Federal Judge Grants Injunction of New Tobacco Labels

We have previously discussed the new labeling rules for cigarette packages and I have not hidden my criticism of the graphic images from both a legal and policy perspective. This afternoon, U.S. District Judge Richard Leon handed down a major decision granting an injunction of the rules — a move based on his belief that the cigarette makers are likely to succeed in blocking the new packaging rules.

ABA Journal Under Fire For Coverage Of Survey Of Legal Secretaries

I often read ABA Journal as a great source of legal stories. The journal however has been the center of controversy this month after reporting on the results of a study on the preference of secretaries vis-a-vis male and female partners. The study by Professor Felice Batlan interviewed 142 secretaries at larger law firms and produced a surprising result: not a single secretary preferred female partners. When the ABA Journal reported that surprising fact, professors accused it of fostering gender stereotypes, misrepresenting the results of the study, and displaying a sexist view of the work. Some demanded a retraction and apology from the ABA Journal.

Obama Administration Fires General For Calling Karzai “Erratic” and “Divorced From Reality”

Reporters and columnists often wait until Friday for the White House to do things that it does not want covered extensively in the press. This Friday’s news dump was the firing of Maj. Gen. Peter Fuller for saying what most everyone is saying about our ally, Afghan President Hamid Karzai — he is nuts. Remarkably, Fuller said if much more nicely, expressing concern whether Karzai is “isolated from reality.” My own disappointment is that Fuller did not add that Karzai’s family is little more than a criminal enterprise fostering corruption and drug trafficking.

A Decade of Misplaced Patriotism

A milestone passed by most of us this past week.  It seems that the Patriot Act birthday cake added a 10th candle this week and there was no party!  The infamous Patriot Act turned 10 this week and a decade of attacks on our personal liberties went unnoticed by our Main Stream media.  You can probably remember that the act passed with little opposition in the House and with only 1 member of the Senate in opposition. Happier Times: Sandusky (left) with Paterno

The reports from State College, Pa are shocking. Long-time assistant to iconic coach, Joe Paterno, charged with multiple counts of deviant sexual acts with at least eight minors — most under age 12. University administrators who did nothing despite horrific credible eyewitness accounts of  explicit sexual acts in locker rooms and showers. Disadvantaged kids taken advantage of by an authority figure who founded an organization ostensibly to help them, but apparently designed to fulfill his own aberrational desires.

Richmond, VA Photographer Arrested For Trespass on Public Street

Richmond, Va photographer, Ian Graham, must be wondering where he was this past Monday as he was arrested by local police for trespassing on a city street. Graham, who was photographing police arresting demonstrators in the Occupy Richmond protest, was told by police he was trespassing as he politely stood near a public crosswalk  recording the goings on with his camera. Police claim they told Graham he could take photos but only in the designated “media area,” which was, of course, far from the scene of the arrests.

Is “In God We Trust” The Only Thing Standing Between Us and Anarchy?

We have previously discussed how leaders in both the United States and Europe have focused on atheists and secularists as one of the greatest threats facing the free world. Rep. Trent Franks (R-Ariz.) seemed to take this to a new level in arguing this week that if the nation did not reaffirm “In God We Trust” as our national motto, we are inviting anarchy and accepting that we are nothing but “worm food.”

Texas Judge Under Investigation After Daughter Releases Video of Savage Beating

County Court-at-Law Judge William Adams has become an Internet sensation, but not in a good way. A video was posted that purportedly shows the judge beating his disabled teenage daughter. Now, the YouTube video has triggered a formal investigation. The 2004 beating by the judge was reportedly due to her use of the Internet without his permission. The daughter leaked the video entitled “Family law judge beats own daughter for using the internet, please spread” to expose what she says is her father’s untreated “problem.” The daughter who has cerebral palsy was caught downloading music.

Is Justin Bieber a Dead-Beat Dad Or Rape Victim?

I rarely take much interest in celebrity story, but one legal stories this week caught my eye: a woman who is seeking paternity liability from Justin Bieber. What is fascinating is that it would seem likely that any paternity payment would be accompanied by a possible charge of statutory rape. The alleged 30-second tryst after the concert occurred when Bieber was just 16 in a state (California) with a statutory date of 18.

Who Are These People? Foreclosure Firm Staff Mock Homeless People At Halloween Party

These pictures sent to columnist Joe Nocera from a Halloween party last year show affluent people mocking homeless people with signs like this reading “3rd Party Squatter. I Lost My Home & Was Never Served!!” Under any circumstances in a devastating recession, such costumes would show callous and tasteless senses of humor. However, this was a party of lawyer with the law firm of Steven J. Baum, a “foreclosure mill” representing banks and mortgage servicers.

Police Union Under Fire For T-Shirts Reading “U Raise ‘Em, We Cage ‘Em.”

A Northern California school police officers union under fire after they sold T-shirts with a picture of a child behind bars and the slogan: “U raise ’em, we cage ’em.” The Twin Rivers Police Department in North Highlands has ended further sales after the objections of citizens.

More Wrong Than Wright: Sheriff Calls For Citizens To Arm Themselves And Mete Out Their Own Justice

Spartanburg County Sheriff Chuck Wright surprised many this week in calling a press conference to discuss an assault on a woman in one of the city parks. Wright used the opportunity to repeatedly call on all of the citizens to arm themselves and expressed frustration that someone with a weapon did not come along and take care of Walter Lance, 46, rather than have him dealt with by the justice system. Wright began his news conference by saying, “Our form of justice is not making it. . . . Carry a concealed weapon. That’ll fix it.”

Separation Anxiety: Is the Obama Administration Teaching Foreign Soldiers A Distorted View of Constitutional Law and History?

A writer for the Military Religious Freedom Foundation (MRFF) has published a startling blog entry that, if true, should be a major story on the government’s indoctrination of flawed historical and constitutional accounts in training foreign military personnel. The article below discussed material used in International Military Student Officer (IMSO) program run by the Defense Security Cooperation Agency. It is run by the military but is under the supervision and direction of the Secretary of State. The author from MRFF, Chris Rodda, quotes from the material used in the training and it is pretty shocking.
