Police are investigation the death of 35-year-old Rodney “Krook” Hawkins at the Ruby Tuesday’s in Lovejoy, Georgia. Hawkins went into anaphylactic shock when he was served Chicken Oscar, a dish with crab meat. Hawkins was fiercely allergic to shellfish.

They are called Black Cat Screech and Scream — a firework that is supposed to make a loud noise with s fountain of fireworks. I almost bought a couple this weekend with a purchase of a huge amount of ordinance for the Fourth of July. What I did not know was that they had been recalled the day before –July 3, 2008. Since the government waited until the day before July 4th, they were still be sold across the country.

First, Ray is accused to shilling donuts for terrorists, here, now her show is accused for harassing staff with eating disorders. Former accountant Aaron Ferguson has sued for his treatment by Ray’s show as he battled anorexia. He is seeking $1 million in damages. It is not the only interesting recent case involving anorexia. The parents of Janell Smith are suing after their daughter was denied insurance for her anorexia and was sent home — where she committed suicide.

In an impressive victory for the paint industry, the Rhode Island Supreme Court overturned the major verdict against three former lead paint producers. Sherwin-Williams Co., NL Industries Inc. and Millennium Holdings LLC liable secured a 4-0 sweep of the court in a setback for advocates of these cases employing a novel use of nuisance law.
Joe Horn, a man who killed two men who broke into a neighbors house will not be charged despite an audio recording in which Horn disobeys a dispatcher and seems intent on killing the men. A Texas grand jury refused to indict him for the killings in November.
The Horn case has focused attention on so-called Make My Day Laws (or the Castle Doctrine). Horn expressly cited his right to shoot the men before going outside to encounter him. For a prior story, click here and here.

Citizen groups are calling for an investigation of the death of David Woodman, a 22-year-old Emmanuel College student in Boston. According to friends, Woodman merely made a slightly snide comment to officers and was tackled by eight officers and eventually died from his injuries. The Boston police department is insisting that no excessive force was used against Woodman who was holding only a plastic beer cup.

In the last year, we have seen some alarming examples of how Canada has rolled back on free speech, particularly in cases of alleged discrimination (here and here). However, the Supreme Court of Canada has handed down a unanimous decision that offers great hope that free speech is not dead in the North. The Court ruled 9-0 in favor of controversial Vancouver radio broadcaster Rafe Mair in his libel case.

In Sweden, a family has found itself reported to Parliament for its violations of anti-discrimination laws. The offense? It’s eight-year-old boy failed to invite two children to his birthday party. It is still unclear whether the “goodie bags” will raise any additional legal questions, but party counsel has been hired for the occasion.
A 17-year-old boy was decapitated by a roller coaster at Six Flags Over Georgia. It is only the latest mishap on such rides and the matter is being investigated to determine why the teen (with a friend) scaled two six-foot fences to gain access to the off-limits areas.

New York undercover police officers filmed themselves framing four men in a drug case. The films shows that brothers Jose Colon and Maximo Colon had no contact with the officers despite their sworn statements that the men sold them drugs. The Colon brothers were ruined over the six months, it took to clear their names and are now suing.

After a stinging opinion by U.S. District Judge Denny Chin in February, NBC has thrown in the towel on its defense of “Dateline NBC: To Catch A Predator” in the suicide of a former prosecutor. Louis William Conradt Jr. shot himself after the program accused him of engaging in sexually explicit chats with an adult posing as a child. The program then allegedly pushed for his arrest when he failed to show up at a sting operation.
