A new AP-NORC poll is out and, consistent with earlier polling results, shows that there remains a disconnect between the media coverage and public opinion over the Biden corruption scandal. Despite the continued dismissal or downplaying of the scandal by many in the media, a massive 68 percent of Americans believe that President Biden acted either illegally or unethically in his involvement in his son’s foreign dealings.

Bob Menendez, his wife, and associates to include new charges related to his alleged work as unregistered foreign agents. The new charges not only highlight the alleged corrupt practices of Sen. Menendez, but also the absence of such charges for Hunter Biden.

Last night, many of us responded to the statement of Leon Panetta, former CIA Director in the Obama Administration, that he “has no regrets” about signing the now infamous letter of 51 former intelligence officials suggesting that the Hunter Biden laptop was Russian disinformation. Even more unsettling were his comments that he believes it could still be Russian disinformation. It turns out that even with American intelligence, the media, and Hunter Biden himself acknowledging authenticity, it can still be Russian disinformation. Panetta has become the personification of the economic theory of path dependence. No matter how much countervailing evidence is presented to Panetta, he still refuses to accept the authenticity of the laptop.
Legal academics are divided on the new popular theory that former President Donald Trump can be removed from ballots under Section 3 of the Fourteenth Amendment. While I respect many of the academics who view this as a credible interpretation, I have long opposed it as textually and historically flawed. In addition to some exaggerated claims of precedent, I view the theory as one of the most dangerous in my lifetime. One thing, however, we agree upon: it is time for the federal courts to rule on this theory to bring clarity to the election. That may now occur in West Virginia where Attorney General Patrick Morrisey wants a federal court to throw out a lawsuit attempting to remove Donald Trump from the ballot in the state. What is most striking about the filing is the accusation of judge-shopping by advocates like John Anthony Castro in seeking to remove Donald Trump from the ballot in the state. Below is my column in The Messenger on how the Speaker’s Chair has become the latest manifestation of our politics of chaos. This includes the truly bizarre suggestion of the Washington Post’s Jennifer Rubin that the GOP “invited” the terror attack in Israel by allowing eight members and the entire Democratic block to vacate the chair. While Rep. Steve Scalise (R., La.) received the most votes in the GOP caucus yesterday, the party remains divided between him and Jim Jordan (R., Oh.).
Universities and colleges across the country have become embroiled in a debate over free speech in the aftermath of the massacre of Israelis by Hamas terrorists this week. Various student groups have expressed support for Hamas or their cause while condemning Israel. Black Lives Matter (BLM) chapters have even shown the image below of one of the terrorists who paraglided into Israel where hundreds of civilians were murdered, including babies. Harvard has been a particular flashpoint over strident statements of condemnation of Israel immediately after the attack. The support has led to at least one firm rescinding an offer to a pro-Palestinian NYU law student as well as calls for universities to cut off support for student groups condemning Israel.
Jack Phillips recently celebrated two anniversaries. On Labor Day, his bakery, Masterpiece Cakeshop in Colorado reached its 30th anniversary. The other anniversary this year was less celebratory. He has now spent 11 years in court fighting for his right to refuse to make cakes that conflict with his religious beliefs. In 2012, Charlie Craig and David Mullins asked Phillips to make a cake for their same-sex marriage. As a devout Christian, Phillips declined. He would sell any pre-made cakes to customer, but said that he could not morally make a cake for same-sex marriages. Newly released evidence from the House Committee on Ways and Means reveals over $20 million coming from 23 separate countries on four continents to at least nine Biden family members. Not only are the Biden transfers becoming clear, so is the Biden family tree in this lucrative form of corruption.

We have been following the regular disruption of events on college campuses by students and groups. The latest occurred at Tufts University where pro-abortion groups organized to interrupt a panel that was planned to discuss the moral issues surrounding abortion. These groups and students did not hide their role. The question is whether Tufts will take action to discipline those responsible for blocking the exercise of free speech. In academia, one of the most common criticisms in research and discussions is that correlation does not mean causation. It refers to the logical fallacy for some who draw a cause-and-effect relationship between two events. The logical fallacy is captured in the Latin phrase cum hoc ergo propter hoc (‘with this, therefore because of this’). With the horrific attacks on Israel this week, some well-known commentators have been criticized for using the killing of hundreds by Hamas as a criticism of conservative figures or Republicans in general. That includes the Washington Post’s Jennifer Rubin who appeared to blame the GOP for inviting the attack and Professor Laurence Tribe who suggested (and later retracted) that the war was actually a “wag-the-dog” operation by Prime Minister Benjamin Netanyahu to distract from corruption allegations. We have been following the gradual elimination of common terms deemed offensive or microaggressive. The latest is the word “picnic.” After the University of Nevada Las Vegas law school’s Environmental Law Society announced a picnic, it was renamed “Lunch by the Lake” due to “diversity and inclusion” concerns. The ELS was able to avoid a second correction with a “Lunch in the Field” since “field” has also been found to be offensive at other schools. For over a year, I have been writing and commenting on California’s unconstitutional Covid gag law for physicians and other medical professionals. The law allowing the revocation of licenses for “false or misleading information” on Covid-19 was a frontal attack on free speech. Nevertheless, many lawyers supported the law and Gov. Gavin Newsom signed it. Now Newsom has quietly signed the repeal of the law after it was headed for an almost certain rejection by the United States Court of Appeals for the Ninth Circuit. All of the supporters of the law seem to be shrugging and moving on after the waste of money and time on a facially unconstitutional law. We have been discussing shareholder and consumer opposition to companies like Disney and BudLight tying their brands to social agendas and political questions. Now a Gallup survey shows that public support for these companies is continuing to fall, even among Democrats who still overall favor corporate messaging on social and political issues. Only 41 percent now approve of such corporate campaigns. However, neither public support nor sales were the driving forces behind these campaigns.
