Below is my column in the Hill Newspaper on the highly controversial move of Special Counsel Robert Mueller to use Paul Manafort’s own lawyer as a witness against him. What is most striking about this move is that it was entirely unnecessary given the other evidence of alleged violations of federal law governing foreign agents. The case against Manafort is strong but the denial of attorney-client protections in the case should be a matter of great concern for all citizens — regardless of your view of the underlying merits of the Russian investigation.
Below is my column in USA Today on the Rick Gates indictment and his potential as a witness for the prosecution in the Mueller investigation. The other obvious concern for the defense should be General Michael Flynn. It is curious that there was no indictment of Flynn given his similar alleged violations involving work as a foreign agent. Flynn would also be a natural target for prosecutors in seeking cooperative witnesses. Washington says that he was not resisting but was slammed to the ground — resulting in a broken wrist.
CBS has fired Hayley Geftman-Gold, the network’s vice president and senior counsel, after a bizarre and disgraceful tweet saying that she is “not even sympathetic” to victims of the Las Vegas shooting because “country music fans often are Republican gun toters.” We have been discussing the free speech concerns over employees being disciplined for expressing their political or religious viewpoints on social media. However, this is a news network that contractually reserves the right to terminate employees for conduct deemed inimical to its journalistic image or mission.

White supremacist Dylann Roof says that he has something of a problem on his hands: he has court-appointed counsel who happen to be Jewish and Indian. He has asked the court to replace Alexandra Yates and Sapna Mirchandani in his appeal of his death sentence for the massacre of nine people in the Emmanuel AME Church during a Bible study in 2015. Roof appears to believe that the right of counsel includes the right to white counsel. It doesn’t. The court should not be a vehicle for racial or religious discrimination to cater to the wishes of a homicidal fanatic.

It is clear that Comey violated FBI rules and regulations — offenses that would have likely cost any of his subordinates their jobs at the Bureau when he was director.
