Unlearning The Constitution: University President Declares That Biden Can “Unpardon” Trump

We have repeatedly discussed how legal experts over the last four years have adopted ever expansive interpretations of statutory and constitutional provisions to argue that President Donald Trump could be indicted or impeached on a myriad of different grounds. This includes the reliance on interpretations long rejected by the Supreme Court.  Some issues are manifestly closer like the long-standing question of presidential self-pardons. While I have long maintained (before the Trump Administration) that a president can self-pardon, I have always said that this is a question with good-faith arguments on both sides. Recently, however, experts have brought the same claims of clarity on this question to assure the public that the argument for self-pardons is “incoherent and incompatible” with the Constitution. Ken Gormley, president of Duquesne University, is one of those who supported impeachment and rejected any basis for self-pardons. He has now however gone one better and claimed that Joe Biden can “unpardon” Trump if he does grant himself a self-pardon.

“How Scared Should We Be?”: CNN’s Jake Tapper Leads Show With “Conspiracy In the Oval Office” On Possible Declaration Of Martial Law

Yesterday, the media erupted with the latest bombshell stories of how President Donald Trump is discussing plans for martial law and the appointment of former Trump campaign lawyer Sidney Powell as a Special Counsel. It was a familiar bomb and bust pattern. A fair basis for coverage on the meeting quickly mutated into what bordered on panic coverage on the threat of a military takeover. This morning Jake Tapper headlined his show with “Conspiracy in the Oval Office” on how Trump discussed imposing martial law. He asked “How scared should we be?”  The answer is not very on either count. President Trump publicly denied the report as “fake news.”

Comedic Relief: Biden Declares Hunter Investigation Just More “Foul Play” By Political Operatives

We had breaking news Thursday night: Joe Biden is proud of his son Hunter. After a blackout on the Hunter Biden scandal before the election, it often seems as if the media is struggling to offer the appearance of coverage without actually asking questions that could be damaging for the president-elect.

That view of many was reinforced in the first interview with Biden about his son since the November election. It was conducted by CBS’ Stephen Colbert, host of “The Late Show with Stephen Colbert.” Biden has refused to answer questions on the expanding scandal surrounding his son’s China connections so this was a big deal. However, the president-elect’s team arranged for the all-important question to be asked by a comedian on a late-night show. Rudy Goes Full Shlomi? Video of Giuliani Shilling For Cigars and Gold Coins Raises New Representation Concerns

I will admit to being highly critical of Rudy Giuliani’s representation of President Donald Trump for many years (here and here and here and here and here and here and here). He has consistently made statements in interviews that seem diametrically at odds with the interests of his client and his comments have repeatedly forced later corrections or clarifications by the White House or himself. This history led to his prior firm severing ties with him. However, despite that history, nothing prepared me for the video posted by the Recount showing Giuliani breaking off from detailing allegations against Hunter Biden to shill for cigars and gold coins. To be honest, the video comes across as Lionel Hutz of the Simpsons meets Offer Shlomi of ShamWow.  Some have raised renewed questions of whether he is helping or hurting his legal team.  I do not view this commercial as a bar violation though it raises an increasing issue over the ethical rules governing dual roles of counsel.

Former DNC Official: “We Should Give Eric Swalwell The Congressional Medal Of Honor For His Conduct”

There continues to be a virtual news blackout on coverage of the scandal involving House Intelligence Committee member Rep. Eric Swalwell reportedly having a long intimate relationship with a Chinese spy named Fang Fang.  Some however were not content to simply ignore the story.  In a more worthy of Shakespeare’s Julius Caesar, Brad Woodhouse, the former DNC Communications Director, went on Fox News not to bury Swalwell but to praise him.  Asked whether Swalwell should have been left on the House Intelligence Committee after an alleged intimate relationship with a Chinese spy, Woodhouse declared Swalwell did everything right after being notified by the FBI. He then added “we should give Eric Swalwell the congressional medal of honor his conduct.” As a military history buff, the comparison did not sit well with me, but it was particularly odd coming from Woodhouse. Cuomo v. Cuomo: Did The New York Governor Make The Case Against Himself With Kavanaugh?

