant spate of cases vividly show, Trump cannot get a fair shake when the scales of Justice are turned against him for political reasons. He does, after all, represent a threat to the ruling class.

Filing the charges against Trump and his attorney’s is the problem much more than the mugshot. The mugshot just sealed Trump’s position as a freedom fighter for his supporters. It is one more nail in the coffin where the coffin is made up of the politically motivated prosecution of a former U.S. President. Dark days.

I agree with liberal attorney Alan Dershowitz who said that these cases cannot survive the appellate process but juries are not bound by the legal niceties of the law and often convict on emotions and whim. He said that the prosecutors only want a conviction in the trial court and recognize that their cases are likely to be overturned on appeal. Is this the proper application of our judicial system? Of course not. The Free Speech cases need to be removed immediately to federal courts because they involve federal workers doing their jobs within the scope of their employment. Only the Mar-a-Lago case has legs but that case should be dismissed as arbitrary, capricious, and an abuse of discretion by the prosecutor. If I were defending such a defense theory, I would threaten to call Hillary and Bill Clinton as well as Jim Comey and maybe Barack Obama as witnesses to show the arbitrariness of the case against Trump.

Sounds like JT is squirming a bit because he made snap judgements about the 1st amendment allowing you to tell any lie and say anything you want and no crime has been committed. Turns out, trump may be in just a tad more trouble than JT originally thought.
You can “sing” all you want but if the case is defenctive, your singing will do nothing to further the prosecution. Plus, singing witnesses who are co-defendants are considered motivated by their own self-interest more than a desire to see the truth be established. Their testimony may carry weight with a jury but the reasonable doubt must still be afforded the defendant. It’s a common strategy to indict multiple ham sandwiches at one in the hope that one or more will turn out to be baloney. Again, this may work in the trial court but fade away on appeal.

People are paying attention, but we know the police state mercies extend to only the demoncrat side, so they can pull an uprising and get paid to do it, and get off scott free.
So no one is going to stop the regime criminals. They will murder and incarcerate while lying and bloviating till they spontaneously combust at the least bit of resistance, after the silencing, banning, removing bank accounts, social media posts, shadowbanning, embedding themselves in the MSM, creating false flags like the gov whitmer fake kidnapping, getting people removed from their employment, removing credentials including doctorates and everything else, attacking lawyers and breaching client privilege with abandon.
