Federal Judge Rules Against Berkeley In Victory For Free Speech

Seal_of_University_of_California,_Berkeley.svgI have previously criticized the University of California at Berkeley for its highly biased history in dealing with conservative speakers who come to campus.  Now, federal judge Maxine Chesney has agreed with the Young America’s Foundation (and the U.S. Justice Department) in rejecting a motion to dismiss by Berkeley — forcing the school to deal with its policies and priorities on the exercise of free speech.  The president of the University of California system is Janet Napolitano, former  United States Secretary of Homeland Security under President Barack Obama.

Turley To Give The 2018 Thomas M. Kerr, Jr. Lecture At Carnegie Mellon University

Fresno Professor Faces Calls For Termination After Declaring “The Witch Is Dead” Hours After The Passing Of Barbara Bush

California State University Randa Jarrar is facing calls for her termination after she appeared to celebrate the death of former First Lady Barbara Bush.   A petition calls for the  “Immediate termination of Professor Randa Jarrar for racism and inflammatory comments regarding a former First Lady of the United States, Barbara Bush.”  Jarrar’s comments were disgraceful and hateful, but there remains a question of the free speech rights of teachers and professors in their private lives.

Erdogan Takes A Hostage: Authoritarian Turkish Leader Demands U.S. Turn Over Dissident In Exchange For American Pastor

Recep_Tayyip_Erdogan_2017We have followed the rapid destruction of the secular government and civil liberties in Turkey under the authoritarian rule of Erdogan. Erdogan used a failed coup to push his effort to create a de facto Islamic regime and to complete his work in arresting his critics, including forcing the resignation of thousands of secular academics, and suspending all civil liberties in a proclaimed state of emergency. Previously, Erdogan threatened the United States if it didn’t handIslamic cleric Fethullah Gulen over to him and that a failure to yield to his demands would be a “big mistake.”  Now he is taking hostages.  Erdogan is suggesting that he will not turn over pastor Andrew Brunson (who was arrested in 2016) unless we turn over Gulen for likely torture and execution.  Erdogan, who has destroyed the once free press of Turkey as well as secular institutions, is leaving no doubt as to his achieving tyrannical rule in the once modern Islamic nation.

Liar, Liar, DOJ On Fire? Comey and McCabe Offer Sharply Conflicting Accounts

440px-Comey-FBI-PortraitAndrew_McCabe_official_photoI previously wrote that President Donald Trump has the curious skill of bringing out the worst in his critics.  In the last two weeks, two of Trump’s greatest critics have not only faced their own investigations into leaks by the Inspector General (and McCabe is now the subject of a criminal referral for prosecution), they are increasingly at odds with one another. It is clear that either Comey or McCabe is offering a false account of leaks from the Justice Department.  With McCabe now promising defamation lawsuits and the possibility of a prosecution, this could get much worse before it gets better.

Conservative Protester Shouts Down Comey At Book Event

440px-Comey-FBI-PortraitI have always marveled at the relativism of the most extreme voices in our public discourse.  As shown just yesterday, I have regularly criticized the failure of schools to discipline or expel students who prevent conservatives from speaking on campuses. This included my criticism of Howard University students who stopped former FBI Director James Comey from speaking.  Yet, Laura Loomer, a conservative activist, believed it was her right to stop others from hearing from Comey at an event promoting his book in New York City.  I felt Comey handled it well but it is beyond me how people like Loomer believe that they can prevent others from speaking or listening to opposing views.  While I have been highly critical of Comey, including a column out this morning, he has every right to be heard and these people came to hear him — not Loomer.

CUNY Law Dean: Students Shutting Down Speech on Free Speech Was Free Speech

imagesWe have been discussing the rising intolerance and violence on college campuses, particularly against conservative speakers. (Here and here and here and here). Berkeley has been the focus of much concern over mob rule on our campuses as violent protesters have succeeded in silencing speakers, even including a few speakers like an ACLU officials and James Comey.  Both students and some faculty have maintained the position that they have a right to silence those with whom they disagree and even student newspapers have declared opposing speech to be outside of the protections of free speech.  At another University of California campus, professors actually rallied around a professor who physically assaulted pro-life advocates and tore down their display.  In the meantime, academics and deans have said that there is no free speech protection for offensive or “disingenuous” speech.  Now, CUNY Law Dean Mary Lu Bilek has a different approach. When conservative law professor Josh Blackman was stopped from speaking about “the importance of free speech,”  Bilek insisted that disrupting the speech on free speech was free speech.  It reveals the twisted logic overtaking our schools on both tolerance and free speech.

