French Baker Fined For Refusing To Work Less

cropped-liberty.jpgWe have previously discussed the continuing debate over France’s generous vacation and work regulations — and their impact on productivity.  Anyone who goes to France in the summer will find most stores shut at the peak of tourist season as the French take off for month long vacations.  One Frenchmen however wanted to work . . . and he now going to pay the price for productivity.  In Lusigny-sur-Barse, a baker has been ordered to pay a €3,000 fine for refusing to close his shop and work less.

Saudi Arabia flagWe have previously discussed how Saudi princes and princess routinely flee debts and criminal investigations (here and here and here and here and here).  Now France has issued an arrest warrant for the sister of Saudi crown prince Mohammed bin Salman after she allegedly ordered her bodyguard to beat up a contractor in her Paris apartment.  Princess Hassa bint Salman (aka Hussat ben Salmane) is named in a warrant.

Penn Law Professor Removed From First-Year Classes After Controversial Statements

downloadThere is a major controversy unfolding at Penn Law School.  Professor Amy Wax has been removed from first-year courses after making controversial comments about the performance of black students at the school.  Regardless of the merits of Wax’s comments, the action raises serious questions over academic freedom and free speech.  We have been discussing controversies over academics being punished for controversial views including two recent cases involving the use of the “n-word” in classes on offensive speech at DePaul and Princeton.

The Ultimate Loser In The Stormy Daniels Saga Could Prove To Be Trump’s Lawyer

donald_trump_president-elect_portrait_croppedBelow is my column in USA Today on the expanding litigation over the Stormy Daniels controversy and specifically the precarious ethical position for Trump’s longtime counsel, Michael Cohen.  One interest development was the move by Daniels’ counsel (and my former research assistant) Michael Avenatti to get a new judge in the Daniels case.  Avenatti argued that it was inappropriate for the case to be heard by Los Angeles Superior Court Judge Elizabeth Feffer because she is seeking a federal judgeship from President Trump.  The move was surprisingly successful and the case was transferred to Judge Howard Halm.  Like Feffer, Halm was appointed by former California Gov. Arnold Schwarzenegger (R).

Here is the column:

Rich Family Sues Fox Over “Sham Story”

150px-Foxnewslogo.svgThe family of the late Democratic National Committee Staffer Seth Rich has sued Fox News for intentional infliction of emotional distress and related torts in the airing of allegations of a conspiracy involving Rich and Wikileaks.  Despite my great sympathy for this family in the loss of Seth Rich, the complaint (below) is in my view without serious merit.  The causal connections are too attenuated and liability would undermine first amendment protections for the free press.

Report: Sessions Considering IG Recommendation For The Firing Of McCabe

McCabeI recently wrote a column about the expected finding of the Inspector General that former Acting FBI Director Andrew McCabe misled investigators about a leak to the media. The finding raises the question of consistency in criminally charging Michael Flynn for the same alleged act.  There is now a report that the IG is recommending not a criminal referral but that McCabe be terminated, even though he is literally days from retirement.

250px-United_Airlines.svgUnited Airlines is under fire after a flight attendant ordered a pet dog to be placed in a passenger’s overhead bin on a flight from Houston.  When United Flight 1284 arrived in New York, the French Bulldog “Kokito” was found dead.  The horrific scene could well result in a tort action for negligence, intentional infliction of emotional distress and other claims.  As a common carrier, United is subject to a high standard of care in the treatment of passengers.

In a story that is likely to resonate in the national debate over President Donald Trump’s push to get teacher’s armed in school, a teacher at Seaside High School in Sand City, Ca. injured a student when his gun discharged in a class.  Even more embarrassing is that the class was on gun safety.

Trump Offers To Meet With Mueller, But Is It Too Late For Damage Control?

440px-Director_Robert_S._Mueller-_III-1donald_trump_president-elect_portrait_croppedBelow is my column in The Hill newspaper on the effort of the Trump legal team to reach deal to have the President sit down with the Special Counsel in exchange for certain conditions or concessions.  The problem is a matter of timing.  As has been a repeated problem, the Trump team seems a couple steps behind the unfolding controversy.

London Mayor Joins Call For Censoring and Fining Internet Companies

England flagThe mayor of London, Sadiq Khan, used the annual SXSW festival in Austin to join other European leaders in calling for tech companies to censor hate speech and be subject to government regulations for fines for violations.  Khan read hateful messages against him to support the need for a crackdown — ignoring the free speech implications of such government regulation.

Hillary Clinton Again Claims That She Lost Because White Women Are Controlled By Their Husbands

Hillary_Clinton_Testimony_to_House_Select_Committee_on_BenghaziWe have previously discussed how Clinton has compiled  a long list of people responsible for her loss to Donald Trump with the notable exception of herself.  This includes her explanation (and her supporters) that it was not Clinton but self-hating, misogynistic women who could not vote for any woman for President.  Despite the criticism over her past statements and additional polls showing that she remains hugely unpopular with many voters (and would still lose to Trump), Clinton continues to blame others for her loss.  In a speech at the India Today Conclave, Clinton repeated her view that white women are under the thumb of their husbands and vote as they dictate.

Ex-Nobel Secretary Admits Obama’s Prize Was A Mistake

Nobel_PrizePresident_Barack_ObamaLike many people, I was highly critical of the awarding of the Nobel Award to President Barack Obama in 2009 before he had done anything as president.  Now the ex-Secretary for the Nobel Prize Geir Lundestad has admitted that Obama did not deserve the prize but rather they thought the award would strengthen Obama.  It is a maddening admission that the committee bypassed a list of worthy candidates with proven contributions to humanity to give a boost to someone that the Committee simply liked. That would seem grossly unethical but Lundestad merely acknowledged that it did not seem to work.

Warren: I Will Not Take A DNA Test

official-portraitWe have been following the controversy over the claim of Native American ancestry by Sen. Elizabeth Warren and the continued criticism from President Donald Trump who continues mock her as “Pocahontas”. Recently, we discussed Warren’s surprise speech doubling down on her claim and whether Warren would simply take a DNA test to put the matter to rest.  The suggestion was echoed by the media in Massachusetts like the Berkshire Eagle  For $100, the question is why let the matter simmer. Warren answered that question this weekend and the answer is no.
