The tourist was walking along a fence when she found herself in a hole that proved to be a staircase into a 350 year old vault.

While Walmart advertises Spend Less, Live Better, the company may want to just reduce it to “Spend Less.” Jay Richitelli, 42, is now the third Floridian to be bitten by a snake at a Walmart garden center in that state alone. The culprit was a pygmy rattler at the Pembroke Pines Wal-Mart.

There may be on thing that is not quite better at Here Everything’s Better stores in Texas. The chain has recalled meat that it sold due to metal fragments in the meat due to “an equipment malfunction.” The recall was issued appropriately on Friday the 13th.

Jonathan Lopez has filed a lawsuit against a professor and Los Angeles City College over his treatment after giving a speech on the Christian view of marriage in speech class. Lopez alleges that Professor John Matteson had made it clear that he supported same-sex marriage. He claims that Matteson allegedly attacked him verbally, refused let him complete his speech, effectively called him a “fascist bastard” and refused to give him a grade (telling him to “ask God” for his grade).

For years gay and lesbian couples have complained about being denies access to loved ones in hospitals. Now, a lawsuit has been filed in Miami in which Janice Langbehn alleges that she was prevented from being with her partner of 18 years, Lisa Marie Pond, 39, as she died at Jackson Memorial Hospital after a brain aneurysm. The reason for the denial was never made clear to her.

U.S. District Court Judge Keith Ellison gutted the defamation case of Roger Clemens against his former trainer Brian McNamee. As discussed on this blog, the case was unlikely to succeed and seemed part of Clemens’ public campaign to defend his reputation. Now, he is more likely to appear in court as a criminal defendant than as a civil litigant.

He is suing the judge for libel and slander. The case raises provocative questions about not just recusal but defamation.

Former New York Mets player Roberto Alomar has been sued by his former girlfriend, Ilya Dall, 31, who says that Alomar gave her AIDS from unprotected sex. Once rare in torts, claims of negligent or intentional exposure to sexually transmitted diseases (STDs) has become much more common in American courts under theories of negligence or battery or infliction of emotional distress. She is suing the Puerto Rican baseball star for $15 million.
The Fresno Police Department is investigating two officers videotaped beating a homeless man during his arrest. In the video below, the man, Glen Beaty, 52, is shown on the ground receiving hits to the head. Police Chief Jerry Dyer acknowledged that ‘the initial reaction of people that view this video will be one of disbelief.”

Jeremy Lusk, an American freestyle motocross racer, died of head injuries this week after failing to complete the rotation in a “Hart Attack backflip.” The move caused severe brain damage and possible spinal cord injury. The accident follows complaints over the danger of such activities, particularly for kids trying to mimic their heroes. The video below raises serious questions about the safety of this sport.

Texas Judge Pat Shelton has already attracted a great deal of controversy over his role in the defense of his daughter, Elizabeth Shelton, who was convicted of drunk driving that led to the death of her boyfriend, Matthew McNiece. Not only did Shelton sue the car that she hit but Judge Shelton attacked the man who is credited with saving his daughter. Now, Judge Shelton is accused of not paying his legal bills in the case.

Sherrie Russell-Brown, a former law professor at the University of Florida Levin College of Law has filed a racial and sexual discrimination lawsuit against the school and its dean. Her allegations could force the entire faculty to face discovery and a potential trial on actions taken against her and statements made in faculty meetings. She has named Dean Robert H. Jerry, the University of Florida and its board of trustees as defendants.

As Congress struggles to understand the shocking report of a massive increase in suicides in the Army, they might want to study the case of Army Pvt. Adam Lieberman to see how some officers treat soldiers in mental distress. Lieberman was experiencing severe mental problems after a year in Iraq qith the Ist Battalion, 67 Armored Regiment — known as “the Death Dealers.” When he tried to kill himself, he wrote his suicide note on the wall in his room. The Army reportedly responded to the suicide attempt by charging him criminally and cut a deal with this mom. If she re-painted the wall, his charges would not include defacing of government property. After she painted the wall with the help of her handicapped sister, they charged him anyway with the crime.
