Stranger in a Strange Land: ABA To Hold Session On The Cultural Defense

200px-AbalogoI will have the honor of serving as the moderator on a panel at the American Bar Association’s conference in Washington, D.C. today. The panel is entitled “Stranger in a Strange Land: Cross Cultural Issues in the Courts.” This is part of an internationally successful program organized by Judge Hon. Delissa A. Ridgway of U.S. Court of International Trade. Judge Ridgway has brought together jurists and lawyers from around the world to discuss difficult cultural issues that are increasingly appearing in criminal and civil cases. These cases deal with arguments or defenses that turn on the cultural norms or practices of a given defendant or litigant. The cases have forced the question of when and how courts should recognize such defenses.

SUV Driver Almost Kills Three Children By Inches After Speeding By School Bus

I am not talking about the occasional mistake to see a stopped bus, but people who intentionally drive around buses and children so not to be delayed or inconvenienced. The video below shows just how thoughtless and dangerous these idiots can be as a driver of a SUV missing killing three children by inches after speeding through the space between the bus and the curb.

Baltimore Burning: Video Shows Protester Sabotaging Fire Hoses As Mayor Denounces “Thugs” Destroying Her City

Screen Shot 2015-04-28 at 6.59.57 AMThe video below sums up the worsening situation in Baltimore. Protesters have been sabotaging fire hoses to stop the Fire Department from saving buildings. The CVS in this case was first looted and then burned (as have other business and cars). When the Fire Department showed up, this man punctured the hose to frustrate efforts at putting out the fire. In the meantime, Baltimore Mayor Stephanie Rawlings-Blake denounced the “thugs” in the streets of her city. She however added another mangled quote after her earlier assurance that the police would give protesters “space” to destroy. For the riots consuming the city during the afternoon and in the early evening. The mayor objected that the city is being “destroyed by thugs who in a very senseless way are trying to tear down what so many have fought for.” People immediately asked if there was a sensible way to tear down the city.

Baltimore Mayor: “We . . . Gave Those Who Wished To Destroy Space To Do That.”

mayorWith looting and rioting increasing in Baltimore, Baltimore Mayor Stephanie Rawlings-Blake caused a bit of a stir in her press conference by explaining that she instructed police to not only give protesters room for the exercise of their free speech but “we also gave those who wished to destroy space to do that as well.” The problem is that images of people being stripped of their bags and belongings in broad daylight seemed to confirm precisely that type of space. It is perhaps the most botched quote in the history of botched quotes.

Carnegie Deli Shutdown Amid Allegations Of Dangerous Illegal Gas Line

300px-Carnegie_deli_exteriorI am beginning to think that the Almighty is intervening to get me to eat better. After the closing of our favorite hot dog joint in Chicago, Hot Doug’s, last week saw an announcement that my favorite burger place in Chicago, Ed Debevic’s, was closing its most famous location (where our family has gone religiously for years) to make way for a new high rise. Now, as my family is still reeling from the news, city officials have shutdown our favorite New York deli, Carnegie Deli. I have gone to Carnegie since I was a kid and my kids are now equal fans. However, the owners of this highly profitable deli are accused of possibly stealing gas and endangering customers.

Putin Does Not Twerk: Women Jailed For Twerking In Russia

Russia-jails-women-in-twerking-video-at-WWII-memorialA Russian court has sentencing two women and a teenager to 15 days jail time for twerking. That’s right, twerking. The women filmed a dance video with twerking in front of a World War II memorial. The timing could not be worse — or better — depending on your perspective. The Putin regime is using the 70th anniversary of the Allied victory to rally citizens. The court ruled that the twerking constituted “hooliganism.” You will recall that this is the same undefined crime used to jail two members of punk band Pussy Riot to prison for two years for an impromptu protest at Moscow’s main cathedral in 2012.

Perils of the Press: Journalists Videotaped As They Are Attacked By Both Protesters and Police In Baltimore

kidsRussia Today is showing a less than positive image of the United States as a video shows its reporter trying to report on the protests in Baltimore last week only to be mugged on camera. Fortunately, police were in the area and apprehended the suspect. In the meantime, another disturbing video shows City Paper Photo Editor J.M. Giordano was tackled and beaten by Baltimore City police outside of Western District headquarters last night while covering the protests. The attack on a journalist by police was accompanied by the arrest and charging of another reporter for disorderly conduct.