There remains a blackout on the sexual harassment allegations against Democratic Gov. Andrew Cuomo by most major media outlets. Putting aside the striking lack of interest in comparison to the allegations raised against Justice Brett Kavanaugh, the controversy from that confirmation fight could raise difficult questions for Cuomo who not only insisted that Dr. Christine Blasey Ford must be believed but demanded that Kavanaugh take a polygraph examination.  It is not clear if Cuomo will now follow his own standard and take a polygraph examination arranged by others. Below is my column in the Hill on the Hunter Biden scandal and how the media is attempting to cover a story that was dismissed as Russian disinformation throughout the campaign. The media like the Daily Beast is spinning the sudden disclosure of one and possible two related investigations as based on details that were “largely unnoticed” before the election. They were of course noticed. They were largely ignored.

CNN’s April Ryan Strikes Out At Reporters Disclosing Embarrassing Comments From Joe Biden

We have been discussing the open bias shown by the media in the last four years. It is not clear if we can regain the ground lost for journalism as even journalism professors call for the rejection of objectivity in favor of advocacy. This has included shielding Joe Biden from any challenging questions during the recent election. That includes the news blackout on reporting on the Hunter Biden scandal, the subject of my column today in the Hill. CNN’s April Ryan personifies this trend. Even as the media is facing widespread criticism for burying the Hunter Biden story (and is now doing the same with the Swalwell scandal), Ryan lashed out at confidential sources responsible for leaking a recording of Joe Biden making embarrassing comments about the “defund the police” movement. Ryan is demanding to know who is responsible for allowing the embarrassing comments to be made public despite her past enthusiastic discussion of such leaks against President Donald Trump. Whitmer Defends Democratic Rep Over Violent Rhetoric As Other Democrats Seek diGenova’s Disbarment For His Comments

There is an interesting contrast developing in two controversies.  We recently discussed how legal experts demanded that Joe diGenova be disbarred for recently saying that Cybersecurity and Infrastructure Security Agency head Chris Krebs should to be “drawn and quartered” for his failure to protect this election.  Krebs has filed a legally dubious lawsuit against diGenova. Yet, in Michigan, Gov. Gretchen Whitmer and other Democrats have defended Rep. Cynthia Johnson who called out for “soldiers” to “make [Trump supporters] pay” for their criticism and harassment of her. Those who insisted on disbarment and other measures for diGenova are conspicuously silent about such overheated rhetoric from the left.

Is the Media Burying The Swalwell Story?

We often discuss media coverage and accuracy on developing legal and political controversies.  Much of this discussion recently has focused on the bias shown by the media in the last four years. I have worked for the media as a legal analyst and columnist for years, but I have never before seen this raw and open bias in major media. At the same time, academics are rejecting the very concept of objectivity in journalism in favor of open advocacy.

This morning, Fox News called out all of the networks for zero coverage of the bombshell story from Axios that Rep. Eric Swalwell may have had a close relationship with a suspected Chinese spy who fled to China a few years ago.  Many of us were struck by the lack of coverage, particularly given the position of Swalwell on the House Intelligence Committee and his former bid for the presidency. It was particularly striking when the media is now reluctantly covering the Hunter Biden story after a long blackout before the election. Yet, the most stark comparison is with the exhaustive coverage given the highly analogous story involving an alleged spy, Maria Butina, who had an affair with a high-ranking figure in the National Rifle Association. YouTube Declares It Will Censor Videos Questioning Biden’s Victory

We have have been discussing how writers, editors, commentators, and academics have embraced rising calls for censorship and speech controls, including President-elect Joe Biden and his key advisers. The erosion of free speech has been radically accelerated by the Big Tech and social media companies. The level of censorship and viewpoint regulation has raised questions of a new type of state media where companies advance an ideological agenda with political allies.  The state media criticism was never more compelling than in the announcement of YouTube this week that it would now remove videos that question the victory of President-elect Joe Biden.  The election is over but YouTube will now scrub away any dissenting views that the election was marred by fraud. It now appears to be protecting history itself from things deemed disinformation — the ultimate calling of the corporate censor.

Hunter Biden Is Under Federal Investigation

Hunter Biden confirmed yesterday that he is indeed under investigation by the U.S. attorney’s office in Delaware for possible tax violations.  For years, the media has maintained a virtual blackout on Hunter Biden stories even as some of us noted that a 2019 subpoena indicated an active criminal investigation. Apparently, there was no way to “say this nicely” so the media said virtually nothing at all. The son of the incoming president will now be investigated by his father’s Justice Department. In the meantime, many in the media are still struggling with the journalistic version of the denial stage in the KüblerRoss stages of grieving.  The move during the lame duck period could reflect a desire to iron plate the investigation before the arrival of a Biden Justice Department. It will certainly add a new complication to any already difficult situation with a pending Special Counsel investigation.
