Florida Student Reportedly Suspended For Using Finger Gun In Playground Game

220px-gesture_thumb_up_then_down_forefinger_out_like_gun1We have previously followed the suspensions and discipline of students under zero tolerance policies that are used by teachers to justify zero judgment or responsibility. I have long criticized zero tolerance policies that have led to suspensions and arrests of children (here and here and here and here). Here is a prior column on the subject (and here).Children have been suspended or expelled for drawing stick figures or wearing military hats or bringing Legos shaped like guns or even having Danish in the shape of a gun. Despite the public outcry over the completely irrational and abusive application of zero tolerance rules, administrators and teachers continue to apply them blindly. If you do not have to exercise judgment, you can never been blamed for any failure. That seems to be the logic out of Harmony, Florida where teachers have suspended eight-year-old Jordan Bennett for using a finger as a play gun. This is only the last of such absurd finger gun cases. In the meantime, a student in Rhode Island was suspended for having a key chain with a tiny gun the size of a quarter on it.

“Ye Are My Witnesses”: Arkansas Man Arrested For Firing Shots At Jehovah’s Witnesses Who Approached Him On His Lawn

johnbaldwinJehovah’s Witnesses in Arkansas will soon be called to be witnesses of a different kind for John Baldwin, 35. Baldwin is charged with aggravated assault after firing 13 times at the Jehovah’s Witnesses who approached him in his front yard. After Baldwin told Laura Goforth, 47, and Rachel Boshears, 55, to get off his lawn, the Jehovah’s Witnesses were leaving when one of them heard Baldwin tell his wife “Get me my 9.” (A referenced to his Springfield XDM-9). While Isaiah 43:10 may proclaim “Ye are my witnesses, saith Jehovah, and my servant whom I have chosen,” these pious folk will soon be called by a more earthly authority to bear witness.

New York Police Make First Arrest in Biker Attack on Family (Updated)

wife.jpgPolice have made an arrest in the extraordinary case of a gang of bikers who terrorized a family of Alexian Lien, 33, in New York City. One of the bikers filmed the entire chase and attack and then posted it on YouTube. He may have succeeded in incriminating his colleagues, including Christopher Cruz, 28. Cruz was charged with reckless endangerment, menacing, reckless driving and acting in a manner injurious to a child less than 17. (Update: A second suspect — Allen Edwards, 42, of Queens, charged with reckless endangerment, criminal mischief and menacing. He is believed to be the man seen on video below striking the Range Rover windows with his fists.).

One Stop Shopping (and Sentencing): California Judge Sentences Man To 53 Years To Life . . . And Then Declares Him Married In Wedding Ceremony

Patricia K. CooksonDestiny Desbrow certainly had a marriage ceremony that would be hard to forget. It has the usual features of most weddings: a cake, a ring, and an audience. However, the location and time was a bit odd. She married Danne Desbrow just minutes after he was sentenced to 53 years to life for murder by Judge Patricia Cookson who not only had sentenced him but baked the cake for the wedding.

Tuba Torts

I have been warning for years of the dangers of tuba lines and now you can see why. Tuba lines are torts waiting to happen. The question is whether proximate causation for negligence of the first Tuba player covers all six victims or whether the casual chain is cut off after the first fall. It seems clear that the chain reaction is the foreseeable consequence of the original fall.

Drive and Die? Leading Saudi Cleric Warns Women That Driving Will Result In Damage to Ovaries and Birth Defects

saudi-sheikh-300x169Al Arabiya is reporting a bizarre warning issue by a leading Muslim cleric that women who drive risk damaging their ovaries and pelvises and birth defects. The announcement from Sheikh Saleh bin Saad al-Luhaydan comes as women continue to demand to be able to drive in the Kingdom and international pressure is growing for Saudi to make fundamental reforms. Judging from today’s other Saudi story, I thought the greatest danger was the religious police on the roads.