South African Sentenced To Two Years For Racist Comments

download-1We have previously discussed the alarming rollback on free speech rights in the West, particularly in France (here and here and here and here and here and here) and England ( here and here and here and here and here and here and here and here and here and here).  Even the Home Secretary has been accused of hate speech for criticizing immigrant workers.  South Africa now appears to have crossed the Rubicon of speech criminalization with a two-year sentence for a white woman, Vicki Momberg, who espoused racist statements in a confrontation with a police officer. The prosecution is being heralded as the start of a new era for speech prosecutions.

Scottish Man Arrested After Leaving Napkin In Restaurant With Racist Language

England flagThere is a new controversy in Great Britain over the expanding criminalization of speech. An arrest has been made after an intensive investigation of napkins left at a Chinese restaurant containing racist language.  The napkin was left by a young couple at the Hong Kong Star, a restaurant in Dumfries, Scotland. As vile as the language was on the napkin, the investigation and arrest illustrates the degree to which speech is being criminalized in Great Britain.  Warning: this article has profane and racist language below.

Kaiser Fires Nurse For Saying Stephen Clark “Deserved It For Being Stupid” On Social Media [Updated]

downloadFaith Linthicum, a labor and delivery nurse at Kaiser Permanente Roseville Medical Center in California, has been forced on leave for writing on Facebook that Stephon Clark, the unarmed black man who was fatally shot by police, “deserved it for being stupid.”  This is the latest example of employees being fired for expressing their views outside of work, including prior controversies involving nurses.  Update: the hospital has fired Linthicum.

London Mayor Joins Call For Censoring and Fining Internet Companies

England flagThe mayor of London, Sadiq Khan, used the annual SXSW festival in Austin to join other European leaders in calling for tech companies to censor hate speech and be subject to government regulations for fines for violations.  Khan read hateful messages against him to support the need for a crackdown — ignoring the free speech implications of such government regulation.

Jackie Chan Joins Chinese “Advisers” In Calling For Other Artists To Be Jailed For Insulting China

Hong Kong movie star Jackie Chan has long been known to harbor authoritarian and anti-free speech views. Now, the action movie star is calling for other artists to be arrested for art that is deemed insulting to China, particularly in advancing favorable images of the Japanese.  Chan and his 37 other members of the Chinese People’s Political Consultative Conference called on then government to punish fellow artists who insult “national integrity and dignity.”  The call follows Chinese artists who wee criticized for showing the Japanese in World War II in a positive light.  This by the way was part of the propaganda issued by the U.S. government against the Japanese. The racist elements are quite evident and shocking.  Hollywood was a critical part in our propaganda efforts during the war.  Now, over 50 years later, Chan and other artists and authors however are seeking to criminalize speech that is viewed as sympathetic or favorable to the Japanese.

Beware Of Politicians Promising An “Honest” Internet: New Bills Targeting Russians May Bag Free Speech

800px-Capitol_Building_Full_ViewBelow is my column in USA Today on the legislation proposed to combat Russian trolling and Internet campaigns.  There is a serious threat to free speech in these measures, which mirror efforts from (ironically) countries like Russia and China.  The serious threat is not a handful of Russians playing on our deep divisions, but rather the hacking operations and attempt to interfere with voting systems.

Controversial Polish Holocaust Denial Law Takes On Its First Media Target

Child_survivors_of_AuschwitzI recently criticized the new Polish law criminalizing any statements attributing the genocide of Jews to Polish forces or actions. The legislature approved a bill making it a crime to use statements suggesting Poland bears responsibility for crimes against humanity committed by Nazi Germany.  You could receive up to three years in prison for calling Auschwitz-Birkenau a “Polish death camp.”  USNews is reporting that the first target of this abusive law has now been announced: the Argentine Pagina 12 daily.  The newspaper was accused of breaching a new law by suggesting that Poland was complicit in the Holocaust.
