Under the common law, one of the more controversial rules is the “no duty to rescue rule” that says that, if you were not responsible for placing someone in danger or risk, you have no obligation to help them even when it would cost little to save their life. A New York judge has shown how far this rule extends in clearing two transit employees would did nothing but call their superiors while a woman was raped in their station.

Former Sen. Ted Stevens (R., Alaska) and his allies are continuing their implausible campaign to rehabilitate the disgraced Senator and portray the Justice Department’s gross negligence as a vindication of the ethically challenged Stevens. Alaskan legislators in the House passed a resolution demanding not only an apology from the federal government but a lawsuit to recoup his fees and costs in defending himself.

In a remarkable order, U.S. District Court Judge Emmet Sullivan appointed a special prosecutor to investigate the Justice Department lawyers who mishandled the prosecution of former Sen. Ted Stevens (R., Alaska). The order reflects a degree of dissatisfaction and distrust over the Justice Department’s own internal investigation.
In yet another break with its campaign promise to fight to restore civil liberties and privacy, the Obama Administration has made a breathtaking claim of state secrets to block a public interest organization from suing the government for illegal surveillance. There is not a scintilla of difference in the legal position of President Obama and the position of President Bush in trying to quash any effort to challenge unlawful surveillance by the government. It appears the “yes we can” means “yes we can do most anything that we want” when it comes to unlawful programs. I discussed this story on this segment of MSNBC Countdown.

NASA has captured a picture of what appears to be the hand of God reaching across space. Notably, the picture was taken as former Sen. Ted Stevens (R., Alaska) is about to appear in federal court to declare victory after the Justice Department drops its case against him.
The Justice Department is once again being threatened with contempt of court after United States District Court Judge Emmet Sullivan found that they withheld evidence from the defense that a witness in a “significant” number of cases was mentally disturbed. Judge Sullivan found that the testimony of the detainee was unreliable, could be challenged in other cases, and could be the basis for a possible contempt order against the government.
After a Pakistani minister alleged that the video of a teenage girl being flogged was a “Jewish conspiracy,” the 17-year-old girl Chand Bibi in the film has claimed that the whole thing is a hoax and that she was never flogged.

According to Pakistani Federal Minister Senator Azam Khan Swati of the Jamiat Ulema-e-Islam the flogging of the 17-year-old girl in Swat was a Jewish conspiracy. He explained that it is the work of Jews aimed at destroying peace in Swat and distorting the image of those Islamists who sport beards and wear turbans.