Change The Narrative: Clapper Returns To The Senate And Is Joined By Senators In Denouncing The Media and Snowden

220px-James_R._Clapper_official_portraitThe hearing this week on the massive surveillance programs targeting the communications of all citizens was the latest in the increasingly bizarre world of American politics. We have a Constitution that prohibits warrantless searches and seizures. We have a government — and a President — who previously misled us about the existence of such programs. We have Senators who knew of the prior deception and even perjury sitting in a hearing on the latest account from our leaders. Now, these same politicians are speaking openly about seizing every single telephone call. Rather than denying the program, they now refer to it as a harmless “lock box,” the way that Al Gore once referred to the social security accounts. What was particularly interesting is the statement of General Keith Alexander, the director of the National Security Agency, that disclosures by Edward Snowden “will change how we operate”. Indeed, in light of the Snowden disclosures, Alexander has stopped the prior denials of the Administration and is now speaking of “reforms.” That is precisely why most people view Snowden as a whistleblower despite the demands of the President and members of Congress that he be tracked down and put away for good. Even more interesting is the appearance of James Clapper, director of National Intelligence, who previously acknowledged perjury before the Senate. Rather than raise the perjury or demand his prosecution, Senators engaged in friendly exchanges with Clapper as if nothing had happened. This is clearly under the belief that the public has a remarkably short attention span and the media will follow the lead of the White House. Indeed, reporters for the most part did not even mention that Clapper is thought by many to be an unprosecuted felon due to his prior testimony or that his last major testimony on this very subject was to deny such programs. There was not even laughter when Clapper said that he was working to find ways to “counter the popular narrative” of any dangers in this surveillance. That “popular narrative” of course also includes his prior false testimony.

EasyJet: No Frills, No Free Speech?

220px-Easyjet_a319-100_g-ezbr_hundredthairbus_arpEasyJet has long been notorious for the level of service and comfort of a cattle car. However, the cattle were at least allowed to get on the plane and occasionally “moo”. Mark Leiser, who lectures at Strathclyde University, says that he was pulled out of line on his delayed flight and told that he could not board the plane. The reason? Lesier had tweeted criticism of the airline, which one would think the no-frills company would be rather used to. Apparently not. He says that he was only allowed on the plane after the airline employees discovered that he is a lawyer.

Las Vegas Union Pushes Through Deal That Bars Mandatory Use Of Body Cameras

123px-Las_Vegas,_NV_Metropolitan_PoliceBody cameras have been credited with not only uncovering police abuse but generally improving the conduct of officers in relation to the public. Recently in Las Vegas, controversial shootings have led to the demand of such tiny cameras. However, the Protective Association representing Las Vegas police has announced that it pushed through an agreement with Sheriff Doug Gillespie to make the wearing of such cameras optional for officers — an option unlikely to be taken by most police officers.

NBC Show Features NRA Lobbyist Shooting Elephant In Face And Then Celebrating The Kill

Given the story today about the poaching of elephants, this video on Reddit caught my eye. It part of a show called Under Wild Skies What is this shit? For some reason, NBC Sports Network has been airing an NRA-sponsored hunting show called Under Wild Skies, which apparently airs on NBC. This video shows a lobbyist named Tony Makris shooting an elephant in the face. I am surprised to see NBC airing the scene. It shows that, while one cannot swear on television or show certain types of intimate scenes, you can still shoot a elephant in the face. [WARNING The video contains graphic and disturbing images]

Michigan DHS Takes Baby From Home Due To Parents Use Of Legal Medical Marijuana

marijuana_leafThere is a case in Michigan that captures what many parents complain is a child protective system that strips away basic due process rights and at times defies both logic and controlling authority. There may be no better example than the treatment of Gordon “Steve” and Maria Green after their 6-month-old baby girl, Bree, was taken away from them. The reason is the determination that the parents have marijuana in the house. It was not hard for the case worker to find: the Greens have a right to medical marijuana protected under state law. That did not matter to the Department of Human Services however and their baby was taken away from their Lancing home.