Sixty Yazidi Girls Per Month Reportedly Commit Suicide After Rape By ISIS Terrorists

yazidi-women-facing-wallAccording to an Iraqi based aid worker, who identified himself only as Yousif, approximately two girls a day commit suicide in the aftermath of being raped by ISIS Terrorists. The news and other corroboration of reports of inhumanity directed toward women in girls are unimaginable. Compounding the horror experienced from gang rapes in open streets, being sold into sexual slavery, or subjected to other outrages is both the stigma and shame forced onto women and girls–a furtherance of ISIS’ crimes against humanity. It also shows a macabre window into a policy of ethnic cleansing by ISIS at several levels.

Probative or Prejudicial? Prosectors Allowed To Show Picture of Tsarnaev Making Obscene Gesture Before Arraignment

220px-BostonSuspect2The testimony at the penalty phase for Boston Marathon bomb Dzhokhar Tsarnaev could not be more damning in terms of the pain and suffering that he and his brother caused. Survivors detailed their suffering from injuries as well as lost loved ones with pictures that left many in tears. Such evidence is entirely appropriate as the jury debates whether to impose the death penalty on the 21-year-old defendant. One piece of evidence, however, is more controversial: the court allowed the prosecutors to show the jury a videotape of Tsarnaev flipping the bird at a camera shortly before his arraignment to show that he was not repentant after his arrest. The question is whether such a videotape is clearly probative or too prejudicial for the jury. It is a demonstration of how far the prosecutor is willing to go (even in the creation of an appellate issue) to secure a death sentence in the case.

Video: U.S. Marshal Shown Rushing Woman and Smashing Her Cellphone To Stop Her Videotaping A Public Arrest

New reports indicate that the officer holding an automatic weapon in the videotape below who is seen charging the woman and smashing her phone on the ground is a United States Marshal in California.

Police Arrest Precious In Nicetown For Vicious Hit-And-Run

Precious_Coleman-1024Precious Richardson Coleman, 29, is facing a particularly strong prosecution case in a remarkably disturbing criminal case. Coleman is accused of purposely running over Beatrice “Dee Dee” Spence, 24, and her uncle Damon Watson, 37. She allegedly targeted Spence with her 2004 white Dodge Durango in a jealous rage — resulting in the amputation of Spence’s leg. A video before shows her speeding up in the Nicetown neighborhood of Philadelphia, jumping the curb, and then backing up on the street before fleeing. She is charged with two counts of attempted murder and related offenses. The attack also left Spence without a home after her mother ran out to help her with fried chicken cooking on the stove. Iranian Dog Torture Video Sparks Outrage

blind_dog250px-flag_of_iransvgWe have previously discussed violence and legal measures targeting dogs by some Muslims who view canines as “unclean.” Even postcards with dogs and service dogs (and here) have raised the ire of some Muslim groups. Now this issue is getting some long-needed attention in Iran after a short film that showed stray dogs being tortured and killed by having acid injected into them.

St. Louis Marathon Officials Strip Woman Of Victory After Allegations Of Cheating

AAba06j.imgWe have another Rosie Ruiz controversy of someone who took credit for winning a major marathon only to be accused of skipping much of the race. Kendall Schler celebrated her victory at the St. Louis Marathon on April 12th only to have her title taken away after marathon officials discovered that she cheated. Officials say that they believe that she slipped onto the course after the last checkpoint — a conclusion reinforced by the fact that Schler did not register any times on the route. It is interesting that there is no threat of a lawsuit either by the race or by Schler, who would presumably sue in defamation if she had indeed run the race.

Pakistani Husband Learns Wife Went To Visit Her Sister Without Permission . . . So He and His Father Beat Her And Then Burn Her Alive

We have yet another horrific “honor killing” — this time in Pakistan. Muhammad Siddique became outraged when he learned that his wife, Shabana Bibi, 25, had not asked him for permission to leave the house to visit her sister so he and his father beat her, doused her with gasoline, and burned her alive. The only good news is that the authorities have arrested the father and son and charged them with murder as well as terrorism.

Over the last few years we have seen many stories and articles that discuss the problems States and Municipalities are having in paying their public pension payments and how various politicians propose to fix those “problems”.  The politicians almost always seem to blame the pension problems on the overpaid government workers and their unions. The idea that Wall Street might have something to do with these government pension plans being underfunded is rarely discussed.  Until now.

A significant portion of the funds deposited in government employee pension plans is invested with Wall Street. According to one recent study, the public pension plans are paying at least $5.4 Billion dollars each year to Wall Street. Continue reading “Follow The Money”
